9.2.1 Huishoudelijk reglement en Richtlijnen Ingebruikname en Afbouw (RIA) 🠔
Huurder verklaart zich door middel van ondertekening van deze huurovereenkomst te conformeren aan de bepalingen van het huishoudelijk reglement. Het huishoudelijk reglement maakt onlosmakelijk deel uit van deze huurovereenkomst en huurder heeft een exemplaar van dit reglement ontvangen.
Verhuurder heeft het recht het huishoudelijk reglement in de loop van de overeenkomst aan te passen, na overleg met de winkeliersvereniging, indien dat naar het oordeel van verhuurder nodig is voor de goede gang van zaken binnen het gehuurde, het gebouw of complex waar het gehuurde deel van uitmaakt en/of indien omstandigheden van huishoudelijke aard daartoe aanleiding geven. Huurder verleent bij voorbaat zijn instemming aan deze aanpassingen en zal zich (ook) hieraan houden.
Tevens verklaart huurder zich door middel van ondertekening van deze huurovereenkomst te conformeren aan de bepalingen van het RIA, in het bijzonder - maar niet uitsluitend - bij het uitvoeren van werkzaamheden binnen het gehuurde. Het RIA maakt onlosmakelijk deel uit van deze huurovereenkomst en huurder heeft een exemplaar van dit reglement ontvangen. Indien huurder zich niet houdt aan deze richtlijnen, zijn de kosten voor eventueel herstel van schade aan het gehuurde (in de breedste zin van het woord), alsmede gevolgschade voor eigenaar en derden, voor rekening en risico van de huurder."

Asker: Interesting, I was actually thinking more along the lines of: Ingebruikname en Afbouw = Occupation and Fitting-out

Asker: Thanks! Still not sure if "afbouw" here is about adding or removing (as you suggest) fixtures. Also feel that "ingebruikname" is "occupation" here, rather than relating to said fixtures.

  -> Would you accept "initial adaptation and final restoration", from which the Reader would understand "initial adaptation [for occupancy] and final restoration [when vacating]"?

agree  Tina Vonhof (X): Seen this in previous translations. It's a standard requirement in business and office leases. You could shorten it by saying: installation and removal of fixtures.

  -> Thank you. I think it's ambiguous. The Asker's comment above has merit. HOWEVER, similarly to you, I have seen my interpretation many times in my work, where the meaning was 100% clear from context etc.!

disagree  Kitty Brussaard: I'm afraid that "afbouw" has nothing to do with the removal or restoration of lessee-installed fixtures when vacating the premises. "Afbouw" is the process/phase of fitting out premises leased (or sold) in shell condition.

Asker: Not sure this is the correct interpretation. See my comments elsewhere. Since I find so many refs supporting "afbouw" as fitting out, I wouldn't feel comfortable interpreting it as meaning the removal of fixtures in my text. Decommissioning/dismantling is a possible meaning of "afbouw", but usually in the case of machinery/installations, rather than entire buildings. Am basically on the fence still.

  -> No, I think it's ambiguous - it can mean finishing something off (so fitting out to your requirements) or dismantling (unbuilding as it were) which can equate to decommissioning (so when you vacate you have to remove your fittings).

agree  philgoddard: You don't need references for this - you can translate it however you like, within reason. Two other alternatives: check-in and check-out provisions, or move-in and move-out
