Desde un punto eminentemente práctico podríamos decir que, en general, los vendedores deberían ser cautos y breves al describir el producto; puede ocurrir que, al amparo de algún ordenamiento jurídico, el comprador en un escenario de mercado a la baja pueda resolver el contrato si la mercancía entregada varía respecto de la descripción contractual, argumentando incumplimiento de la obligación de entregar la mercancía pactada/descrita en el contrato.
From a practical point of view we can say, in general, the sellers must be careful and brief to describe the product; it can happen that, under a legal regulation, the purchaser in a market arena on the wane can determine the contract if the delivered goods change concerning to the contract description, arguing non-compliance of the liability to deliver the agreed/described goods in the contract.

I understand it to mean that in a declining market (declining demand for the product) the buyer can get out of a purchase contract by claiming that the merchandise does not meet the contract terms. I think "on the downswing" is a good term for the context.
