proceeds Explanation: I have worked at one of the top law firms in Korea and translated many times this 'typical' legal phrase. I believe the term for 과실 in this case needs to be compared with the legal term in the US or UK. Almost all US or UK legal documents refer to 'proceeds" from shares or commercial papers taken in security by a creditor. Fructus as found in the Korean government publication is not supported by the Korean law firms. This makes sense to me because the term 'fructus' is related to real property rather than securities. I think you may use 'fruits' in literary documents but in official legal documents this term will be surely striken out by a knowledgeable editor. |
