I am having trouble understanding the last portion of this "sentence":

Por otro lado no queda acreditado en el expediente que el padre hubiese ejercido la custodia de forma efectiva, aspecto este que, junto al hecho del periodo transcurrido desde el traslado,

On the other hand the expedient that the father has exercised custody effectively is unsubstantiated, an aspect which, together with the period of time elapsed from the time of transfer,

You can see that my attempt falls apart in the last half of this section. I'm not so much looking for a translation as an explanation; I really don't understand exactly what the second part of this sentence says. Any help would be greatly appreciated.

ponemos de manifiesto al objecto si procede la presentacion de la demanda (de restitucion del menor), y en su caso si se insta por esta Abogacia del Estado la restitucion o una regulacion del regimen de visitas.

Terri, you should start by looking up the translation for "expediente" in a legal context. Also, "... time elapsed SINCE the transfer".

Where is the term in the original. I hate to say it but you are having a problem with the first part of the sentence as well. It actually says:
Furthermore it is not demonstrated in the matter that the father has effectively exercised custody .......

Oh dear, you're having a few problems here I fear. Ponemos de manifiesto here simply means 'which we state' and it goes on 'for the purpose' (al objeto - not objecto) if......
