success fee
Explanation:
"in most cases in the form of a success fee"

What is a Success Fee? In finance, a success fee is a commission paid to an advisor (typically an investment bank) for successfully completing a transaction. The fee is contingent on successfully helping the client achieve their goal, and thus aligns the interests of the client and the advisor.

success of the case instructed on (litigation: contingency or conditional fee)

Explanation:
-unclear what the professional-services context is but, as both or more of us know from UK litigation practice, the first type of fee used to be lawful and the second unlawful and unenforceable if exceeding '100% of the law firm client's base fees'- I will leave open an alternative of 'success of the agency(as in a recent ProZ question) entrusted'

I agree, though, that success fee is the 'overarching' idea.

Example sentence(s):
  • IATE: en contingency fee agreement COM es pacto de cuota litis + en conditional fee agreement es pacto de prima de éxito Consilium
  • A conditional fee agreement or CFA is an agreement with a legal representative .. to be paid ..- usually only if the client wins the case + a contingency fee is a form of payment to a lawyer for their legal services.
