For purposes of this Agreement “Confidential Information” shall mean information including, without limitation, ideas, inventions (whether patentable or not), schematics and other technical, business, financial and product development plans, customer lists, information regarding distribution channels, forecasts, and strategies, whether or not such items are marked “Confidential”, but if disclosed orally, identified as confidential and reduced to writing within thirty (30) days after such oral disclosure.
I don't quite get the last part of this sentence. Do they mean that, regardless of whether the information is marked as confidential, all one needs for it to be considered as such is that it be "disclosed orally, identified as confidential and reduced to writing within thirty (30) days after such oral disclosure"?

Aux fins du présent contrat, le terme "Informations confidentielles" désigne notamment, sans que cette liste ne soit exhaustive, les idées, inventions (brevetables ou non), etc., que lesdits éléments (c'est-à-dire la liste qui vient d'être donnée) portent ou non la mention "confidentiel" ; cependant, en cas de divulgation orale, la nature confidentielle de l'élément concerné devra être précisée et ce dernier devra être porté par écrit dans un délai de trente jours à compter de sa divulgation.
Ma rédaction n'est peut-être pas très heureuse pour la fin de la phrase mais je pense que vous comprendrez le sens.

It's taken me quite a while to get my head round this!
This is how I read it: "whether or not such items are marked 'Confidential'," refers to all the items referred to after "including, without limitation" i.e. if they are in writing, it doesn't matter if they are stated to be confidential or not. If the item falls within the categories listed, it is confidential information.
However, if confidential information is given orally, then you have to say at the time that it is confidential and you have to set out the confidential information in writing within 30 days of talking about it. This is how I understand "reduced to writing" i.e. that it is not enough simply to write that the information given orally was confidential.
I have a horrible feeling my explanation is as opaque as the source text!! I hope it helps.
