As Stephen says, the divorce agreement does not become a valid legal document until both parties have signed it, and until the spouse gets around to signing it as well, the first party to sign is not bound by it. Otherwise, it could be argued that the document became effective on the first signature, and the first signatory would be bound to abide by the terms of the agreement long in advance of the second signatory.
Or something like that.

: Mistranslation - take a 2nd look. "contre celle qui l'a apposée"=against the party which signed. Even if A signs, A cannot be bound by the fact he / she has signed. Both signatures are required - a bi-lateral agreement. Both sign, both are bound.
