1 Article 1 is proposed to be amended with the addition of the following definitions:
Unified License means an individual license permitting a duly authorized service provider to provide any telecommunications services using any type of telecommunications infrastructure and technology capable of delivering the desired service.
Wholesale License means an individual license permitting the service provider to build, own and operate a public telecommunication network for the provision of public telecommunication services only to other Individual Licensed operators
General Authorization License means a class license permitting a service provider to provide any telecommunications services authorized under that license.
2 Article 11.2 is proposed to be amended as follows:
11.2 There shall be two types of individual license; the Unified License, and the Wholesale License, which shall, unless the Commission decides otherwise, permit the provision of any telecommunications network and telecommunications service, as per the conditions of that license

1- من المقترح أن يتم تعديل المادة رقم 1 مع إضافة التعريفات التالية:
الرخصة الموحدة: ويقصد بها الرخصة الفردية التي تسمح لمُقِدم الخدمة المفوض أصولاً بتقديم أية خدمات اتصالات وذلك باستخدام أي نوع من أنواع البنية التحتية للاتصالات والقدرة التكنولوجية على توصيل الخدمة المطلوبة.
رخصة الجملة: ويقصد بها الرخصة الفردية التي تسمح لمُقِدم الخدمة ببناء وامتلاك وتشغيل شبكة اتصالات عامة لتوفير خدمات اتصالات عامة فقط للمشغلين الفرديين المرخص لهم.
رخصة التفويض العامة: ويقصد بها الرخصة الفئوية التي تسمح لمُقِدم الخدمة بتقديم أية خدمات اتصالات معتمدة بموجب تلك الرخصة.
2- من المقترح أن يتم تعديل المادة رقم 11-2 لتصبح كما يلي:
11-2 ينبغي أن يكون هنالك نوعين من الرخص الفردية؛ الرخصة الموحدة، ورخصة الجملة، والتي تسمح؛ ما لم تقرر اللجنة خلافاً لذلك، بتوفير أية شبكات اتصالات وخدمات الاتصالات بموجب شروط وأحكام تلك الرخصة.

Article One : Definitions & Interpretations:
1-1 Definitions:
The defined terms & expressions in CITC’s Ordinance and its implementing bylaw and CITC’s organization shall have the same meaning when used in conjunction with this Service Authorization, unless the context set herein requires otherwise:
“Application” shall mean all documents, information, data & obligations provided by the applicant to CITC for obtaining a Service Authorizationto render broadband satellite services in the Kingdom of Saudi Arabia.
“General Terms & Conditions” shall mean the General Terms & Conditions for General Authorization License prescribed in the License Classification Regulations published on the CITC website.
“User Terminals” means the transmission and reception equipment required by the User to access the licensed BBSS and which shall be capable of being controlled by the Licensee through the Licensee’s network.
“Service Provider” means an operator with a General Authorization License and a Service Authorization for providing Broadband Satellite Services and who is obliged to meet all conditions specified in this Service Regulation.
1-2 Service Regulation Documentation:
This Service Regulation along with its related documents inclusive of, but not limited to, the General Terms & Conditions and related appendices, shall constitute an integral part thereof and shall be interpreted accordingly. Such documents are complementary to each other.
Article Two: Compliance with the Rules & Regulations:
2-1 The Service Provider must abide by CITC Ordinance including this Service Regulation’s Terms & Conditions, Telecommunication Act & its implementing bylaw, CITC Organization, regulatory frameworks, resolutions & guidelines issued by CITC from time to time including the organizations & procedures relating to approval of communication equipment and information technology.
2-2 The Service Provider is bound by whatever information & obligations it provides in its application for securing this License.
2-3 The Service Provider shall submit periodical reports to CITC and provide any information that CITC requires. CITC will determine those reports and the nature of the required information & documentation and date of submission.
2-4 This Service Provider shall be effected pursuant to CITC Ordinance & any subsequent resolutions issued by CITC.
2-5 The Service Provider activities & acts shall be subject to the applicable rules & regulations in the Kingdom of Saudi Arabia.
2-6 The Service Provider shall adhere to the General Conditions and all other relevant License Conditions specified in the License Classification Regulation | Translation - Arabic
المادة الأولى: التعريفات والتفاسير:
التعريفات:
يكون للمصطلحات والتعابير المعرفة في نظام الهيئة ولائحته التنفيذية، وتنظيم الهيئة المعاني نفسها عند استخدامها في هذا الترخيص وفضلاً عن ذلك يكون للمصطلحات والتعابير التالية المعاني المحددة أمامها، ما لم يتطلب سياق الكلام في هذا الترخيص خلاف ذلك.
"الطلب" يعني كافة الوثائق، والمعلومات، والبيانات، والالتزامات المقدمة من قبل مقدم الطلب للهيئة لغرض الحصول على ترخيص تقديم خدمات الأقمار الصناعية ذات النطاق العريض بالمملكة العربية السعودية.
"الشروط العامة" تعني الشروط والأحكام العامة لترخيص التفويض العام المنصوص عليها في لوائح تصنيف الرخص المنشورة على الموقع الإلكتروني للهيئة.
"الأجهزة الطرفية للمستخدم" تعني أجهزة الإرسال والاستقبال اللازمة للمستخدم للوصول إلى الخدمات المقدمة من قبل مقدم خدمات الأقمار الصناعية ذات النطاق العريض المرخص له بتقديمها، كما يمكن للمرخص له التحكم في هذه الأجهزة من خلال شبكته.
1-2 الترخيص و وثائقه
يمثل هذا الترخيص، وكافة الوثائق المرتبطة به، بما فيها، على سبيل المثال لا الحصر، الشروط والأحكام العامة والخاصة، والملاحق ذات العلاقة جزء لا يتجزأ من هذا الترخيص ويجب قراءتها وتفسيرها على هذا النحو، كما تعد تلك الوثائق مكملة لبعضها.
الالتزام بالأنظمة:
2-1 يجب على المرخص له الالتزام بأنظمة الهيئة بما في ذلك شروط وأحكام هذا الترخيص، ونظام الاتصالات ولائحته التنفيذية، وتنظيم الهيئة، والأطر التنظيمية، والقرارات، والإرشادات التي تصدرها الهيئة من حين لآخر بما فيها التنظيمات والإجراءات المتعلقة باعتماد أجهزة الاتصالات وتقنية المعلومات.
2-2 يكون المرخص له ملزماً بما قدمه من معلومات والتزامات ضمن طلب تقديمه للحصول على هذا الترخيص.
2-3 على المرخص له تقديم تقارير دورية إلى الهيئة وتوفير أي معلومات تطلبها منه وتحدد الهيئة أنواع تلك التقارير وطبيعة المعلومات والوثائق المطلوبة ووقت تقديمها.
2-4 يتم تنفيذ هذا الترخيص وفقاً لأنظمة الهيئة، وأية قرارات تصدرها الهيئة.
2-5 تكون أنشطة المرخص له وتصرفاته خاضعة للأنظمة المعمول بها في المملكة العربية السعودية.
2-6 يلتزم مقدم الخدمة بالشروط العامة وكافة شروط الترخيص الأخرى ذات العلاقة المحددة في لائحة تصنيف الترخيص. |
