Il s'agit d'une décision de justice italienne concernant un concordat.
Extrait de la phrase: "il soddisfacimento dei creditori appartenenti alla classe 1 (creditori ipotecari capienti) per Euro XXX"
J'ai trouvé le sens de capiente (Relativo a un bene il cui valore è sufficiente a fare da garanzia per un credito.) mais je ne trouve pas une traduction adéquate.
Est-ce que cela veut dire garanti ou "couvert"? Mais ce serait totalement redondant avec "hypothécaire". Je me demande donc s'il faut vraiment le traduire...

Je ne pense pas qu'il y ait un mot précis pour traduire le mot en français. Capiente signifie que la valeur du bien hypothéqué est suffisante pour rembourser la dette et donc que le crédit est couvert et le remboursement certain. Le privilège est une sûreté découlant d'une loi et non contractuelle et donc je n'utiliserais pas le terme privilégié.

ou
créancier hypothécaire suffisamment garanti

Asker: Merci Francesco. Entièrement d'accord avec l'appréciation selon laquelle il n'y a pas un terme correspondant dans notre ordre juridique (français/suisse). La solution proposée me pose toutefois un (demi-)problème pour traduire "incapiente"; éventuellement insuffisamment garanti... je vais encore réfléchir un petit peu. Et peut-être que quelqu'un d'autre va venir m'aider à faire un choix.
