Hi,

I'm trying to understand the phrase at the end of this sentence, which is an article in a statute of a charitable foundation:

"La decisione di scioglimento, tuttavia, deve essere presa all’unanimità ed in tal caso il Consiglio è tenuto a stabilire la destinazione del patrimonio nell’ambito della propria struttura normativa".

My translation:

"The decision to dissolve [the Foundation], however, must be unanimous and in this case the board is required to establish how the assets are to be allocated, always in accordance with ***its own scope and purpose."

I am translating what I think is the sense of the phrase in question. That is, the assets should be allocated according to the Foundation's aim to allocate assets for charitable purposes, such as education, aid and scientific research in developing countries.

However, reading the sentence correctly, "its" must refer to the board (of trustees), not the foundation. So "nell'ambito della propria struttura normativa/its own regulatory structure" indicates the rules which govern the board. And so perhaps the translation should be "in accordance with its own regulatory structure"? Could I bend it and say "in accordance with the rules governing it"?

To: Asker I think that the "struttura normativa" means the foundation's articles of association. "Regulatory structure" is broad enough to cover the articles of incorporation (or association). It is acceptable in my opinion.

Here is my 2 cents worth
"However, the decision to dissolve the Foundation, must be according to its charter and unanimous and in this case the board is required to establish how the assets are to be allocated."
The syntax can be changed as long as all the ideas are intact. Italian rules for reference, cohesion and coherence need to be those used in English.
