En cuanto a la incompetencia del Ayuntamiento sobre las obras ejecutadas en mar territorial, y la correlativa no sujeccion al impuesto, no se plantea controversia alguna a nivel normativo, por lo cual esta alegación de la demandante habría de ser estimada. Dado que consideramos que también están perfectamente deslindadas estas obras no vemos dificultad alguna para que, estmada esa alegación. se lleve a efecto pero aun en el caso improbable de que el Juzgado no tuviese por probado este delinde, ello nunca podría dar lugar a la desestimación de la alegación y el consiguiente gravamen de esas obras por el impuesto ***, sino, a lo sumo, a la estimación para el posterior deslinde en tramite de ejecución de sentencia.
