Se formula al amparo del articulo 5.4 de la Ley Organica del poder Judicial, por vulneracion de preceptos constitucionales, concretamente del articulo 25.1 de la Constitucion Espanola, que establece el principio de legalidad en materia penal y la irretroactividad de la ley penal en perjuicio del reo.

: no me especializo en el tema. pero buscando en google sólo encontré 68 sitios con la palabra "irretroactivity", y en yahoo, aún menos: 33. por lo que no estoy del todo seguro que sea el término adecuado. pero insisto, no me especializo en el tema.
