settlement of an estate
Explanation:
A Last Will and Testament contains instructions for the distribution of a person's assets, also referred to as the estate, when he dies. The will names a specific person, known as the executor, to act as the estate's representative. The executor, sometimes referred to as the administrator, must collect the decedent's assets, pay his debts and estate taxes, and distribute his remaining assets to the heirs named in the will. This process, called settling the estate, occurs under the supervision of the state probate court.

performance of an estate

Explanation:
An estate, in common law, is the net worth of a person at any point in time alive or dead. It is the sum of a person's assets – legal rights, interests and entitlements to property of any kind – less all liabilities at that time. The issue is of special legal significance on a question of bankruptcy and death of the person. (See inheritance.)

Performance, in law, act of doing that which is required by a contract. The effect of successful performance is to discharge the person bound to do the act from any future contractual liability.

Each party to the contract is bound to perform promises according to the stipulated terms. In case of any controversy as to the meaning of a promise, the courts have usually decided that a person must perform it as the other party reasonably understood it to be. Thus, a preference for the rights of the one who is to receive the benefit of the promise is established.

Attempts to establish hard and fast rules about reasonable interpretations of promises are now discouraged. Although at one time a person would be held to the literal meaning of the contract provisions stating a promise, the requirement now is to perform the true meaning and intent of the contract, which may not correspond with the fine print.

disagree  AllegroTrans: An estate is not "performed" and your examples relate to contracts//all true, but that doesn't make your answer correct, it is simply the wrong term; performance is the carrying out of a contractual obligation, not dealing with an estate

-> It takes time and expertise to determine and distribute an estate. In addition, an estate includes many contracts signed by the party who owns the estate.

neutral  philgoddard: Your explanation is lifted from Wikipedia. You should say this.

ejecución de la herencia de Dª.....
satisfaction - fulfilment and/or payment - of the inheritance of Mrs. .....

Explanation:
The extra context : notably, a deed of acceptance of inheritance or the estate > possibly assets-only and no libailities - supplied by the asker changes the whole complexion of my answer, narrowing down the 'herencia' from the estate generally to a specific inheritance of a legacy or devise of land and buildings.

West: herencia - there are three parts to an inheritance..... my translation 1. legitim or automatic entitlement 2. mejora / a top-up and 3. the free estate.

I will leave our accountants to explain the equitable doctrine of satsfaction of portion-debts by legacies.

Now, post-Taña D'.s clever and pertinent research in the Discussion Entry, my answer is to be prefaced with: 'Execution of Probate / or Letters of Confirmation / to satisfy the inheritance of...'.

Example sentence(s):
  • La herencia comprende todos los bienes, derechos y obligaciones de una persona que no se extingan por su muerte. art 659 cc
  • Satisfaction of portion debts by legacies: A portion was defined in Taylor V Taylor as something given by a father to his child with a view to establishing the child in life.
