Italian term

atto di citazione testi

Italian to English Law/Patents Law (general)
l'atto di citazione dovrebbe essere il wirt of summons.
ma so che ci sono anche witness summons e subpoena ad testificum
e quindi mi sorgono dei dubbi

Questo atto di citazione testi è un atto conforme all’art. 250, comma 3, c.p.c. e all’art. 103 disp. att. c.p.c. redatto da un avvocato difensore che cita delle persone a essere sentite in un'udienza in qualità di testimoni in una causa (e la mancata comparizione può comportare una pena pecuniaria)

Ringrazio per la collaborazione!

Subpoena used to be civil justice in England & Wales and witness summons in criminal process. Now witness summons is used for both.

The question does not spell out which the 'causa' is, but assumed not be a Court Martial in 'service' (military law).

I believe this is likelier to be a subpoena ad testificandum vs. testificum, rather than a subpoena duces tecum - bring the evidence with you.
Example sentence:

A subpoena duces tecum or subpoena for production of evidence.. The term subpoena duces tecum is used in the United States, as well as some other common law jurisdictions such as South Africa and Canada.

Peer comment(s):

neutral Andrew Bramhall : Why confuse everything with all the Latin? 'subpoena' for AE would have sufficed;the rest is just showboating;

The asker doesn't stipulate for AE. Otherwise, as you wouldn't know, Lord Woolf's anti-Latin = anti-Pontius Pilate England & Wales civil justice reforms in 1998 did away with civil-form subpoena to keep a single term of witness summons for civ. & crim.
agree Angelo Berbotto : there is nothing wrong with expounding the differences, in particular, if that is Adrian's specialism as a barrister
