Source text - English Pertinent issues relating to governance
There was a striking consensus from respondents on issues relating to governance in Peru. Interviewees spoke consistently about corruption, decentralisation, natural resource extraction and social exclusion. There was also a significant level of agreement in the analysis of these issues by respondents.
After the scandal that rocked the Fujimori administration, there was a concerted effort to tackle corruption by the interim government. A taskforce was established and one of its recommendations was to centralise efforts and responsibility for addressing corrupt practices. The Toledo administration formed an anti-corruption commission, but according to respondents it suffered from a lack of resources and was not given a mandate to initiate investigations. The Commission was disbanded in 2001 only a year after its inception. Currently the Cabinet is assuming an anti-corruption role, with Ministers holding discrete responsibilities. There is also a national plan in place. One respondent reflected that this was a sign of progress but was reluctant to describe developments under Garcia as concrete steps towards effectively tackling corruption. Many felt that the Garcia administration had lost the momentum built up by Toledo and that the political appetite to address corruption was waning.
Peru has adequate anti-corruption legislation but weak institutions and a lack of enforcement contribute to a culture of impunity and tacit acceptance of corrupt behaviour. Those most susceptible to petty and grand corruption are indigenous people groups, whose rights are frequently violated. They are also experiencing high levels of poverty and social exclusion.
‘Fujimori robbed the rich, but governed well.’
Peru is a country that is facing many challenges and is changing rapidly, creating an ideal environment for corruption. The general public tolerates corruption as long as things get done. It is common practice to pay a bribe to access services. Petty corruption eats into the already meagre incomes of people living in poverty and grand corruption is a barrier to public service provision. Corruption appears to impact upon the design of social policy, not just the implementation of programmes. One respondent claimed that policies on social welfare are based on economic interests and that the beneficiaries are not those who require welfare interventions but the companies providing the services, for example, the supplies of food for communal kitchens. Respondents felt that there was a profound lack of understanding amongst the population of the impact of grand corruption on sectors such as health and education. In 2004, 10% of the national budget was lost as a result of corruption. Peru has been without a General Controller for several months. The General Controller is responsible for auditing public spending. This has significant implications regarding government accountability for the use of public funds.
Peru remains a highly centralised country. There are 24 regions, but under decentralisation plans these would be amalgamated into 7 or 8 regional authorities. The decentralisation process is slow and hindered by disputes regarding budget allocation and a lack of capacity in regional government to manage resources and roll out programmes. Currently, local government only receives 4% of the public sector budget. Specifically, respondents felt that the local authorities’ system for tax collection should be strengthened and they should be given power to administer their own resources. One respondent accused the President of using divide and rule tactics to maintain control over regional authorities.
Decentralisation has been implemented in the health and education sectors. Many of the poorest communities live in geographically remote areas and this poses a significant challenge to providing health and education services. Regional government gets ‘thrown a bone’ observed one respondent, while central government maintains control over the strategic and lucrative sectors such as natural resources.
The current system poses a number of problems. Respondents indicated that the majority of resources remain in Lima and are not benefiting the whole population. A centralised system also means it takes time to disperse public funds. This is a problem when budgets are allocated on an annual basis. However, for decentralisation to effectively address these problems greater transparency and participation needs to be encouraged and facilitated.
Issues related to extractive industries were articulated by almost all the respondents. In general it was felt that the sector is poorly regulated and the penalties for non compliance are minimal. The majority of complaints dealt with by the national ombudsman are concerning mining and environmental problems. Conflicts with mining companies are increasing as is the pressure to exploit minerals. There is a stark contrast between the US$ billions made in profits and the extreme poverty faced by many of the communities whose traditional lands are being stripped of natural resources. Communities are ill-equipped to enter into negotiations with big business. Very little support is provided by the State to communities trying to negotiate with highly skilled and well-informed representatives from multi-nationals. Human rights groups have been working to empower communities and are calling for tighter regulation, harsher penalties and increased transparency. Peru has joined the Extractive Industries Transparency Initiative (EITI) and some companies have signed up, but few agreeing to full disclosure because of fears over security.

Hubo un notable consenso de parte de los informantes en cuanto a asuntos relacionados con la gobernabilidad en el Perú. Los entrevistados coincidieron sobre la corrupción, la descentralización, la extracción de los recursos naturales y la exclusión social. También hubo un nivel importante de acuerdo en el análisis de los informantes sobre estos asuntos.
Luego del escándalo que sacudió la administración de Fujimori, el gobierno provisional llevó a cabo un esfuerzo organizado por enfrentar la corrupción. Se creó un equipo de tareas y una de sus recomendaciones fue centralizar los esfuerzos y la responsabilidad para abordar las prácticas corruptas. La administración de Toledo formó una comisión anticorrupción, pero de acuerdo con los informantes, ésta sufrió de una falta de recursos y no se le otorgó poder para iniciar investigaciones. La comisión fue disuelta en el 2001, tan sólo un año desde su comienzo. En la actualidad, el Gabinete está asumiendo un papel de anticorrupción, en el que los Ministros tienen responsabilidades discretas. También se ha implementado un plan nacional. Un informante reflexionó que ésta era una señal de progreso, pero se mostró renuente a describir los eventos bajo el mandato de García como pasos concretos hacia enfrentar la corrupción con eficacia. Muchos opinaron que la administración de García había perdido el impulso labrado por Toledo y que el apetito político por dar respuesta a la corrupción estaba menguando.
El Perú tiene leyes anticorrupción adecuadas, pero tiene instituciones débiles, y la falta de aplicación de las leyes contribuye a una cultura de impunidad y de aceptación tácita del comportamiento corrupto. Las personas más susceptibles a la corrupción a pequeña y gran escala son los pueblos indígenas, cuyos derechos con frecuencia son violados. También están experimentando altos niveles de pobreza y de exclusión social.

El Perú es un país que está enfrentando muchos retos y está cambiando rápidamente, creando así un ambiente ideal para la corrupción. El público general tolera la corrupción siempre y cuando las cosas se ejecuten. Es una práctica común pagar un soborno para tener acceso a los servicios. La corrupción de menor escala corroe los ya escasos ingresos de las personas que viven en la pobreza y la corrupción a gran escala es una barrera a la provisión de servicios públicos. La corrupción parece afectar el diseño de las políticas sociales, no solamente la implementación de programas. Un informante alegó que las políticas de servicios sociales se basan en los intereses económicos y que los beneficiarios no son quienes necesitan las intervenciones de servicios sociales sino las compañías que proporcionan los servicios, por ejemplo, los suministros para los comedores comunales. Los informantes opinaron que existe una profunda falta de entendimiento en la población respecto al impacto de la corrupción a gran escala sobre sectores tales como la salud y la educación. En el 2004 se perdió el 10% del presupuesto nacional como resultado de la corrupción. El Perú no ha tenido Contralor General por varios meses. El Contralor General es la persona responsable de auditar los gastos públicos. Esto tiene implicaciones importantes respecto a la rendición de cuentas del gobierno sobre el uso de los fondos públicos.
El Perú continúa siendo un país altamente centralizado. Existen 24 regiones, pero bajo los planes de descentralización éstas serían fusionadas en 7 u 8 autoridades regionales. El proceso de descentralización es lento y se ve entorpecido por las disputas respecto a la asignación presupuestaria y por una falta de capacidad en el gobierno regional para manejar los recursos y para implementar los programas. Actualmente, el gobierno local solamente recibe el 4% del presupuesto para el sector público. Específicamente, los informantes opinaron que el sistema de recolección de impuestos de las autoridades locales debería ser fortalecido y debería otorgárseles poder para administrar sus propios recursos. Un informante acusó al Presidente de utilizar tácticas de divide y gana para mantener el control sobre las autoridades regionales.
Se ha implementado la descentralización en los sectores de salud y educación. Muchas de las comunidades más pobres viven en zonas geográficas remotas y esto representa un reto importante en cuanto a proporcionar servicios de salud y educación. Un informante comentó que al gobierno regional ‘le tiran un hueso’ mientras que el gobierno central mantiene el control sobre los sectores estratégicos y lucrativos, como los recursos naturales.
El sistema actual acarrea varios problemas. Los informantes indicaron que la mayoría de los recursos permanece en Lima y no están beneficiando a la población total. Un sistema centralizado también significa que toma tiempo dispersar los fondos públicos. Esto es un problema cuando los presupuestos se asignan anualmente. No obstante, para que la descentralización dé respuesta eficazmente a estos problemas, se necesita animar y facilitar una mayor transparencia y participación.
Casi todos los informantes expusieron asuntos relacionados con las industrias de extracción. En general, la opinión es que el sector está mal regulado y que las multas por no cumplimiento son mínimas. La mayoría de las quejas con las que trabaja el Ombudsman nacional tratan sobre problemas relacionados con la minería y el medio ambiente. Los conflictos con las compañías mineras están aumentando, al igual que la presión por la explotación de minerales. Hay un marcado contraste entre los billones de dólares obtenidos en ganancia y la extrema pobreza que enfrentan muchas de las comunidades cuyas tierras ancestrales han sido despojadas de los recursos naturales. Las comunidades están muy mal preparadas para entrar en negociaciones con las grandes empresas. El estado proporciona muy poco apoyo a las comunidades que intentan negociar con los altamente adiestrados y bien informados representantes de las multinacionales. Grupos de derechos humanos han estado trabajando para empoderar a las comunidades y están haciendo un llamado por más normas, multas más severas y mayor transparencia. El Perú se ha unido al Extractive Industries Transparency Initiative (EITI, por sus siglas en inglés) y algunas compañías se han inscrito, pero pocas han acordado hacer una revelación plena por sentir temor respecto a la seguridad.
