رئٌس السلطة الوطنٌة الفلسطٌنٌة
بعد اإلطالع على القانون األساسً لسنة 2112م وتعدٌالته،
وعلى قانون رقم )0 )لسنة 2111م بشأن الجمعٌات الخٌرٌة والهٌئات األهلٌة،
وعلى قانون مزاولة مهنة تدقٌق الحسابات رقم )9 )لسنة 2112م،
وعلى قانون رقم )2 )لسنة 0999م بشأن تنظٌم مهنة المحاماة وتعدٌالته،
وعلى قانون رقم )01 )لسنة 0991 بشأن الترجمة والمترجمٌن،
وعلى قانون مثمنً األراضً رقم )22 )لسنة 0921 وتعدٌالته،
وعلى قانون أطباء األسنان رقم )0 )لسنة 0921 وتعدٌالته،
وعلى قانون رخص المهن رقم )99 )لسنة 0911 وتعدٌالته،

وعلى النظام الداخلً للمجلس التشرٌعً، السٌما المادة )10 )منه،
وبنا ًء على ما أق بتارٌخ 1/2/2102م ّره المجلس التشرٌعً فً جلسته المنعقدة
وبعد أن أصبح القانون مصدراً بقوة المادة )20 )من القانون األساسً المعدل لسنة 2112
وتعدٌالته،

المادة )0)
تعارٌف
ٌكون لأللفاظ والعبارات الواردة فً هذا القانون المعانً المخصصةة لهةا أدنةاه مةا لةم تةدل القرٌنةة
على خالف ذلك:
الوزارة: وزارة العدل
الوزير: وزٌر العدل
الوزارة المختصة: الوزارة التً تندرج المهنة أو الحرفة أو العمل ضمن اختصاصها.
تجم النقابة: ع قانونً ٌُّؤسس بموجب اتفاق بٌن أشخاص طبٌعٌٌن ٌمارسةون
أعمال وحرف ومهن واحدة أو متقاربة.
النقيب: رئٌس مجلس إدارة النقابة المنتخب.
المهني:
الحرفي:
الشةةخص الةةذي ٌمةةارس مهنةةة تتطلةةب تةةأهٌالً علمٌةةاً وعملٌةةاً تخولةةه
العضوٌة فً نقابة مهنٌة تم تأسٌسها وفق أحكام هذا القانون.
كةل شةخص طبٌعةً مسةجل فةً سةجل الصةناعات التقلٌدٌةة والحرفٌةة
ٌمةارس نشةاطاً تقلٌةدٌاً ٌةدوٌاً وٌثبةت تأهٌلةه وٌتةولى بنفسةه مباشةرة
تنفٌذ العمل وإدارة نشاطه وتسٌٌره .
كل شخص طبٌعً ٌؤدي عمالً لدى صاحب العمةل لقةاء أجةر وٌكةون العامل:
أثناء أدائه العمل تحت إدارته وإشرافه.
العضو: الشخص الطبٌعً المنضم إلى إحدى النقابات المهنٌة أو العمالٌة وفق
أحكام هذا القانون واألنظمة الخاصة بكل نقابة.
المجلس: مجلس إدارة النقابة .
الجمعية العمومية: كافة أعضاء النقابة .
الجمعية العمومية
التمثيلية:
الممثلٌن عن أعضاء الجمعٌة العمومٌة.
النظام األساسي: النظام األساسً للنقابة .
األغلبية المطلقة: أكثر من نصف عدد األعضاء الحاضرٌن عند التصوٌت.

أكثر من نصف عدد أعضاء مجلس النقابة.

نطاق تطبٌق القانون
المادة )2)
تسةري أحكةام هةذا القةانون علةى النقابةات المهنٌةة والحرفٌةة والعمالٌةة كافةة ال ُمشةكلة بموجةب
أحكام هذا القانون واللوائح والقرارات الصادرة بمقتضاه.
المادة )2)
0ٌ .حدد مجلس الوزراء بقرار المهن والحرف واألعمال التً ٌجةوز ألصةحابها تأسةٌس نقابةة
خاصة بهم ، وتحدد فً القرار الوزارة المختصة بكل نقابة.
2 .ال ٌجوز تشكٌل أكثر من نقابة ألصحاب المهنة أو الحرفة أو العمل الواحد.
مادة )2)
ألصةحاب المهةن والحةرف واألعمةال تنظةٌم أنفسةهم فةً نقابةات خاصةة بهةم وفقةاً ألحكةام هةذا
القانون والقرارات الصادرة بمقتضاه.
تسجٌل النقابة
المادة )1)
0ُ .تسجل النقابة فً الوزارة وفقاً ألحكام هذا القانون والئحته التنفٌذٌة.
2 .على مؤسسً النقابة تقدٌم طلةب خطةً ُمسةتو لف للشةروط إلةى الةوزارة ومّوقةع مةن خمسةة
على األقل من المؤسسٌن المفوضٌن بالتسجٌل والتوقٌع عن النقابة ، ومرفق بثالثة نسةخ مةن
النظام األساسً للنقابة موقعة من أعضاء اللجنة التأسٌسٌة.
2 .على الوزٌر أن ٌصدر قراره بشأن استٌفاء الطلب لشروط التسجٌل وبالتنسٌق مع الةوزارة
المختصة خالل مدة ال تزٌد عن شهرٌن من تارٌخ تقدٌمه، وإذا لم ٌصةدر الةوزٌر القةرار خةالل
هذه الفترة تعتبر النقابة مسجلة بحكم القانون.
2 .فً حالة صدور قرار الوزٌر برفض الطلب ٌجب أن ٌكون القرار مسبباً وٌجوز الطعةن فٌةه
أمام محكمة العدل العلٌا.
المادة )1)
1ُ .تّنظم مزاولة المهن والحرف واألعمال وفقاً لنظام ٌصدر عن الجمعٌة العمومٌة للنقابة، أو
عن الجمعٌة العمومٌة التمثٌلٌة حسب مقتضى الحال.
2ٌُ .سةتثنى مةن الفقةرة )0 )مةن هةذه المةادة المهةن المنظمةة بقةانون خةاص قبةل سةرٌان هةذا
القانون أو التً ستنظم بعده بقانون خاص.
المادة )1)
0 .تتمتع النقابة بالشخصٌة االعتبارٌة وبذمة مالٌة مستقلة.
2 .لكل نقابة الحق فً تملك األموال المنقولة وغٌر المنقولة لتحقٌق أهدافها.
المادة )9)
0ٌ .كون المقر الرئٌس للنقابة فً العاصمة القةدس، وٌجةوز لهةا إنشةاء مقةرٌن مةؤقتٌن فةً
مدٌنتً غزة ورام هللا.
2ٌ .جوز للجمعٌة العمومٌة التمثٌلٌة إنشاء فروع للنقابة فً المحافظات.
األهداف
المادة )9)
تهدف النقابات إلى تحقٌق األهداف التالٌة:
0 .تنظٌم مزاولة المهن والحرف واألعمال والعمل على تحسٌن ظروفها ورفع مستواها وفقاً
للنظام أو القانون .
2 .حماٌة مصالح األعضاء وتحسٌن ظروفهم.
2 .تنمٌة الوعً الثقافً ورفع المستوى االجتماعً والصحً واالقتصادي ألعضائها.
2 .المحافظة على تقالٌد المهن والحرف واألعمال وآدابها وشرفها.
1 .تقدٌم المشورة والرأي للجهات الرسةمٌة المختصةة فٌمةا ٌتعلةق بشةؤون ممارسةة المهنةة
والحرف واألعمال وتحدٌثها وتطوٌرها.
1 .العمل على إنشاء صنادٌق للراغبٌن من األعضاء لتقدٌم الخدمات الالزمة.
1 .تسوٌة الخالفات التً تنشأ بٌن األعضاء بالمصالحة أو التحكٌم.
9 .أي نشاطات أو فعالٌات ال تتعارض مع القانون.
شروط العضوٌة
المادة )01)
ٌُشترط لعضوٌة النقابة:
0 .أن ٌكون المتقدم فلسطٌنٌاً.
2 .أن ٌكون المتقدم حاصالً على المؤهل العلمً الالزم لعضوٌة النقابة فٌما ٌتعلق بالمهن.
2 .أال ٌقل سنه عن )09 )عاماً فٌما ٌتعلق باألعمال والحرف .
2 .تسدٌد رسوم االنتساب والعضوٌة.
1 .أن ٌكون حسن السٌرة والسمعة وغٌةر محكةوم علٌةه نهائٌةاً فةً جناٌةة أو جنحةة مخلتةٌن
بالشرف أو األمانة ما لم ٌرد إلٌه اعتباره.
1 .أٌة شروط أخرى تحددها أنظمة النقابة.
المادة )00)
0 .مع مراعاة أحكام المادتٌن )1،01 )من هذا القانون ٌصدر قرار منح العضوٌة من المجلس
وذلك خالل مدة أقصاها شهرٌن من تارٌخ تقدٌم الطلب.
2 .إذا انقضةت مةدة الشةهرٌن ولةم ٌصةدر المجلةس القةرار المشةار إلٌةه فةً الفقةرة )0 )أعةاله
أعتبر الطلب مقبوالً ضمناً.
2ٌ .جوز الطعن أمام محكمة العدل العلٌا فً حالة رفض طلب العضوٌة.
انتهاء العضوٌة
المادة )02)
تنتهً العضوٌة فً الحاالت التالٌة:
0 .الوفاة.
2 .الفصل من النقابة.
2 .االنسحاب من النقابة.
2 .فقدان شرط من شروط العضوٌة.
1 .صدور حكم نهائً بحق العضو فً جنحة أو جناٌةة مخلتةٌن بالشةرف أو األمانةة مةا لةم
ٌرد إلٌه اعتباره.
المادة )02)
للمجلس أن ٌُعٌد تسجٌل اسم العضو فً سجل العضوٌة إذا زال سبب حذف إسمه.
المادة )02)
0ُ .تعلن سنوٌاً أسماء األعضاء وفقاً للنظام األساسً .
2ٌ .حتفظ المجلس بسجل األعضاء وفق النموذج الذي ٌحدده المجلس.
المادة )01)
تحةتفظ النقابةات فةً مقرهةا الةرئٌس بالسةجالت المالٌةة واإلدارٌةة الرسةمٌة المتضةمنة جمٌةع
المعامالت المالٌة والقرارات اإلدارٌة التً تنظم عملها.
المادة )01)
ال ٌعتد بأي تعدٌل أو تغٌٌر ٌطرأ علةى مركةز النقابةة أو نظامهةا أو أهةدافها أو أغراضةها أو أي
تغٌٌر فً مجلس إدارتها كله أو بعضه ؛ ما لم ٌودع لدى الوزارة وذلك خالل مدة أقصاها شهر
واحد من تارٌخ إجراء التغٌٌر أو التعدٌل.
المادة )01 )
تلتزم النقابات برفع تقرٌرٌن مالً وإداري مقرٌن من الجمعٌة العمومٌة أو الجمعٌةة العمومٌةة
التمثٌلٌة عن أعمالها إلى الوزارة فً موعد ال ٌتعدى أربعة أشهر من نهاٌة السنة المالٌة.
مجلس النقابة
المادة )09)
0ٌ .كون لكل نقابة مجلس ٌتكون من عدد ال ٌقل عن سبعة أعضاء وال ٌزٌد عن خمسة عشر
عضواً .
2 .مدة والٌة المجلس ثالث سنوات مٌالدٌة.
اختصاصات مجلس النقابة
المادة )09)
ٌختص المجلس بما ٌلً:
0 .تنفٌذ السٌاسات العامة التً تحددها الجمعٌة العمومٌة للنقابة .
2 .النظر فً طلبات العضوٌة واتخاذ القرارات المناسبة بشأنها.
2 .إدارة شؤون النقابة واإلشراف على حسن سٌر العمل فٌها.
2 .إعداد اللوائح أو األنظمة والتعلٌمات الالزمة وفقاً للنظام األساسً للنقابة.
1 .تعٌةٌن المةوظفٌن الالزمةٌن للنقابةة وتحدٌةد اختصاصةاتهم أو إنهةاء خةدماتهم وفقةاً ألحكةام
القانون.
1 .إعداد الخطة التطوٌرٌة للنقابة ورفعها للجمعٌة العمومٌة إلقرارها.
1 .تكوٌن اللجان التً ٌراها الزمة لتحسٌن العمل وتحدٌد اختصاص كل منها.
9 .تقدٌم التقارٌر السنوٌة اإلدارٌة والمالٌة وأٌة خطط ومشارٌع مستقبلٌة للجمعٌة العمومٌة.
9 .دعوة الجمعٌة العمومٌة لجلسة عادٌة أو غٌر عادٌة لالجتماع.
01 .تنفٌذ قرارات الجمعٌة العمومٌة طبقاً ألحكام القانون والنظام األساسً.
00 .إقرار اتفاقٌات التعاون مع المؤسسات ذات العالقة.
02 .أٌة نشاطات أو أعمال تحقق مصالح النقابة دون اإلخالل بالقانون أو النظام األساسً.
صالحٌات النقٌب
مادة )21)
ٌُمارس النقٌب الصالحٌات التالٌة:
0 .دعوة المجلس لالنعقاد وفقاً ألحكام هذا القانون.
2 .ترؤس جلسات المجلس وإدارتها.
2 .التوقٌع على القرارات التً ٌصدرها المجلس.
2 .توقٌع العقود وإبرام االتفاقٌات باسم النقابة.
1 .متابعة تنفٌذ قرارات المجلس.
1 .تمثٌل النقابة أمام الجهات الرسمٌة وغٌر الرسمٌة الداخلٌة والخارجٌة.
1 .أٌة صالحٌات أخرى ٌحددها النظام األساسً بما ال ٌتعارض مع أحكام هذا القانون.
المادة )20)
ُتحدد اختصاصات أمٌن السر وأمٌن الصندوق وباقً أعضاء المجلةس وفقةاً لنظامهةا األساسةً
بما ال ٌتعارض مع أحكام هذا القانون.
شغور العضوٌة فً المجلس
مادة )22)
0 .إذا شغر مركز النقٌب مؤقتاً ألي سبب ٌقوم مقامه نائبه.
2 .إذا شةغر مركةز عضةو فةً المجلةس ألي سةبب، ٌةدعو المجلةس مةن حصةل علةى األكثرٌةة فةً
االنتخابات السابقة حسب التسلسل لٌخلفةه، وٌسةتمر المجلةس فةً أداء مهامةه إذا كانةت المةدة
أقل من سنة، وتجرى االنتخابات لشغل المنصب فً حال كانت المدة المتبقٌة سنة فأكثر.
اجتماعات المجلس
المادة )22)
0ٌ .نعقد المجلس بصورة عادٌة مرة كل شهر على األقل بدعوة من النقٌب أو من ٌنوب عنه.
2ٌ .نعقد المجلس بصورة استثنائٌة كلما دعت الضرورة لذلك بدعوة من النقٌب أو من ٌنوب عنه
أو بطلب من ثلث أعضائه.
2 .تكون اجتماعات المجلس صحٌحة بحضور األغلبٌة المطلقة للمجلس.
2 .تتخذ قرارات المجلس باألغلبٌة المطلقة، وفً حالة تساوي األصوات ٌرجح الجانةب الةذي فٌةه
النقٌب.
المادة )22)
0 .عند تعذر اجتماع المجلس وفقاً للفقرة )2 )من المادة )22 )من هذا القةانون بسةبب االسةتقالة
أو الوفاة ٌتولى من تبقى من المجلس) باعتبارهم لجنةة مؤقتةة( مهمةة المجلةس لمةدة أقصةاها
شهرٌن وتتم دعوة الجمعٌة العمومٌة خالل نفس المدة الختٌار مجلس جدٌد.
2 .إذا كانت االستقالة جماعٌة أو لم تقةم اللجنةة المؤقتةة باإلعةداد إلجةراء االنتخابةات خةالل المةدة
المحددة لها ؛ ٌقوم الوزٌر بتعٌةٌن لجنةة مؤقتةة مةن بةٌن أعضةاء النقابةة تكةون مهمتهةا دعةوة
الجمعٌة العمومٌة لالنعقاد خالل شهر الختٌار مجلس جدٌد.
الجمعٌة العمومٌة والجمعٌة العمومٌة التمثٌلٌة
المادة )21)
0ٌ .حةةدد النظةةام األساسةةً للنقابةةة تشةةكٌل الجمعٌةةة العمومٌةةة والجمعٌةةة العمومٌةةة التمثٌلٌةةة
ومهامهما.
2 .تصدر قرارات الجمعٌة العمومٌة والجمعٌة العمومٌة التمثٌلٌة باألغلبٌة المطلقة ما لم ٌةنص
القانون على خالف ذلك .
2ٌ.عتبةةر اجتمةةاع الجمعٌةةة العمومٌةةة والجمعٌةةة العمومٌةةة التمثٌلٌةةة للنقابةةة صةةحٌحاً بحضةةور
األغلبٌة المطلقة للنقابة فإذا لم تتوفر هذه األغلبٌة ٌؤجل االجتمةاع إلةى جلسةة أخةرى تعقةد
خةالل مةدة ال تتجةاوز خمسةة عشةر ٌومةاً مةن تةارٌخ االجتمةاع األول وال تقةل عةن أسةبوع
وٌكون االنعقاد فٌها صحٌحاً بحضور ثلث األعضاء على األقل.
الجمعٌة العمومٌة
تشكٌلها واختصاصاتها
المادة )21)
بما ال ٌتعارض مع أحكام هذا القانون:
0ٌ .حدد النظام األساسً للنقابة طبٌعة تشكٌل الجمعٌة العمومٌة للنقابة، بحٌث تتكون مةن
جمٌع األعضاء الذٌن أوفوا التزاماتهم وفقاً للنظام األساسً.
2 .تختص الجمعٌة العمومٌة بما ٌلً:
أ- وضع السٌاسات والتوجهات العامة للنقابة .
ب- انتخاب أعضاء مجلس اإلدارة .
ج- حل النقابة ودمجها واتحادها .
د- حل مجلس اإلدارة أو عزل أحد أعضائه.
ه- فصل األعضاء.
و- وضع نظام المزاولة أو تعدٌله.
ز- أٌة اختصاصات أخرى ٌحددها النظام األساسً.
2 .أ- تصةدر قةرارات الجمعٌةة العمومٌةة باألغلبٌةة المطلقةة ألعضةائها فٌمةا ٌخةتص بتعةدٌل
نظامها األساسً .
ب - تصدر قرارات الجمعٌة العمومٌة بأغلبٌة ثلثً أعضاءها فٌما ٌختص بما ٌلً:
0 )حل النقابة.
2 )تعدٌل فً أهداف النقابة.
2 )عزل أحد أعضاء مجلس اإلدارة .
2 )اتحادها أو إدماجها.
1 )وضع نظام المزاولة أو تعدٌله.
2 -تعقد الجمعٌة العمومٌة اجتماعاً عادٌاً مرة واحدة كةل سةنة علةى األقةل، للنظةر فةً تقرٌةر
مجلس اإلدارة عن نشاطات النقابة وتقرٌةر مةدقق الحسةابات عةن مركزهةا المةالً والمصةادقة
علٌه وتعٌٌن مدقق الحسابات وغٌر ذلك من المسائل التةً ٌةرى المجلةس إدراجهةا فةً جةدول
األعمال.
1ٌ -جوز لثلث أعضاء الجمعٌة العمومٌة ألٌة نقابة طلب دعوتها الجتماع غٌر عادي .
الجمعٌة العمومٌة التمثٌلٌة
المادة )21 )
بما ال ٌتعارض مع أحكام هذا القانون:
0 .فً حالة كان عدد أعضاء الجمعٌة العمومٌة أكثر من ألةف عضةو ٌجةوز عقةد الجمعٌةة
العمومٌة بنظام التمثٌل على أن ٌتم تحدٌد إجراءات وآلٌات ونسةبة التمثٌةل فةً النظةام
األساسً للنقابة.
2 .باستثناء الصالحٌات الواردة فً الفقرات )ب،ج، د( مةن الفقةرة )2 )مةن المةادة )21 )
ُتمارس الجمعٌة العمومٌة التمثٌلٌة كافة مهام الجمعٌة العمومٌة.
2 .تصدر قرارات الجمعٌة العمومٌة التمثٌلٌة بأغلبٌةة ثلثةً أعضةاءها فٌمةا ٌتعلةق بوضةع
نظامها األساسً ووضع نظام المزاولة أو بإدخال التعدٌالت علٌهما وبةأغراض النقابةة
األخرى.
2 .تعقد الجمعٌة العمومٌة التمثٌلٌة اجتماعاً عادٌاً مرة واحدة على األقل كةل سةنة، للنظةر
فً تقرٌر المجلس عن نشةاطات النقابةة وتقرٌةر مةدقق الحسةابات عةن مركزهةا المةالً
والمصادقة علٌه وتعٌٌن مدقق الحسابات وغٌر ذلةك مةن المسةائل التةً ٌةرى المجلةس
إدراجها فً جدول األعمال.
1ٌ .جوز للمجلس أو لثلةث أعضةاء الجمعٌةة العمومٌةة التمثٌلٌةة ألٌةة نقابةة طلةب دعوتهةا
الجتماع غٌر عادي، وٌكون االجتماع غٌةر العةادي صةحٌحاً بحضةور األغلبٌةة المطلقةة
للجمعٌة العمومٌة التمثٌلٌة.
االتحادات النقابٌة
المادة )29)
0ٌ .جوز لثالث نقابات أو أكثر أن ُتِّكون فٌما بٌنهةا اتحةاداً، كمةا ٌجةوز لهةذه االتحةادات أن
تشكل فٌما بٌنها اتحاداً عاماً.
2 .تطبةةق جمٌةةع األحكةةام واإلجةةراءات المبٌنةةة فةةً هةةذا القةةانون علةةى كٌفٌةةة التسةةجٌل
وإجراءاته واألنظمة األساسٌة وبٌاناتها ونظام العمةل فٌهةا بالنسةبة لكةل اتحةاد تةم بةٌن
مجموعة من النقابات أو أٌة نقابات موحدة تم إنشاؤها وفقاً ألحكامه.
المادة )29)
ٌجوز ألٌة نقابةة أن تشةترك أو تنتسةب إلةى أٌةة منظمةة أو اتحةاد عربةً أو إقلٌمةً أو دولةً
خارج فلسطٌن على أن ٌتم إعالم الجهات ذات االختصاص بذلك.
الشؤون المالٌة للنقابة
مادة )21)
0 .تتكون موارد النقابـة من :
أ- رسوم العضوٌة السنوٌة واالنتسةاب المقةررة بموجةب النظةام األساسةً وأٌةة رسةوم أخةرى
ٌقرها المجلس.
ب- اإلعانات والهبات التً ٌوافق علٌها المجلس.
ج- رٌع استثمارات أموال النقابة وعقاراتها.
د - أٌةة مبةالر أخةةرى تحصةلها النقابةة مقابةل الخةدمات التةً تقةدمها وفقةاً للقةانون ونظامهةا
األساسً.
2 .تحدد الرسوم والموارد وكٌفٌة فرضها واستٌفائها فةً النظةام األساسةً أو فةً أٌةة أنظمةة
توضع لهذه الغاٌة.
المادة )20)

المادة )22)
0 .تودع النقود واألوراق المالٌة باسم النقابة فً مصرف أو أكثر ٌعٌن بقرار من المجلس.
2 .ال ٌجوز التصرف بشًء من أموال النقابة إال بقرار من المجلس.

حل النقابة
المادة )21)
0ُ .تحل النقابة وفقاً لإلجراءات المنصوص علٌها فةً نظامهةا األساسةً أو وفقةاً لحكةم قضةائً

العقوبات
المادة )21)
0ٌ -حظر على النقابات و ُمنتسبٌها :
أ- تلقً هبات أو مساعدات تهدف إلى التطبٌع مع االحتالل الصهٌونً.
ب- التروٌج أو التشجٌع ألي نشاط مع االحتالل الصهٌونً.
2 -مع عدم اإلخالل بأٌة عقوبة أشةد وردت فةً قةانون آخةر؛ كةل مةن ٌخةالف أحكةام الفقةرة )0 )
أعاله ٌُعتبر مرتكباً جناٌةة مخلةة بالشةرف واألمانةة وٌعاقةب بةالحبس مةدة ال تزٌةد عةن عشةر
سنوات، وُتعاقب النقابة المخالفة بفرض غرامة ال تزٌد عن 210111 دٌنار أردنً)عشرون
ألف دٌنار أردنً( أو ما ٌعادلها بالعملة المتداولة.

المادة )29)
مةع مراعةاة األحكةام الةواردة فةً هةذا القةانون تلتةزم النقابةات بالمعةاٌٌر التةً ٌحةددها مجلةس
الوزراء فٌما ٌخص التسجٌل للمهنة أو الحرفة أو العمل.
المادة )29)
0 .ال ٌجةوز تفتةٌر مقةر النقابةة أو فروعهةا أو إغالقهةا إال بعةد صةدور قةرار مةن جهةة قضةائٌة
مختصة.
2 .ال تجوز مصادرة أموال النقابة أو إغالقها نهائٌاً إال بموجب حكم قضائً نهائً.
المادة )21)
فً حال مخالفةة النقابةة للمةواد )01، 01،22 )مةن هةذا القةانون؛ ٌةتم إخطةار النقابةة مةن قبةل
الوزارة بإزالة هذه المخالفة خالل شهر من تارٌخ تبلٌغها باإلخطار وفً حةال اسةتمرار النقابةة
بالمخالفة أو تكرارها فإن للوزارة الحق فً حل المجلس.

After reviewing the Basic Law of 2003 and its Amendments,
And Law No. (1) for the year 2000 concerning Charitable Societies and NGOs,
And Act of Practicing Auditing Profession No. (9) for the year 2004,
And Law No. (3) of 1999 on Regulating the Legal Profession and its Amendments,
And Law No. (15) of 1995 on Translation and Translators,
And the Law of Land Assessors No. (34) of 1947 and its Amendments,
And the Dentists Act No. (1) for the year 1945 and its Amendments,
And the Profession Licensing Law No. (89) of 1966 and its Amendments,
And the Veterinarians Act, Chapter (148) for the year 1929 and its Amendments,
And the Law of Cannabis, Chapter (93) for the year 1929,
And the Law of Tour Guides, Chapter (66) of 1927,
And the Notaries Act (Foreign Documents) Chapter (99) of 1921 and its Amendments,
And the Pharmacists Act Chapter (110) of 1921 and its Amendments,

Based on what was approved by the Legislative Council in its session held on 06/2/2013
And after the Law has become a source by force of Article (41) of the Amended Basic Law of 2003 and its Amendments,
In the name of God, and then in the name of the Palestinian Arab people
The following Law was issued:
Article (1)
Definitions
The following terms and phrases shall have their specified meanings unless mentioned otherwise:
Ministry: Ministry of Justice
Minister: Minister of Justice
The Competent Ministry: The Ministry in which the profession or craft or work falls within its jurisdiction (competence).
Union: A legal gathering established by an agreement between natural persons engaged in one or similar works, crafts and professions.
Chairman Elected Chairman of the Union’s Board of Directors.
Professional: A person practicing a profession that requires scientific and practical qualification which entitles him to membership in a trade union established in accordance with the provisions of this Law.
Craftsman: Any natural person registered in the Register of the Traditional Handicrafts Industries who performs a traditional handcraft activity and shall prove his qualification, and undertake directly to carry out the work, to run and facilitate his activity.
Worker: Any natural person who performs work for the employer in return for remuneration and while performing work he’s under his direction and supervision.
Member: The natural person who is affiliated with a professional or labor union in accordance with the provisions of this Law and the regulations of each union.
The Board: Board of Directors of the Union.
General Assembly: All members of the Union.
Representative Assembly: Representatives of the members of the General Assembly.
Statute: The Statute of the Union.
Absolute Majority: More than half of the members present at the voting.
The Absolute Majority of the Council: More than half of the Board members of the Union.
The Absolute Majority of the Assembly: More than half of the members of the General Assembly of the Union.
Scope of Law Enforcement
Article (2)
The provisions of this Law shall apply to all professional, handicraft and labor unions formed under the provisions of this Law, regulations and decisions issued pursuant thereto.
Article (3)
1. The Council of Ministers shall determine by a decision the professions, crafts and works that the owners may establish their own unions. The competent ministry of each union shall be specified in the decision.
2. No more than one union may be formed for the owners of the same profession or craft or work.
Article (4)
The professions, trades and businesses shall organize themselves in their own unions in accordance with the provisions of this Law and the decisions issued pursuant thereto.
Registration of the Union
Article (5)
1. The Union shall be registered in the Ministry in accordance with the provisions of this Law and its executive regulation.
2. The founders of the Union shall submit a written application that meets the requirements to the Ministry of Justice and signed by at least five of the founders who are authorized to register and sign on behalf of the Union. The application shall be attached with three copies of the Statute of the Union and signed by the founding committee members.
3. The Minister shall issue his decision on the application’s fulfillment of the registration requirements and in coordination with the competent ministry within a period not exceeding two months from the date of its submission. If the Minister does not issue the decision during this period, the Union shall be registered by law.
4. In the case of the Minister’s decision to reject the application, the decision must be substantiated and may be appealed before the High Court of Justice.
Article (6)
1. The professions, crafts and businesses shall be regulated in accordance with a regulation issued by the General Assembly of the Union or by the Representative General Assembly as the case may be.
2. Professions regulated by a special law shall be excluded from Paragraph (1) of this Article before this Law comes into force or which shall be regulated by a special law.
Article (7)
1. The Union shall enjoy an artificial personality and an independent financial liability.
2. Every Union has the right to own movable and immovable property in order to achieve its objectives.
Article (8)
1. The headquarters of the Union shall be in the capital, Jerusalem, and may establish two temporary headquarters in Gaza and Ramallah.
2. The Representative General Assembly may establish branches for the Union in the governorates.
Objectives
Article (9)
The Unions aim to achieve the following objectives:
1. Regulate the practice of professions, crafts and works, improve their conditions and raise their level according to the Statute or the law.
2. Protect the interests of the members and improve their conditions.
3. Develop the cultural awareness and raise the social, health and economic level of its members.
4. Preserve the traditions of professions, crafts, businesses, its ethics and its honor.
5. Provide advice and opinion to the competent official authorities with regard to matters of practicing, updating and developing the profession, crafts and businesses.
6. Work on establishing funds for interested members to provide the necessary services.
7. Settle disputes arising between members by reconciliation or arbitration.
8. Any activities that do not conflict with the law.
Terms & Conditions of Membership
Article (10)
Membership of the Union requires:
1. The applicant must be Palestinian.
2. The applicant must have the necessary scientific qualification for membership of the union in relation to professions.
3. Shall not be less than (18) years in regard to works and crafts.
4. Shall pay the membership fees.
5. Must be of good conduct and reputation and is not finally sentenced to a felony or misdemeanor in violation of honor or trust unless he is rehabilitated.
6. Any other conditions determined by the regulations of the union.
Article (11)
1. Subject to the provisions of Articles (6 and 10) of this Law, a decision to grant membership shall be issued by the Board within a maximum period of two months from the date of submission of the membership application.
2. If the two-month period has elapsed and the Board has not made the decision referred to in Paragraph (1) above, the application shall be deemed to be admissible implicitly.
3. In case the membership application is rejected, it may be appealed before the Supreme Court of Justice.
Termination of Membership
Article (12)
Membership comes to an end in the following cases:
1. Death.
2. Separation from the union.
3. Withdrawal from the union.
4. Loss of a membership condition.
5. A final judgment is issued against the member in a misdemeanor or felony in violation of honor or trust unless he is rehabilitated.
Article (13)
The Board may re-register the member’s name in the membership register if the reason for deleting his or her name is removed.
Article (14)
1. The names of members shall be announced annually in accordance with the Statute.
2. The Board shall keep the register of members in accordance with the form determined by the Board.
Article (15)
The unions shall maintain, at their headquarters, the official financial and administrative records containing all financial transactions and administrative decisions governing their work.
Article (16)
Any amendment or change in the status of the Union, its system, its objectives or purposes, or any change in its Board of Directors, in whole or in part, shall not be considered unless it is filed with the Ministry within a maximum period of one month from the date of the change or amendment.
Article (17)
The unions shall submit financial and administrative reports approved by the General Assembly or the Representative General Assembly to the Ministry about their work not later than four months from the end of the fiscal year.
The Union Board
Article (18)
1. Each Union shall have a Board of Directors composed of a number not exceeding seven members and not more than fifteen members.
2. The term of office of the Board is three calendar years.
Competence of the Union’s Board
Article (19)
The Board shall be competent to:
1. Implement the general policies determined by the General Assembly of the Union.
2. Consider and take appropriate decisions on membership applications.
3. Manage the Union’s affairs and supervise the proper functioning of the Union.
4. Prepare the necessary regulations or instructions in accordance with the Statute of the Union.
5. Appoint the necessary personnel for the Union and determine their competences or terminate their services in accordance with the provisions of the law.
6. Prepare the development plan of the union and submit it to the General Assembly for approval.
7. Form the committees it deems necessary to improve the work and determine the competence of each committee.
8. Submit administrative and financial annual reports and any future plans and projects to the General Assembly.
9. Invite the General Assembly to a regular or extraordinary meeting.
10. Implement the decisions of the General Assembly in accordance with the provisions of the law and the Statute.
11. Approve cooperation agreements with relevant institutions.
12. Any activities or works that achieve the union’s interests without prejudice to the law or the Statute.
The Powers of the Board Chairman
Article (20)
The Board Chairman shall exercise the following authorities:
1. Invite the Board to convene in accordance with the provisions of this Law.
2. Chair and run the Board meetings.
3. Sign the resolutions issued by the Board.
4. Sign contracts and conclude agreements on behalf of the union.
5. Follow up on the implementation of the Board decisions.
6. Represent the union before official and non-official internal and external bodies.
7. Any other powers specified by the Statute in a manner not inconsistent with the provisions of this Law.
Article (21)
The competences of the Secretary, the Treasurer and other Board members shall be determined in accordance with its Statute in a manner not inconsistent with the provisions of this Law.
Vacancy of Membership in the Board
Article (22)
1. If the Chairman’s position temporarily becomes vacant for any reason, his deputy shall take his place.
2. If the Board member’s position is vacant for any reason, the Board shall call upon the person who obtained the majority in the previous elections in succession to succeed him. The Board shall continue to perform its duties if the period is less than one year. The elections shall be held to fill the post in the event that the remaining period is one year or more.
Board Meetings
Article (23)
1. The Board shall meet regularly at least once a month at the invitation of the Chairman or his deputy.
2. The Board shall meet on an exceptional basis whenever necessary at the invitation of the Chairman or his deputy or at the request of one third of its members.
3. The Board meetings shall be valid in the presence of the absolute majority of the Board.
4. The Board decisions shall be taken by an absolute majority. In case of equal votes, the side of the Chairman is likely to prevail.
Article (24)
1. If the Board is unable to meet in accordance with Paragraph (3) of Article (23) of this Law due to resignation or death, the remaining Board members (as an interim committee) shall assume the Board duties for a maximum period of two months. The General Assembly shall be invited during the same period to elect a new Board.
2. If the resignation is collective or the interim committee does not prepare for holding the elections within the specified period, the Minister appoints an interim committee from among the union members whose task is to call the General Assembly to convene within a one-month period to elect a new Board.
General Assembly and the Representative General Assembly
Article (25)
1. The Statute of the Union shall determine the formation of the General Assembly and the Representative General Assembly and their duties.
2. The General Assembly and the Representative General Assembly’s decisions shall be made by an absolute majority unless the law provides otherwise.
3. The meeting of the Union General Assembly and the Representative General Assembly shall be considered valid in the presence of the absolute majority of the Union. If this majority is not available, the meeting shall be adjourned to another session held not later than fifteen days from the date of the first meeting and not less than one week. The meeting shall be valid in the presence of at least one third of the members.
General Assembly
Its composition and its Terms of Reference
Article (26)
In a manner not inconsistent with the provisions of this Law:
1. The Statute of the Union shall determine the nature of the formation of the Union General Assembly, consisting of all members who have fulfilled their obligations in accordance with the Statute.
2. The General Assembly shall be competent to:
a. Develop general policies and guidelines for the Union.
b. Elect the members of the Board of Directors.
c. Dissolve, consolidate and unite the Union.
d. Dissolve the Board of Directors or isolate one of its members.
e. Dismiss the board members.
f. Develop or modify the practice system.
g. Any other functions specified by the Statute.
3. (a) The General Assembly’s decisions shall be issued by an absolute majority of its members in respect of amending its Statute.
(b) The General Assembly’s resolutions shall be issued by a two-third majority of its members in respect of the following:
1) Dissolution of the Union.
2) Amendment of the objectives of the Union.
3) Isolation one of the Board members.
4) Unification or integration of the Union.
5) Development or adjustment of the practice system.
4. The General Assembly shall hold a regular meeting at least once a year to study the Board of Directors’ report on the activities of the Union and the auditor’s report on its financial position and approval, the appointment of the auditor and other matters considered by the Board to be included in the agenda.
5. One third of the members of the General Assembly of any Union may be invited to an extraordinary meeting.
The Representative General Assembly
Article (27)
In a manner not inconsistent with the provisions of this Law:
1. In case the number of the General Assembly’s members is more than one thousand members, the General Assembly may be held by the representation system, provided that the procedures, mechanisms and proportion of representation shall be determined in the Statute of the Union.
2. With the exception of the powers mentioned in Paragraphs (b, c & d) of Paragraph (2) of Article (26), the Representative General Assembly shall exercise all the functions of the General Assembly.
3. The General Assembly’s resolutions shall be issued by a two-third majority of its members with regard to the establishment of its Statute and the establishment of the practice system or the amendments thereto and for other purposes of the Union.
4. The Representative General Assembly shall hold a regular meeting at least once a year to consider the report of the Board of Directors on the activities of the Union and the auditor’s report on its financial position and approval, the appointment of the auditor and other matters considered by the Board to be included in the agenda.
5. The Board or one third of the members of the Representative General Assembly of any union may be invited to an extraordinary meeting. The extraordinary meeting shall be valid in the presence of the absolute majority of the Representative General Assembly.
Trade Union Federations
Article (28)
1. Three or more unions may have a federation among themselves, and such federations may form among themselves a general federation.
2. All the provisions and procedures set forth in this Law shall apply to the manner of registration, its procedures, its statutes, its statements, and its work system thereof for each union between a group of unions or any unified unions established in accordance with its provisions.
Article (29)
Any Union may participate or belong to any Arab, regional or international organization or federation outside Palestine, provided that the competent authorities are notified.
Financial Affairs of the Union
Article (30)
1. The Union’s resources shall consist of:
a) Annual membership fees as determined by the Statute and any other fees approved by the Board.
b) Subsidies and grants approved by the Board.
c) Proceeds of the Union’s investments and real estates.
d) Any other sums collected by the Union in return for the services it provides in accordance with the Law and its Statute.
2. Fees and resources, its imposition and collection shall be determined in the Statute or in any regulations established for that purpose.
Article (31)
The fiscal year of the Union shall commence on the 1st of January and end on the 31st of December of each year.
Article (32)
1. The Board shall submit the final account for the previous fiscal year to the General Assembly for ratification.
2. Each year, the Board shall prepare a budget for the next fiscal year and submit it to the General Assembly for ratification.
3. If extraordinary circumstances prevent the General Assembly from meeting in time for the ratification of the final account and the New Year’s budget, the Board continues to collect and the expenditure is based on the previous budget of 1/12 monthly and for a period not exceeding three months until the General Assembly meets and approves the final account and the new budget.
Article (33)
1. Money and securities shall be deposited in the name of the Union in one bank or more determined by a decision of the Board.
2. It is not permissible to dispose of any of the Union’s funds except by a decision of the Board.
3. The deposit and expenditure orders shall be signed by the Chairman and the Treasurer or their representative by a decision of the Board.
4. The Statute shall specify the amount which may be retained in the Union’s treasury.
Article (34)
The Union shall be exempted from taxes and customs on movable and immovable property necessary for the implementation of its objectives set out in its Statute.
Article (35)
The Union shall have the right to hold activities and establish income-generating projects provided that the income earned is used to cover its activities, benefit the Union and achieve its objectives.
Dissolution of the Union
Article (36)
1. The Union shall be dissolved in accordance with the procedures provided for in its Statute or in accordance with a final judgment.
2. In both cases mentioned in Paragraph (1) of this Article, the party issuing the dissolution decision shall determine how to deal with the Union’s assets, both in kind and cash.
Penalties
Article (37)
1. The Unions and their affiliates shall be prohibited from:
a) Receiving grants or aid aimed at normalization with the Zionist occupation.
b) Promoting or encouraging any activity with the Zionist occupation.
2. Without prejudice to any more severe punishment provided in another law, anyone who contravenes the provisions of Paragraph (1) above shall be deemed to have committed a felony that violates honor and trust and shall be punished by imprisonment for a term not exceeding ten years. The infringing Union shall be penalized a fine not exceeding JD 20,000 (twenty thousand Jordanian Dinars) or its equivalent in the currency.
General and Transitional Provisions
Article (38)
Subject to the provisions of this Law, the Unions shall abide by the criteria determined by the Council of Ministers with regard to registration for the profession or craft or work.
Article (39)
1) The Union headquarters or its branches shall not be searched or closed unless a decision has been issued by a competent judicial authority.
2) The Union’s funds may not be confiscated or closed indefinitely except by a final judicial ruling.
Article (40)
In case of violation of Articles (16, 17, 32) of this Law, the Union shall be notified by the Ministry of the elimination of this violation within one month from the date of notification. If the Union continues to violate or repeat it, the Ministry has the right to dissolve the Board.
Article (41)
1) Associations that have been dealt with as a trade union representing a profession, craft or work, as well as trade unions in Palestine prior to the entry into force of this Law, shall be licensed by law, provided that their conditions are in accordance with the provisions of this Law within a maximum period of one year from the date of its implementation and the Ministry has the right to extend this period for one month.
2) The special laws governing professions and issued before the coming into force of this Law shall continue to apply.
3) The regulations of each profession, craft or work shall continue for a maximum period of one year from the date of the entry into force of this Law until the competent authorities issue their own regulations in accordance with the provisions of this Law.
Article (42)
The Union registration’s decision shall be published in the Official Gazette.
Article (43)
The Council of Ministers shall issue the necessary rules and regulations to implement the provisions of this Law.
Article (44)
Any contravention of the provisions of this Law shall be canceled.
Article (45)
All competent authorities, each within its jurisdiction, shall implement the provisions of this Law and shall enter into force thirty days after the date of its publication in the Official Gazette.

During the years from 1995 through 2010, I worked for different organizations as a full-time translator and have been a “Freelance Translator” since 2010 until the present time, providing professional, timely and high-quality document translation services. I am also very good at proofreading and editing, which I have acquired over time.
