Beschluss
1. Das Aufenthaltsbestimmungsrecht, einschließlich des Rechts, das Kind mit nach Indien zu nehmen und eine Schulanmeldung vorzunehmen, wird für das gemeinsame minderjährige Kind, XXX, geboren am ..., der Antragstellern übertragen. Der Antrag des Antragsgegners wird zurückgewiesen.
2. Die Kosten des Verfahrens werden gegeneinander aufgehoben,
Verfahrenswert: 3.000,-€.
Gründe
Die Beteiligten sind Eltern des gemeinschaftlichen Kindes XXX.
Das Kind wird überwiegend von der Mutter betreut. Sie ist auch Hauptbezugsperson.
Das Kind hat seinen Lebensmittelpunkt bei der Mutter.
Die Parteien stammen ursprünglich aus Indien.
Nach der Eheschließung der Parteien im Jahr 1999 zogen diesen mit der Tochter im Oktober 2002 nach Deutschland.
2004 kehrten Mutter und Kind nach Indien zurück, begleitet vom Vater, der sich nach einem Monat wieder zurück nach Deutschland begab.
Im Jahr 2006 kamen die Antragstellerin und die Tochter nach Deutschland nach.
Beide Elternteile beantragen das Aufenthaltsbestimmungsrecht für das Kind jeweils auf sich zu übertragen.
Bei der persönlichen Anhörung hat das Kind XXX erklärt, dass es bei der Mutter bleiben will. XXX ist ein intelligentes Mädchen, das diese Aussage unabhängig für die Varianten getroffen hat, ob die Mutter nun in Deutschland bleiben will oder zukünftig in Indien leben möchte. XXX befürwortet ein Leben in Indien, aufgrund der dort für sie leichteren Kontakte und aufgrund der Angehörigen.
Zwischenzeitlich hat XXX allerdings auch in ihrer Klasse Fuß gefasst, was ihr Selbstbewusstsein stärkt.

Der Verfahrensbeistand hat daher vorgeschlagen, XXX die vierte Grundschulklasse abschließen zu lassen, damit auch formell eine dann übliche Verabschiedung in Verbindung mit dem Besuch der weiterführenden Schule erfolgen kann. Außerdem solle der Wechsel nach Indien längerfristig vorbereitet werden und der Kontakt zum Vater hier intensiviert werden.
Dem ist die Antragstellern entgegengetreten, da sie durch eine Verfestigung und ein Hinausziehen der Rückkehr nach Indien eine Erschwerung der Situation für ihre Tochter befürchtet.
Der Antragsgegner kann materiell auf jeden Fall XXX ein Hierbleiben ermöglichen.
Er war in der Vergangenheit eher der Ernährer der Familie mit den hierzu üblichen Kontakten.
Das beteiligte Kreisjugendamt ist dem Antrag der Antragstellerin nicht entgegengetreten.
Dem Antrag der Mutter, ihr das Aufenthaltsbestimmungsrecht einschließlich der genannten Nebenrechte für das gemeinsame Kind alleine zu übertragen, war stattzugeben, da nach Anhörung der Parteien, des beteiligten Jugendamtes, des Kindes und des Verfahrensbeistands es sich hierbei um diejenige Sorgerechtsentscheidung handelt, die für das Kind die am wenigsten schädliche Variante darstellt, §§ 1671 Abs.2 Nr.2, Abs.3, 1697 a BGB.
Die Parteien können sich letztlich nicht über den Zeitpunkt der Rückkehr einigen.
Der Antragsgegner möchte vor allem ein Scheidungsverfahren in Deutschland abschließen.
Gegen die Erziehungseignung der Mutter bestehen keine Bedenken.
Die Antragstellerin weiß, was sie sich bei einer Rückkehr mit ihrer Tochter in das Heimatland Indien einhandelt.
Mutter und Kind hatten dort bereits ihren Aufenthalt, während der Antragsgegner zwei Jahre lang in Deutschfand war.
Die Antragstellerin konnte in ihrem erlernten Beruf als Lehrerin in Deutschland keinen Fuß fassen, während sie in Indien eine Zusage für eine Beschäftigung hat.
Der bei der persönlichen Anhörung gewonnene Eindruck von den Neigungen, Bindungen und dem Willen des Kindes XXX wurde bei der Entscheidung berücksichtigt.
Das Gericht folgt dabei der Argumentation der Antragstellerin, wonach ein Hinauszögern des Wechsels aufgrund des unklaren Aufenthaltsstatus, sowie der dann noch längeren Eingewöhnungsphase von XXX in Deutschland, zusätzliche Probleme bereitet.
Freundschaften in Deutschland werden intensiviert, der in Indien zu bewältigende Lernstoff für XXX wird noch weiter in die Zukunft verlagert.
Die Beziehung zwischen XXX und dem Antragsgegner bietet keine entsprechend sichere Grundlage.
Es ist für XXX aber auf jeden Fall erforderlich, dass sie Kontakt zum Vater halten kann.

Dies ist durch die Regelung eines gesonderten Umgangsrechts sicherzustellen.
Der Antragstellerin ist hiermit nochmals klarzumachen, dass der Kontakt von XXX zu ihrem Vater wichtig ist. Dieser darf nicht unterbunden werden.
Die Kostenentscheidung beruht auf § 81 Abs. 1 Satz 1 FamFG.

Regarding parental custody
The District Court of Backnang, hereby, issues the following decree on 23.08.2010 through the judge at District Court Züfle on the basis of the hearing dated 16.08.2010.

Decree
1. The right to determine the domicile of the child, XXX, born on ..., including the right to take the child to India and register her name in a school, is granted to the petitioner. The petition of the respondent stands rejected.
2. The costs of the proceedings shall be divided equally between the parties.
Value in dispute: € 3,000.00
Reasons
The parties are parents of the common child, XXX.
The child has, predominantly, been looked after by the mother. The child is also primarily attached to her.
The mother is the centre of the child’s life.
The parties originally come from India.
After getting married in 1999, the parties moved to Germany in October 2002 with their daughter.
In 2004 mother and child returned to India, accompanied by the father, who again left for Germany after a month.
In 2006 the petitioner and the daughter followed him to Germany.
Both parents have filed a petition for granting the right to determine the child’s domicile to them respectively.
At a private hearing, the child XXX stated that she wants to stay with the mother. Prachi is an intelligent girl, who made this statement irrespective of the option whether the mother wishes to stay in Germany or live in India in the future. XXX prefers living in India because there she can make contacts easily and has family and relatives.
In the meanwhile, XXX has also gained a foothold in her class, which has increased her self-confidence.

The legal advisor, therefore, recommended letting XXX complete her fourth year at primary school, so that she may be formally discharged from school, as required by primary school education norms to continue further schooling. In addition, the process of shifting to India should be planned over a longer period of time and the contact with the father should be intensified here.
The petitioner countered the recommendation, for she fears the situation would become complicated for her daughter if she gets acclimatised and if there is a delay in returning to India.
The respondent is, by all means, in a position to financially support XXX if she stays.
He was, in fact, the breadwinner of the family in the past, performing the usual duties.
The participant local youth welfare office did not counter the petition of the petitioner.
The petition of the mother, requesting the Court to grant the exclusive right to determine the child’s domicile including the above-mentioned ancillary rights, was accepted because as per the hearing of the parties, the participant youth welfare office, the child and the legal advisor this becomes a case of child custody that presents the least detrimental option for the child, i.e. §§ 1671 para 2 no. 2, para 3, 1697 a BGB [German Civil Code].
Finally, the parties have not been able to agree upon a date of return.
The respondent wishes to first conclude a divorce proceeding in Germany.
There are no concerns regarding the parenting abilities of the mother.
The petitioner is aware of what she is heading for in case she returns with her daughter to their home-country, India.
Mother and child were already staying there while the respondent was in Germany for two years.
The petitioner could not gain a foothold in her occupation as teacher in Germany, whereas in India she has an assurance of finding employment.
The impression about the inclinations, attachments and will of the child, XXX, gathered at the private hearing, were taken into consideration while making the decision.
The Court, thereby, complies with the petitioner’s argument that a delay in shifting owing to unclear domicile status, as well as Prachi’s longer settling period in Germany, pose additional problems.
XXX would establish closer bonds and friendships in Germany, and the amount of school work she has to cope with in India would get pushed into the future.
The relationship between XXX and the respondent provides no sound basis.
However, it is in any case important for XXX to be able to maintain contact with her father.

This shall have to be ensured by means of separate visitation rights.
It shall, hereby, be required to again clarify to the petitioner that the contact between XXX and her father is important. Inhibiting such contact shall not be allowed.
The decision regarding costs is based on § 81 para 1 art. 1 FamFG [Procedural Law in Family Matters and Matters of Custodianship]
English to Hindi: Non-Traditional homes

These are homes that are built using different materials to the usual brick and block with a cavity in between. Non­traditional properties are built with materials such as a mixture of steel and concrete. The majority of these homes do not have cavities, which make them difficult to insulate.

We are drawing up detailed proposals to upgrade all homes that are of ‘Non-Traditional’ construction. Investment in these homes is complex, and requires more money than homes of traditional construction.

Specialist Surveyors XYZ have been appointed to carry out survey work for us. The aim of their work is to inspect a sample of each ‘non traditional’ house type, sheltered accommodation unit and high rise blocks. This will help to establish what works may be required to ensure their long term sustainability including, insulation and Disability Discrimination Act requirements. This information will feed into our 5 year Housing programme. We will begin the surveys with home calls. The surveyors intend to visit a small number of each house type for an initial survey. We will keep you updated on our progress with Non-Traditional homes over the coming months.

विशेषज्ञ सर्वेक्षक संस्था ‘कखग’ को हमारे लिए सर्वेक्षण कार्य करने हेतु नियुक्त किया गया है| इनके कार्य का मुख्य उद्देश्य प्रत्येक प्रकार के ‘अपारंपरिक’ घरों, आश्रय निवासों और गगनचुंबी इमारतों के नमूनों की जांच करना है| इससे यह स्थापित करने में सहायता मिलेगी कि इन घरों और इमारतों के लंबे समय तक टिके रहने के लिए किस तरह के सुधार कार्य करने होंगे, जिनमें तापावरोधन (इंसुलेशन) और विकलांगता भेदभाव अधिनियम (डिसएबिलिटी डिस्क्रिमिनेशन एक्ट) के प्रावधानों का पालन आदि शामिल हैं| यह जानकारी हमारी पंच-वर्षीय गृह योजना में दर्ज की जाएगी| सर्वेक्षणों की शुरुआत घर-घर जाकर मुआयना करने से की जाएगी| प्रारंभिक सर्वेक्षण के लिए हमारे सर्वेक्षक प्रत्येक प्रकार के घरों की एक छोटी संख्या का निरीक्षण करेंगे| आने वाले महीनों में अपारंपरिक घरों के सुधार की दिशा में हुई प्रगति की जानकारी हम आप तक पहुंचाते रहेंगे|

Zur Person
Gromzigs Medium ist das Holz, das unter seinen Händen eine eigenwillige Metamorphose durchlebt. Oft vergehen Jahre bis zur Vollendung einer Skulptur. Der Skulpteur verarbeitet meist über 200 Jahre alte Eichenbalken. Seine Rohlinge stammen überwiegend aus alten Gebäuden. Weiche filigrane Formen, herausgemeißelt und mit reinem Bienenwachs aus der eigenen Imkerei überzogen, verleihen dem alten, schweren Eichenbalken eine schwebende Leichtigkeit, die im Widerspruch zum Material zu stehen scheint - oder eben sein Geheimnis offenbart.

„Form im Holz, Form in mir“ nennt Gromzig viele dieser Arbeiten. Er bringt damit zum Ausdruck, wie er als Künstler arbeitet. Das Holz selbst gibt ihm den Gestaltungsimpuls. Er sieht darin Formen und Figuren, die er durch seine Arbeit offen legt.

I'm not looking for work, because I chose a job I love! :)

THE JOURNEY SO FAR

It's been over 20 years since I began my journey as a translator. After a brief corporate stint at the renowned automotive company Robert Bosch Engineering & Business Solutions, I moved to something I truly wanted to do in the first place -- freelance translation.

The most exciting thing about being a freelance translator is that one can choose to explore and work on different kinds of subjects and topics. Yes, domain expertise has its legitimate place in the translation profession, but I also most humbly believe that with proper research, interaction with domain experts and an eye for accuracy a translator should be able to handle any subject. Therefore, I usually hesitate to mention my areas of expertise because I'm always keen to work on texts outside my areas of experience.

Afterall, man lernt nie aus!

At Bosch, I gained deep insight into automotive, SAP ERP and patent translations. The freelance projects that have come my way have primarily related to the areas general legal, web content, general business and advertising, and literature.

THE WAY FORWARD

At this point in my life and career, I crave to do something more creative, more challenging -- translations that get the juices flowing. I'm particularly keen on enhancing my skills in translations related to general health and nutrition, mental health, general medicine and pharmaceuticals, etc. Would love to collaborate on literary translation projects as well!
