Procuro uma tradução de magistrado no contexto do Ministério Público.

As respostas a não dar são:
Magistrate (veja Dicionário Marcílio)
Prosecutor (pois o MP tem funções fora da ação penal, e o magistrado que representa o Estado num processo civil ou administrativo, ou num processo em que o Estado é réu, não é um prosecutor.)
Judge (por motivos óbvios).

Sei bem que está pergunta não é de resolução fácil já que não existe a figura/posição equivalente nos sistemas da common law.

My resolution of the problem The translation I have finally adopted for magistrado do Ministério Público is:
law officer of the Attorney-General's and Public Prosecutions Department

Why?:

Law officer: because although magistrados do MP are clearly not a type of judge, they are tenured state officers with a clearly defined role in the judicial system.
of the Attorney-General's and Public Prosecutions Department: this reflects the fact that the role of these law officers and of the Department for which they work, is not limited to the investigation and prosecution of crime, but includes the representation of the state in civil. administrative, tax and public accounts matters, an advisory role in court with regard to the law, defence of legal rights and the public interest, representation and defence of minors, the absent and persons under a disability.

Os magistrados do Ministério Público Encontrei um comentário relevante ao assunto no Vocabulário Jurídico, De Plácido e Silva, 28ª Edição, na página 873.

Magistrado: Em sentido estrito, é o vocábulo tecnicamente empregado para designar o juiz, ou seja, a autoridade judiciária, a que se comete o poder de julgar as questões jurídicas.

Os membros do Ministério Público, neste aspecto, não são magistrados; não têm autoridade para julgar. Não são julgadores, no sentido fundamental do vocábulo, nesta acepção."

Olá Décio, Obrigado, mas tribunal é court, judiciary é magistratura (mais ou menos e é composta tanto pelos magistrados do MP e como pelos magistrados judiciais (juizes), master é um tipo de juiz que decide questões de processo.

Hi, Mark: A 'Senior Prosecution Clerk' might also do the trick, though CPS law clerks in E+W - because of the volume of work - aren't always legally qualified, hush, hush..... or how about prefixing - with 'tenured, Senior' - Law Officer as in FHS Bridge's Lux. etc. FRE / ENG entry for a magistrat debout.

Whilst 'Treasury Junior' - normally but not always a 'Senior' Barrister in terms of rank rather than age - had in fact been the first thought that occured to me for E+W, I kept off the civil Scots-law term of Career *Advocate Depute* as not strictly within the orbit of an Anglo-Am. My other hunch was a 'Government Solicitor-General' - again often a Barrister in E+W and as a fuzzy match for the Spanish of Letrado del Estado, Solicitor being one of the sub-categories of a US Am. Deputy District Attorney.

Hi Adrian, Your is the first novel answer. What I am seeking is a good equivalent term for what in Portuguese is referred to as a magistrado do MP and in French as a magistrat debout, i.e. a career jurist employed by the Ministère Publique, so Treasury Counsel is near, but not quite. The answer is always going to be less than perfect, but I am tending towards law officer (in the Department of Public Prosecutions) adopting the US meaning rather than the UK meaning. Any thoughts?
Adopting your train of thought, "treasury devil" is another option that would certainly confuse the masses.

Mark, você não postou o termo no contexto do documento. Não dá para saber. Mas o termo costuma se referir a uma pessoa não a um órgão. Pela definição "o magistrado" poderia até ser um órgão, mas precisamos ver o termo no contexto. Geralmente, o termo se refere a um juiz e eu sempre traduzo como "high justice" ou "high judge". Porém, se for um membro do MP, não pode ser isto. Poste um trecho com o termo para a gente ter uma ideia, por favor.

Mark, note que o "Poder Judiciário" inclui os tribunais, o MP e os órgãos de segurança pública. Portanto, procuradores, delegados, etc. também seriam, teoricamente, autoridades judiciárias, não apenas os juízes.

Olá Mario, os magistrados do MP nem julgam nem decidem os processos em que intervêm, a sua função é de acusador, nos processos penais, de representante do Estado, de interveniente que presta a sua opinião ao tribunal sobre aspectos de direito ou interesse público, ou que advoga a favor dos menores, ausentes e inabilitados. Assim e SMP são nem justices nem judges.
Obrigado Mário, uma sugestão interessante, mas a autoridade não seria o Ministério Público/Procuradoria-Geral e não o magistrado? Mesmo assim, seria qual o termo equivalente em inglês?
