С точки зрения энергетики Иркутская область является уникальным регионом в масштабе не только России, но и мира — на сравнительно небольшой территории сконцентрировались гигантские запасы различных видов энергоресурсов.
Гидроэлектростанции ангарского каскада, используя о. Байкал как огромное первичное водохранилище, обеспечивают стабильную выработку дешевой электроэнергии в течение всего года. В области с конца 19-го века разрабатываются крупные месторождения угля, который используется для производства тепло- и электроэнергии. В регионе находятся очень большие запасы газа и нефти, месторождения которых планируется освоить уже в ближайшее время. Огромные леса являются источником древесины, частично используемой как топливо.
Энергетика стала базовой отраслью области, определившей направление развития региона. Громадные и фантастически дешевые энергоресурсы привели к развитию мощных энергопроизводящих, энергопередающих и энергопотребляющих производств.
Но при общем большом количестве энергоресурсов, в отдельных населенных пунктах области существуют проблемы с отоплением, а в некоторых отдаленных районах отсутствует устойчивое электроснабжение. На фоне одновременного изобилия и дефицита энергоресурсов наблюдается крайне расточительное отношение к ним, что ведет к неоправданным колоссальным потерям на всех стадиях энергетического процесса — при производстве, передаче и потреблении энергии. Избыточное потребление ресурсов, необходимых для производства и передачи «теряющейся» энергии, приводит к дополнительному отрицательному техногенному воздействию на окружающую среду и существенной нагрузке на областной бюджет.
Поэтому для повышения эффективности деятельности производителей и потребителей энергии, снижения потерь ресурсов, улучшения экологической обстановки и экономии денежных средств на областном уровне разрабатываются и принимаются соответствующие законодательные акты и целевые программы. Наиболее значимой в настоящее время является областная государственная
целевая программа «Развитие коммунальной теплоэнергетики Иркутской области с 2004 по 2006 год».

From the point of view of energy production, Irkutsk Oblast is a unique region not only on a Russian scale but on a worldwide one – enormous reserves of various types of energy resources are concentrated in a comparatively small territory.
Angarsk cascade hydroelectric power stations, which use Lake Baikal as an enormous primary reservoir, provide a sustained output of electrical energy throughout the year. Since the end of the 19th century, large deposits of coal have been developed in the region which are used for the production of thermal and electrical energy. There are also plans for deposits of considerable reserves of gas and oil situated in the region to be opened up in the near future. In addition, enormous forests are a source of timber which is partially used as fuel.
Energy production has become the primary industry in the region and determines the region’s direction of growth. Considerable and fantastically cheap energy resources have lead to the development of heavy-duty energy generation, energy transmission and energy consumption industries.
Despite the generally large quantity of energy resources, however, heating problems exist in isolated residential areas and a stable electricity supply is absent in several outlying regions. At a time when there is a simultaneous abundance and deficit of energy resources, an extremely wasteful attitude towards them can also be observed leading to unjustifiably colossal losses at all stages of the energy process – during generation, transmission and consumption. The overconsumption of resources essential for the production and transfer of “disappearing” energy is leading to an additional negative technological environmental impact and a substantial burden on the region’s financial budget.
Therefore, in order to increase the efficiency of energy producers and consumers, lower the losses of resources and improve the ecological situation and economising of monetary funds on a regional level, appropriate legislative acts and special programmes are being developed and set in motion. Currently, the most significant of these is the regional state special programme “The development of communal heat and power engineering in Irkutsk Oblast 2004-2006”.

Заслушав сообщение судьи-докладчика Л.М. Жарковой, объяснения представителей стороны, издавшей и подписавшей оспариваемый акт, выступления приглашенных в заседание представителей: от Генерального прокурора Российской Федерации - Т.А. Васильевой, от Министерства юстиции Российской Федерации - А.А. Смирнова, от Министерства финансов Российской Федерации - С.В. Ячевской, от Министерства Российской Федерации по делам гражданской обороны, чрезвычайным ситуациям и ликвидации последствий стихийных бедствий - Т.А. Марченко, исследовав представленные документы и иные материалы, Конституционный Суд Российской Федерации установил:
1. Законом Российской Федерации от 15 мая 1991 года N 1244-I “О социальной защите граждан, подвергшихся воздействию радиации вследствие катастрофы на Чернобыльской АЭС” (в редакции Федерального закона от 24 ноября 1995 года N 179-ФЗ) для инвалидов вследствие чернобыльской катастрофы, нуждающихся в улучшении жилищных условий, предусматривалось одноразовое бесплатное обеспечение благоустроенной жилой площадью в течение трех месяцев со дня подачи заявления, а также одноразовое бесплатное обеспечение дополнительной жилой площадью в виде отдельной комнаты (пункт 3 части первой статьи 14); для участников ликвидации последствий чернобыльской катастрофы, нуждающихся в улучшении жилищных условий, предусматривалось первоочередное разовое бесплатное обеспечение благоустроенной жилой площадью (пункт 3 части первой статьи 15).
1 января 2005 года вступил в силу Федеральный закон от 22 августа 2004 года N 122-ФЗ “О внесении изменений в законодательные акты Российской Федерации и признании утратившими силу некоторых законодательных актов Российской Федерации в связи с принятием федеральных законов “О внесении изменений и дополнений в Федеральный закон “Об общих принципах организации законодательных (представительных) и исполнительных органов государственной власти субъектов Российской Федерации” и “Об общих принципах организации местного самоуправления в Российской Федерации”, которым статьи 14 и 15 Закона Российской Федерации “О социальной защите граждан, подвергшихся воздействию радиации вследствие катастрофы на Чернобыльской АЭС” были изложены в новой редакции (пункты 8 и 9 статьи 3).

Having heard the judge-reporter L.M. Zharkova, explanations by representatives of the body which issued and signed the disputed act and speeches of representatives invited to the session: from the Procurator General of the Russian Federation – T.A. Vasil’eva; from the Ministry of Justice of the Russian Federation – A.A. Smirnov; from the Ministry of Finance of the Russian Federation – S.V. Yachevskaya; from the Ministry of the Russian Federation for Civil Defence, Emergencies and Disasters Relief – T.A. Marchenko, and having studied the documents and other materials submitted, the Constitutional Court of the Russian Federation
ESTABLISHED that:
1. In accordance with the law of the Russian Federation N.1244-I of 15 May 1991 “On the social protection of citizens subjected to radiation as a result of the catastrophe at the Chernobyl nuclear power plant” (as amended by the Federal Law N.179-FZ of 24 November 1995), for those disabled as a result of the Chernobyl catastrophe and in need of improved housing conditions, a single free-of-charge subsidy for improved living accommodation was provided, valid for three months from the date on which the application was filed, as well as a single free-of-charge subsidy for additional living accommodation in the form of a separate room (Subsection 3 of Part 1 of Article 14); for those who took part in the elimination of the consequences of the Chernobyl catastrophe and in need of improved housing conditions, a single high-priority free-of-charge subsidy for improved living accommodation was provided (Subsection 3 of Part 1 of Article 15).
The Federal Law N.122-FZ of 22 August 2004 “On the introduction of amendments to the legislative acts of the Russian Federation and recognition as invalid some legislative acts of the Russian Federation in connection with the adoption of the Federal Laws “On the introduction of amendments and additions to the Federal Law “On the general principles of the organisation of the legislative (representative) and executive bodies of public authorities of the subjects of the Russian Federation” and “On the general principles of the organisation of local self-government in the Russian Federation”“ came into force on 1 January 2005, for which Articles 14 and 15 of the Law of the Russian Federation “On the social protection of citizens subject to radiation as a result of the catastrophe at the Chernobyl nuclear power plant” were redrafted (Subsections 8 and 9 of Article 3).
