This is from an expert's report in a civil case in Tunisia.

حيث أن المنوبة شركة الاسم مقرها بتونس ... إلى أخره

وحيث أن المنوبة وعلى خلاف ما تدعيه الضد ... إلى آخره

The منوبة is the same party that is named elsewhere in the document as المدعية in the case. Is this simply another word for plaintiff, or does it mean something else? Please provide references or examples to substantiate your response.

I'd also appreciate help with the term الضد.

I mean the client can be the plaintiff, the defendant, or the principal, in most cases.

"نائبها" in the above example refers to her lawyer or solicitor.

"الضد" is the opposing party, whether the plaintiff or the defendant.
"As the client, contrary to what the (plaintiff/defendant) claims, is ..."

Thank you. I was confused because the plaintiff is not the expert's client, but I now realize that the expert is quoting the plaintiff's lawyer. I'll select your answer once the site allows me to do so in 24 hours :)
