Source text - English As discussed above, see Chapter I.B.2., courts have reached differing conclusions over whether each individual file stored on a computer should be treated as a separate closed container, and this distinction has important ramifications for the scope of the plain view exception. United States v. Carey, 172 F.3d 1268, 1273 (10th Cir. 1999), provides a cautionary example of the restrictive approach. In Carey, a police detective searching a hard drive with a warrant for drug trafficking evidence opened a "jpg" file and instead discovered child pornography. At that point, the detective spent five hours accessing and downloading several hundred "jpg" files in a search not for evidence of the narcotics trafficking that he was authorized to seek and gather pursuant to the original warrant, but for more child pornography. When the defendant moved to exclude the child pornography files on the ground that they were seized beyond the scope of the warrant, the government argued that the detective had seized the "jpg" files properly because the contents of the contraband files were in plain view. The Tenth Circuit rejected this argument with respect to all of the files except for the first "jpg" file the detective discovered. See id. at 1273, 1273 n.4. As best as can be discerned, the rule in Carey seems to be that the detective could seize the first "jpg" file that came into plain view when the detective was executing the search warrant, but could not rely on the plain view exception to justify the search solely for additional "jpg" files containing child pornography on the defendant's computers, evidence beyond the scope of the warrant. Cf. United States v.Walser, 275 F.3d 981, 986-87 (10th Cir. 2001) (finding no Fourth Amendment violation when officer with warrant to search for electronic records of drug transactions opened single computer file containing child pornography, suspended search, and then returned to magistrate for second warrant to search for child pornography).
In contrast to the Tenth Circuit's approach in Carey, the doctrine set forth by the Fifth Circuit in United States v. Runyan, 275 F.3d 449, 464-65 (5th Cir. 2001), and United States v. Slanina, 283 F.3d 670, 680 (5th Cir. 2002), suggests that plain view of a single file on a computer or storage device could provide a basis for a more extensive search. In those two cases, the court held that when a warrantless search of a portion of a computer or storage device had been proper, the defendant no longer retained any reasonable expectation of privacy in the remaining contents of the computer or storage device. See Slanina, 283 F.3d at 680; Runyan, 275 F.3d at 464-65. Thus, a more extensive search of the computer or storage device by law enforcement did not violate the Fourth Amendment. This rationale may also apply when a file has been placed in plain view.
4. Search Incident to a Lawful Arrest
Pursuant to a lawful arrest, agents may conduct a "full search" of the arrested person, and a more limited search of his surrounding area, without a warrant. See United States v. Robinson, 414 U.S. 218, 235 (1973); Chimel v. California, 395 U.S. 752, 762-63 (1969). For example, in Robinson, a police officer conducting a patdown search incident to an arrest for a traffic offense discovered a crumpled cigarette package in the suspect's left breast pocket. Not knowing what the package contained, the officer opened the package and discovered fourteen capsules of heroin. The Supreme Court held that the search of the package was permissible, even though the officer had no articulable reason to open the package. See id. at 234-35. In light of the general need to preserve evidence and prevent harm to the arresting officer, the Court reasoned, it was per se reasonable for an officer to conduct a "full search of the person" pursuant to a lawful arrest. Id. at 235.
Due to the increasing use of handheld and portable computers and other electronic storage devices, agents often encounter computers when conducting searches incident to lawful arrests. Suspects may be carrying pagers, cellular telephones, Personal Digital assistants (such as Palm Pilots), or even laptop computers when they are arrested. Does the search-incident-to-arrest exception permit an agent to access the memory of an electronic storage device found on the arrestee's person during a warrantless search incident to arrest? In the case of electronic pagers, the answer clearly is "yes." Relying on Robinson, courts have uniformly permitted agents to access electronic pagers carried by the arrested person at the time of arrest. See United States v. Reyes, 922 F. Supp. 818, 833 (S.D.N.Y. 1996) (holding that accessing numbers in a pager found in bag attached to defendant's wheelchair within twenty minutes of arrest falls within search-incident-to-arrest exception); United States v. Chan, 830 F. Supp. 531, 535 (N.D. Cal. 1993); United States v. Lynch, 908 F. Supp. 284, 287 (D.V.I. 1995); Yu v. United States, 1997 WL 423070, at *2 (S.D.N.Y. Jul. 29, 1997); United States v. Thomas, 114 F.3d 403, 404 n.2 (3d Cir. 1997) (dicta). See also United States v. Ortiz, 84 F.3d 977, 984 (7th Cir. 1996) (same holding, but relying on an exigency theory).
Courts have not yet addressed whether Robinson will permit warrantless searches of electronic storage devices that contain more information than pagers. In the paper world, certainly, cases have allowed extensive searches of written materials discovered incident to lawful arrests. For example, courts have uniformly held that agents may inspect the entire contents of a suspect's wallet found on his person. See, e.g., United States v. Castro, 596 F.2d 674, 676 (5th Cir. 1979); United States v. Molinaro, 877 F.2d 1341, 1347 (7th Cir. 1989) (citing cases). Similarly, one court has held that agents could photocopy the entire contents of an address book found on the defendant's person during the arrest, see United States v. Rodriguez, 995 F.2d 776, 778 (7th Cir. 1993), and others have permitted the search of a defendant's briefcase that was at his side at the time of arrest. See, e.g., United States v. Johnson, 846 F.2d 279, 283-84 (5th Cir. 1988); United States v. Lam Muk Chiu, 522 F.2d 330, 332 (2d Cir. 1975). If agents can examine the contents of wallets, address books, and briefcases without a warrant, it could be argued that they should be able to search their electronic counterparts (such as electronic organizers, floppy disks, and Palm Pilots) as well. Cf. United v. Tank, 200 F.3d 627, 632 (9th Cir. 2000) (holding that agents searching a car incident to a valid arrest properly seized a Zip disk found in the car, but failing to discuss whether the agents obtained a warrant before searching the disk for images of child pornography).
The limit on this argument is that any search incident to an arrest must be reasonable. See Swain v. Spinney, 117 F.3d 1, 6 (1st Cir. 1997). While a search of physical items found on the arrestee's person may always be reasonable, more invasive searches in different circumstances may violate the Fourth Amendment. See, e.g. Mary Beth G. v. City of Chicago, 723 F.2d 1263, 1269-71 (7th Cir. 1983) (holding that Robinson does not permit strip searches incident to arrest because such searches are not reasonable in context). For example, the increasing storage capacity of handheld computers suggests that Robinson's bright line rule may not always apply in the case of electronic searches. When in doubt, agents should consider whether to obtain a search warrant before examining the contents of electronic storage devices that might contain large amounts of information. 5. Inventory Searches
Law enforcement officers routinely inventory the items they have seized. Such "inventory searches" are reasonable -- and therefore fall under an exception to the warrant requirement -- when two conditions are met. First, the search must serve a legitimate, non-investigatory purpose (e.g., to protect an owner's property while in custody; to insure against claims of lost, stolen, or vandalized property; or to guard the police from danger) that outweighs the intrusion on the individual's Fourth Amendment rights. See Illinois v. Lafayette, 462 U.S. 640, 644 (1983); South Dakota v. Opperman, 428 U.S. 364, 369-70 (1976). Second, the search must follow standardized procedures. See Colorado v. Bertine, 479 U.S. 367, 374 n.6 (1987); Florida v. Wells, 495 U.S. 1, 4-5 (1990).
It is unlikely that the inventory-search exception to the warrant requirement would support a search through seized computer files. See United States v. O'Razvi, 1998 WL 405048, at *6-7 (S.D.N.Y. July 17, 1998) (noting the difficulties of applying the inventory-search requirements to computer disks); see also United States v. Flores, 122 F. Supp. 2d 491, 493-95 (S.D.N.Y. 2000) (finding search of cellular telephone "purely investigatory" and thus not lawful inventory search). Even assuming that standard procedures authorized such a search, the legitimate purposes served by inventory searches in the physical world do not translate well into the intangible realm. Information does not generally need to be reviewed to be protected, and does not pose a risk of physical danger. Although an owner could claim that his computer files were altered or deleted while in police custody, examining the contents of the files would offer little protection from tampering. Accordingly, agents will generally need to obtain a search warrant in order to examine
6. Border Searches
In order to protect the government's ability to monitor contraband and other property that may enter or exit the United States illegally, the Supreme Court has recognized a special exception to the warrant requirement for searches that occur at the border of the United States. According to the Court, "routine searches" at the border or its functional equivalent do not require a warrant, probable cause, or even reasonable suspicion that the search may uncover contraband or evidence. United States v. Montoya De Hernandez, 473 U.S. 531, 538 (1985). Searches that are especially intrusive, however, require at least reasonable suspicion. See id. at 541. These rules apply to people and property both entering and exiting the United States. See United States v. Oriakhi, 57 F.3d 1290, 1297 (4th Cir. 1995).
In at least one case, courts have addressed whether the border search exception permits a warrantless search of a computer disk for contraband computer files. In United States v. Roberts, 86 F. Supp. 2d 678 (S.D. Tex. 2000), aff'd on other grounds, 274 F.3d 1007 (5th Cir. 2001), United States Customs Agents learned that William Roberts, a suspect believed to be carrying computerized images of child pornography, was scheduled to fly from Houston, Texas to Paris, France on a particular day. On the day of the flight, the agents set up an inspection area in the jetway at the Houston airport with the sole purpose of searching Roberts. Roberts arrived at the inspection area and was told by the agents that they were searching for "currency" and "high technology or other data" that could not be exported legally. Id. at 681. After the agents searched Roberts' property and found a laptop computer and six Zip diskettes, Roberts agreed to sign a consent form permitting the agents to search his property. A subsequent search revealed several thousand images of child pornography. See id. at 682.
The district court rejected the defendant's motion to suppress the computer files, holding that the search of Roberts' luggage had been a "routine search" for which no suspicion was required, even though the justification for the search offered by the agents merely had been a pretext. See id. at 686, 688 (citing Whren v. United States, 517 U.S. 806 (1996)). The court also concluded that Roberts' consent justified the search of the laptop and diskettes, and indicated that even if Roberts had not consented to the search, "[t]he search of the defendant's computer and diskettes would have been a routine export search, valid under the Fourth Amendment." See Roberts, 98 F. Supp. 2d at 688. On appeal, the Fifth Circuit affirmed the district court's refusal to suppress the evidence on the grounds that the initial jetway search of Roberts was justified by reasonable suspicion that Roberts possessed child pornography, and that the subsequent search and seizure of computer equipment was justified by probable cause. See id. at 1017. The court did not reach the issue of whether the seizure of Roberts' computer equipment could be considered routine.
Importantly, agents and prosecutors should not interpret Roberts as permitting the interception of data transmitted electronically to and from the United States. Any real-time interception of electronically transmitted data in the United States must comply strictly with the requirements of Title III, 18 U.S.C. §§ 2510-2522, or the Pen/Trap statute, 18 U.S.C. §§ 3121-3127. See generally Chapter 4. Further, once electronically transferred data from outside the United States arrives at its destination within the United States, the government ordinarily cannot rely on the border search exception to search for and seize the data because the data is no longer at the border or its functional equivalent. Cf. Almeida-Sanchez v. United States, 413 U.S. 266, 273-74 (1973) (concluding that a search that occurred 25 miles from the United States border did not qualify for the border search exception, even though the search occurred on a highway known as a common route for illegal aliens, because it did not occur at the border or its functional equivalent).
7. International Issues
Increasingly, electronic evidence necessary to prevent, investigate, or prosecute a crime may be located outside the borders of the United States. This can occur for several reasons. Criminals can use the Internet to commit or facilitate crimes remotely, e.g., when Russian hackers steal money from a bank in New York, or when the kidnappers of an American deliver demands by e-mail for release of their captive. Communications also can be "laundered" through third countries, such as when a criminal in Brooklyn uses the Internet to pass a communication through Tokyo, Tel Aviv, and Johannesburg, before it reaches its intended recipient in Manhattan - much the way monies can be laundered through banks in different countries in order to hide their source. In addition, provider architecture may route or store communications in the country where the provider is based, regardless of the location of its users.
When United States authorities investigating a crime believe electronic evidence is stored by an Internet service provider or on a computer located abroad (in "Country A"), U.S. law enforcement usually must seek assistance from law enforcement authorities in Country A. Since, in general, law enforcement officers exercise their functions in the territory of another country with the consent of that country, U.S. law enforcement should only make direct contact with an ISP located in Country A with (1) prior permission of the foreign government; (2) approval of DOJ's Office of International Affairs ("OIA") (which would know of particular sensitivities and/or accepted practices); or (3) other clear indicia that such practice would not be objectionable in Country A. (There is general agreement that access to publicly available materials in Country A, such as those posted to a public Web site, and access to materials in Country A with the consent of the owner/custodian of those materials, are permissible without prior consultations.)
Under certain circumstances, foreign law enforcement authorities may be able to share evidence informally with U.S. counterparts. However, finding the appropriate official in Country A with which to explore such cooperation is an inexact science, at best. Possible avenues for entree to foreign law enforcement are: (1) the designated expert who participates in the G8's network of international high-tech crime points of contact (discussed below); (2) law enforcement contacts maintained by OIA; (3) representatives of U.S. law enforcement agencies who are stationed at the relevant American Embassy (e.g., FBI Legal Attaches, or "LegAtts," and agents from the U.S. Secret Service and U.S. Customs Service); and (4) the Regional Security Officer (from the Diplomatic Security Service) at the American Embassy (who may have good in-country law enforcement contacts). OIA can be reached at 202-514-0000.
Where Country A cannot otherwise provide informal assistance, requests for evidence usually will be made under existing Mutual Legal Assistance Treaties (MLATs) or Mutual Legal Assistance Agreements, or through the Letters Rogatory process. See 28 U.S.C. § 1781-1782. These official requests for assistance are made by OIA to the designated "Central Authority" of Country A or, in the absence of an MLAT, to other appropriate authorities. (Central Authorities are usually located within the Justice Ministry, or other Ministry or office in Country A that has law enforcement authority.) OIA has attorneys responsible for every country and region of the world. Since official requests of this nature require specified documents and procedures, and can take some time to produce results, law enforcement should contact OIA as soon as a request for international legal assistance becomes a possibility.
When U.S. law enforcement has reason to believe that electronic evidence exists on a computer or computer network located abroad, and expects a delay before that evidence is secured in Country A, a request to foreign law enforcement for preservation of the evidence should be made as soon as possible. Such request, similar to a request under 18 U.S.C. § 2703(f) to a U.S. provider (see Chapter 3.G.1, p. 101), will have varying degrees of success based on several factors, most notably whether Country A has a data preservation law, and whether the U.S. has sufficient law enforcement contacts in Country A to ensure prompt execution of the request. The Council of Europe Cybercrime Convention, completed in 2001, obligates all signatories to have the ability to affect cross-border preservation requests, and the availability of this critical form of assistance therefore is expected to increase greatly in the near future.
To secure preservation, or in emergencies when immediate international assistance is required, the international Network of 24-hour Points of Contact established by the High-tech Crime Subgroup of the G8 countries can provide assistance. This network, created in 1997, is comprised of approximately twenty-eight member countries, and continues to grow every year. (5) Participating countries have a dedicated computer crime expert and a means to contact that office or person twenty-four hours a day. See generally Michael A. Sussmann, The Critical Challenges from International High-Tech and Computer-Related Crime at the Millennium, 9 Duke J. Comp. & Int'l L. 451, 484 (1999). CCIPS is the point of contact for the United States and can be contacted at 202-514-1026 during regular business hours or at other times through the Department of Justice Command Center at 202-514-5000. The Council of Europe's Cybercrime Convention obligates all signatory countries to have a 24-hour point of contact for cybercrime cases, and international 24-hour response capabilities are therefore expected to continue to increase. In addition, CCIPS has high-tech law enforcement contacts in many countries that are not a part of the G8's network or the Council of Europe; agents and prosecutors should call CCIPS for assistance.
In the event that United States law enforcement inadvertently accesses a computer located in another country, CCIPS, OIA, or another appropriate authority should be consulted immediately, as issues such as sovereignty and comity may be implicated. Likewise, if exigencies such as terrorist threats raise the possibility of direct access of a computer located abroad by United States law enforcement, appropriate U.S. authorities should be consulted immediately.
Searching, seizing, or otherwise obtaining electronic evidence located outside of the United States can raise difficult questions of both law and policy. For example, the Fourth Amendment may apply under certain circumstances, but not under others. See generally, United States v. Verdugo-Urquidez, 494 U.S. 259 (1990) (considering the extent to which the Fourth Amendment applies to searches outside of the United States). This manual does not attempt to provide detailed guidance on how to resolve difficult international issues that may arise in cases involving electronic evidence located beyond our borders. Investigators and prosecutors should contact CCIPS or OIA for assistance in particular cases.

Carey, 172 F.3d 1268, 1273 (10th Cir. 1999 مثالا تنبيهيا عن التوجه التشددي. فيذكر في هذا الكتاب أن هناك متحري من الشرطة كان يفتش واحدة من مشغلي الأسطوانات بموجب أمر تفتيش باحثا عن دليل للاتجار بالمخدرات فقام بفتح ملف "jpg) وهو ملف صور وبدلا مما كان يبحث عنه وجد فيلما إباحيا للأطفال. وعند ذلك قضى المتحري خمس ساعات محاولا تحميل العديد من هذه المستندات وملفات الصور ليس بحثا عن دليل للاتجار في المخدرات وإنما كان قد تم تكليفه أن يبحث ويجمع معلومات مستخدما أمر التفتيش الأصلي ولكن عن الأفلام الإباحية الخاصة بالأطفال. وعندما قام المدعي عليه بمحاولة دحض دليل هذه الأفلام الإباحية بناء على أنه تم مصادرتها بدون أمر تفتيش صرحت الحكومة بأن المتحري قام بمصادرة هذه الملفات المصورة بشكل مناسب لأن محتواها الممنوع كان من أجل العرض المعتاد. واعترضت الدائرة العاشرة على هذا التصريح فيما يتعلق بجميع الملفات فيما عدا أول ملف كان المتحري قد اكتشفه . وبأفضل طريقة يمكن تمييزها يبدو أن القاعدة في قضيةCarey أنه يمكن للمتحري مصادرة أول ملف تم عرضه بشكل معتاد بينما كان هذا المتحري يقوم بتنفيذ أمر التفتيش ولكنه لا يمكن له أن يستند على استثناء العرض المعتاد ليبرر بحثه فقط عن أية ملفات صور إضافية تحتوي على إفلام إباحية للأطفال على الحاسب الآلي الخاص بالمدعى عليه، وهو ما يعتبر دليلا لا يتعلق بأمر التفتيش. وينص Cf. United States v.Walser, 275 F.3d 981, 986-87 (10th Cir. 2001) على أنه (لا يوجد أي انتهاك للتعديل الرابع حين يفتح متحري شرطة يملك أمر تفتيش عن تسجيلات إليكترونية متعلقة بصفقات اتجار في المخدرات أحد ملفات الحاسوب التي تحتوي على أفلام إباحية خاصة بالأطفال، فيوقف التفتيش، ويرجع إلى القاضي ليحصل على أمر تفتيش آخر يتعلق بالبحث عن مثل هذه الأفلام).
وتناقضا مع توجه الدائرة العاشرة في قضية Carey فإن المعتقد الذي تم توضيحه من قبل الدائرة العاشرة في قضية كل من Runyan وSlamina يشير على أن عرض محتوى أي ملف على الكمبيوتر أو على أي جهاز تخزين يمكن أن يصبح أساس أي بحث مكثف فيما بعد. في كلا هاتين القضيتين، صرحت المحكمة بأنه حين تتم عملية تفتيش لائقة بدون أمر تفتيش على جزء من أي كمبيوتر أو أي جهاز يقوم بتخزين بيانات أو معلومات فلا يملك المدعي عليه حينها أي توقعات بشأن المحافظة على خصوصيته فيما يتعلق ببقية اجزاء الجهاز، راجع قضيتي Runyan و Slamina. وبالتالي فإن أي تفتيش مكثف في أي جهاز تخزيني أو حاسب آلي لا ينتهك التعديل الرابع بموجب القانون. هذه الأسباب يمكن تطبيقها أيضا حين يوضع أحد الملفات ليتم عرضه بشكل عادي.
4- التفتيش في الحوادث من أجل توقيف المتهم بشكل قانوني
تبعا لقانون التوقيف، يجوز للوكلاء القيام "ببحث أو تفتيش كامل" للشخص الذي تم القبض عليه، ويتم تفتيش المنطقة المحيطة به بصورة أكثر تحديدا وذلك بدون أمر تفتيش. راجع قضية السيد روبنسون 414 U.S. 218, 235 (1973 والسيد Chimel Chimel v. California, 395 U.S. 752, 762-63 (1969).. ففي قضية روبنسون، على سبيل المثال، كان الشرطي يقوم بتفتيش ذاتي ليلقي القبض في جناية مرورية وقد اكتشف علبة سجائر مجعدة في الجيب الأيسر للمتهم. وقد فتح الشرطي العلبة وهو لا يعرف ما بداخلها ووجد أربعة عشر كبسولة من الهيروين، وقد حكمت المحكمة العليا بأن هذا التفتيش في داخل العلبة مسموحا به بالرغم من أن هذا الضابط لم يكن لديه أي سبب قابل للتأويل لفتح هذه العلبة. راجع id. At 234-35. وفي ضوء الحاجة العامة للبحث عن دلائل ومنع إلحاق أي أضرار بالشرطي الذي يقوم بإلقاء القبض على المتهمين فقد رأت المحكمة أنه من أجل هذا الأمر كان ينبغي على الشرطي أن يقوم "بتفتيش الشخص تفتيشا كاملا" تبعا لقانون إلقاء القبض بشكل قانوني. Id at 235.
وبسبب الاستخدام المتزايد للحواسيب المحمولة والأجهزة الأخرى القابلة لتخزين المعلومات بها، فغالبا ما يجد الضباط والمتحريين بعض أجهزة الكمبيوتر عندما يقومون ببعض أحداث التفتيش من أجل إلقاء القبض على المجرمين بصورة قانونية. كما يمكن أن يكون المشتبه فيهم يحملون أجهزة نداء آلي وهواتف محمولة وأدوات رقمية شخصية (مثل Palm Pilots) أو حتى أجهزة كمبيوتر محمولة حين يتم القبض عليهم. هل يسمح دفع التفتيش من أجل القبض على المتهمين لأي عميل بالدخول إلى الذاكرة التخزينية لأي جهاز إليكتروني يوجد مع أي شخص يتم القبض عليه أثناء القيام بالتفتيش بدون إذن؟ في حالة أجهزة النداء الآلي تكون الإجابة نعم بكل وضوح. وبناء على قضية روبنسون، سمحت المحاكم بإجماع لعملائها بالوصل على أجهزة النداء الآلي التي يحملها أي شخص يتم القبض عليه في وقت إلقاء القبض عليه. وفي قضية Reyes See United States v. Reyes, 922 F. Supp. 818, 833 (S.D.N.Y. 1996) ينص الحكم على أن (الدخول على الأرقام الموجودة بأجهزة النداء الآلي التي وجدت في حقيبة معلقة بالكرسي المدولب للمدعى عليه خلال 20 دقيقة من القبض عليه يقع ضمن دفع أحداث التفتيش لإلقاء القبض على المتهم) . كما أنه في القضايا التالية United States v. Chan, 830 F. Supp. 531, 535 (N.D. Cal. 1993); United States v. Lynch, 908 F. Supp. 284, 287 (D.V.I. 1995); Yu v. United States, 1997 WL 423070, at *2 (S.D.N.Y. Jul. 29, 1997); United States v. Thomas, 114 F.3d 403, 404 n.2 (3d Cir. 1997) (dicta). See also United States v. Ortiz, 84 F.3d 977, 984 (7th Cir. 1996) تم الحكم فيها بنفس الطريقة ولكن كان الاعتماد على نظرية الحاجة الماسة أو الضرورة).
ولم تناقش المحاكم حتى الآن سواء كان السيد روبنسون سيسمح بالتفتيش بدون إذن على أجهزة تخزين البيانات الاليكترونية التي تحتوي على معلومات أكثر مما يحتويها جهاز النداء الآلي. في العالم الورقي، تم السماح بتفتيش مكثف على الكثير من المواد المكتوبة في بعض القضايا وقد تم اكتشاف بعض الجرائم التي تؤدي للقبض على المجرمين. فعلى سبيل المثال استقرت جميع المحاكم على أنه يجوز للعملاء تفتيش جميع محتويات حافظة المشتبه به التي وجحدت معه أثناء القبض عليه. راجع هذه القضايا See, e.g., United States v. Castro, 596 F.2d 674, 676 (5th Cir. 1979); United States v. Molinaro, 877 F.2d 1341, 1347 (7th Cir. 1989) (citing cases. كما أن أحد المحاكم استقرت أيضا إلى أنه يمكن للعملاء تصوير نسخة من جميع محتويات دفتر العناوين الذي يوجد مع المشتبه به أثناء القبض عليه. راجع هذه القضايا United States v. Lam Muk Chiu, 522 F.2d 330, 332 (2d Cir. 1975).. إذا استطاع العميل تفتيش وفحص محتويات المحفظة ودفتر العناوين والحقيبة بدون إذن تفتيش فيمكن الجدل بأنه في استطاعتهم أيضا تفتيش أجهزتهم الاليكترونية (كالمنسقات الاليكترونية والأقراص المرنة و palm pilots) كما أنه في قضية . Cf. United v. Tank, 200 F.3d 627, 632 (9th Cir. 2000) قام العملاء بتفتيش سيارة وصادروا أثناء ذلك قرص مضغوط وجد داخلها ولكنهم فشلوا في مناقشة أمر ما إذا كان هؤلاء العملاء يملكون إذن تفتيش قبل البحث في هذا القرص عن أي صور إباحية للأطفال).
ولوضع حد لهذا الجدل يجب ان يكون أي حادث تفتيش متسما بالمشروعية حتى يتم إلقاء القبض على المتهمين بصورة قانونية. راجع Swain v. Spinney, 117 F.3d 1, 6 (1st Cir. 1997).. بينما يكون تفتيش بعض العناصر المادية التي تتواجد مع المتهم وقت إلقاء القبض عليه أمرا مشروعا ومعقولا فربما تنتهك بعض أحداث التفتيش التوسعية الأخرى في ظروف مختلفة التعديل الرابع. راجع Mary Beth G. v. City of Chicago, 723 F.2d 1263, 1269-71 (7th Cir. 1983) والذي ينص على أن السيد روبنسون لا يسمح بالتفتيش الذاتي لأن مثل هذا النوع من التفتيش ليس مشروعا على الإطلاق في هذا السياق). على سبيل المثال تشير سعة التخزين الزائدة على جهاز الكمبيوتر المحمول للسيد روبنسون إلى أن قاعدته لا يمكن تطبيقها دائما في حالة التفتيش الاليكتروني. عندما يكون هناك مجالا للشك، ينبغي ان يفكر العملاء في الحصول على إذن تفتيش قبل فحص محتويات أجهزة التخزين الاليكترونية والتي يمكن أن تحتوي على كم هائل من المعلومات.
5- تفتيش المخزون:-
يقوم ضباط تنفيذ القوانين بجرد العناصر التي قاموا بإلقاء القبض عليها بصورة روتينية ومثل هذا التفتيش يعتبر حدثا معقولا ومعتدلا ولذلك يقع تحت دفع المطالبة بالإذن. عندما يتم الوفاء بشرطين من الشروط وهما اولا ان هذا التفتيش يجب أن يخدم أغراض شرعية لا تتعلق بالتحريات (مثل حماية ملكية أحد الأشخاص الذين دخلوا السجن، أو ضمان عدم الإبلاغ عن فقدها أو سرقتها أو تخريبها أوح المطالبة بحراسة الشرطة لتجنب المخاطر). يتغلب ذلك على التدخل في الحقوق الشخصية الواردة في التعديل الرابع. راجع هذه القضايا Illinois v. Lafayette, 462 U.S. 640, 644 (1983); South Dakota v. Opperman, 428 U.S. 364, 369-70 (1976). Second, the search must follow standardized procedures. See Colorado v. Bertine, 479 U.S. 367, 374 n.6 (1987); Florida v. Wells, 495 U.S. 1, 4-5 (1990)..
ومن غير المحتمل أن يدعم دفع المطالبة بأمر تفتيش على العناصر المخزونة البحث في ملفات أي كمبيوتر تمت مصادرته. راجع قضية United States v. O'Razvi, 1998 WL 405048, at *6-7 (S.D.N.Y. July 17, 1998( مع ملاحظة الصعوبات في تطبيق متطلبات البحث في مخزون أقراص الكمبيوتر) راجع أيضا قضية United States v. Flores, 122 F. Supp. 2d 491, 493-95 (S.D.N.Y. 2000 والتي جاء فيه (وجد ان البحث في أجهزة الهواتف المحولة "بحثا متقصيا بحتا" وبالتالي لا يكون تفتيشا قانونيا للمخزون). حتى على افتراض أن الإجراءات المعيارية صرحت بهذا النوع من التفتيش فإن الأغراض الشرعي التي يخدمها التفتيش في المخزون في العالم المادي لا تتحقق جيدا في العالم الغير ملموس. لا تحتاج المعلومات بوجه عام لأن تراجع حتى تتم حمايتها، ولا يتضمن ذلك أي خطر مادي. على الرغم من أنه يمكن للمالك الإبلاغ عن أنه تم التعديل أو إزالة بعض ملفات الكمبيوتر الخاص به عندما كان مسجونا، فإن فحص محتوى الملفات سيقلل من فرض الحماية عليها من العبث بها. كما أن العملاء سيحتاجون بوجه عام للحصول على إذن تفتيش لفحص ملفات الكمبيوتر الذي تمت مصادرته في الحبس.
6- تفتيش الحدود
حتى تتم حماية مقدرة الحكومة على الرقابة على تهريب الممنوعات وأي ملكيات أخرى يمكن لها الدخول أو الخروج من الولايات المتحدة بشكل غير قانوني، أقرت المحكمة العليا دفعا خاصا بمتطلبات أمر التفتيش الذي يحدث على حدود الولايات المتحدة. طبقا للمحكمة فإن "أعمال التفتيش الروتينية" التي تتم على الحدود وما شابهها لا تتطلب إذنا بالتفتيش أو سببا أو حتى شك في ان هذا التفتيش لن يكشف عن عن أي ممنوعات أو أدلة على التهريب. راجع قضية United States v. Montoya De Hernandez, 473 U.S. 531, 538 (1985. أما أعمال التفتيش التي تكون ذات شكل تطفلي تتطلب على الأقل بعض الشك المشروع للقيام بها. تطبق هذه القواعد على أشخاص وملكيات تدخل أو تخرج من الولايات المتحدة .راجع United States v. Oriakhi, 57 F.3d 1290, 1297 (4th Cir. 1995).
في قضية واحدة على الأقل تناقشت المحاكم فيما إذا كان دفع تفتيش الحدود يسمح بتفتيش أقراص الكمبيوتر بدون إذن للكشف عن أي ملفات ممنوعة يتم تهريبها في قضية الولايات المتحدة ضد السيد روبرتUnited States v. Roberts, 86 F. Supp. 2d 678 (S.D. Tex. 2000), aff'd on other grounds, 274 F.3d 1007 (5th Cir. 2001), ،علم موظفو الجمارك بالولايات المتحدة أن السيد ويليام روبرت – وهو مشتبه به من المتوقع ان يكون معه بعض الصور على الكمبيوتر لأفلام إباحية للأطفال- تم رصد معلومات عن سفره من هيوستن في تكساس إلى باريس في يوم محدد.. في يوم السفر أقام الضباط منطقة تفتيش على الطريق السريع بمطار هيوستن بغرض تفتيش السيد روبرتس. وصل السيد روبرتس إلى منطقة التفتيش وقال له العملاء أنهم يبحثون عن أي عملات أو أدوات تكنولوجية متقدمة أو أي بيانات أخرى لا يتم تصديرها بشك قانوني. بعد أن قاموا بتفتيش المشتبه ب وجدوا كمبيوتر محمول وستة أقراص مضغوطة، وافق السيد روبرت على توقيع اتفاقية بموافقته على السماح لهؤلاء الأفراد بتفتيش أملاكه. وقد كشف هذا التفتيش عن الآلاف من الصور الإباحية للأطفال.
وقد اعترضت محكمة المقاطعة على تحركات المشتبه به لإخفاء دليل ملفات الكمبيوتر مصرحة بأن تفتيش أمتعة السيد روبرتس كان "تفتيشا روتينيا" لم يتوجب الشك فيه حتى بالرغم من أن المبررات التي قدمها العملاء للتفتيش لم تكن أكثر من مجرد حجة. راجع id. at 686, 688 (citing Whren v. United States, 517 U.S. 806 (1996)). كما انتهت المحكمة أيضا إلى أن موافقة السيد روبرتس على التفتيش كانت سببا في تفتيش الحاسب الآلي المحمول والأقراص وأشارت إلى أنه حتى إذا لم يوافق السيد روبرتس على التفتيش ،فإن تفتيش جهاز الكمبيوتر الخاص به والأقراص كن سيصبح تفتيشا روتينيا على الصادرات والذي يتم العمل به بموجب التعديل الرابع. وقد أكدت الدائرة الخامسة على رفض محكمة المقاطعة لإخفاء الدليل على أساس أن التفتيش المبدئي للطريق السريع لروبرتس كان مبررا بالشك العقول بان روبرتس كان يملك صورا إباحية للأطفال وأن التفتيش التالي ومصادرة جهاز الكمبيوتر كان مبررا بسببا محتملا . راجع ID AT 1010. لم تصل المحكمة إلى مسألة ما إذا كان يمكن اعتبار مصادرة جهاز الكمبيوتر الخاص بالسيد روبرتس أمرا روتينيا أم لا.
ومن المهم ألا يفهم الوكلاء والمدعين روبرت بأنه سمح باعتراض ووقف نقل البيانات الكترونيا من وإلى الولايات المتحدة.أي وقف فعلي لنقل بيانات اليكترونيا من وإلى الولايات المتحدة يجب أن بتماشي مع متطلبات Title III, 18 U.S.C. §§ 2510-2522, or the Pen/Trap statute, 18 U.S.C. §§ 3121-. راجع الفصل الرابع بوجه عام. كما أنه بمجرد وصول أي بيانات اليكترونيا من خارج الولايات المتحدة إلى مكان ما دال الولايات المتحدة فلا تستطيع الحكومة الاعتماد على التفتيش القائم على الحدود لتبحث عن البيانات وتقوم بمصادرتها لأن البيانات لم تعد موجودة على الحدود ولا حتى ما يشبهها وقد ورد في قضيةSanchez v. United States, 413 U.S. 266, 273-74 (1973) أن التفتيش الذي تم على بعد 25 ميلا من حدود الولايات المتحدة غير مؤهل لدفوع تفتيش الحدود - ى الرغم من أن التفتيش قد تم على طريق سريع معروف بأنه طريق شائع لمرور الغرباء بشكل غير قانوني- لأنه لم يتم على الحدود أو على ما يشبه الحدود.
7- شئون دولية:-
من المحتمل أن يتواجد الدليل الاليكتروني الضروري لمنع أي جريمة أو التحقيق فيها أو ملاحقتها قضائيا خارج حدود الولايات المتحدة ويمكن أن يحدث ذلك لعدة أسباب منها أن يستخدم المجرم شبكة الانترنت لارتكاب جريمة أو تسهيلها من بعد على سبيل المثال حين يقوم المتسللون الروسيون بسرقة أموال من أحد البنوك في نيويورك أو حين يقوم مختطف أمريكي بتوصيل مطالبه عبر البريد الاليكتروني ليفرج عن رهائنه. كما يمكن أن تتم الاتصالات بطريقة يمكن إخفاؤها أيضا من خلال دول العالم الثالث على سبيل المثال عندما يستخدم أحد المجرمين ببروكلين الانترنت ليقوم بمد خط اتصال خلال طوكيو وتل أبيب وجوهانسبرج قبل أن يصل الاتصال إلى مستلمه المعهود في مانهاتن- كما تتم عملية غسيل الأموال داخل عدة بنوك في دول مختلفة من أجل إخفاء مصدرها. بالإضافة إلى أنه يمكن للمهندس المقاول تخزين أو نقل بعض الاتصالات داخل الدولة التي يقيم فيها المورد أو المقاول بغض النظر عن موقع ستخدمي هذا الاتصال.
عندما تقوم سلطات الولايات المتحدة بالتحقيق في جريمة يعتقدون بأنه تم فيها تخزين دليل إليكتروني من جانب مزود خدمة انترنت أو تم تخزينها في كمبيوتر خارج البلاد (في الدولة أ)، فعادة ما يضطر القائمين على تنفيذ القانون بالولايات المتحدة لطلب المساعدة من سلطات تنفيذ القانون في الدولة أ. وبما أن المسئولين عن تنفيذ القوانين بوجه عام يمارسون مهامهم في دولة أخرى بموافقة هذه الدولة فيتوجب على سلطات تنفيذ القانون الأمريكية التواصل بشكل مباشر مع مقدم خدمة انترنت يكون متواجدا في الدولة أ ويكون حاملا ل (1) تصريح مسبق من الحكومة الأجنبية (2) موافقة من وزارة العدل قسم الشئون الدولية (الذي يكون على علم ببعض المواقف الحساسة ويوافق على ممارستها) أو (3) أي إشارة واضحة أخرى بأن هذه الممارسات لن يتم الاعتراض عليها في الدولة أ (ويكون هناك اتفاق عاما يتم بأن الوصول إلى جميع المواد العامة المتاحة في الدولة أ مسموحا به وبدون استشارة مسبقة، كأن يتم نشرها في بعض المواقع الاليكترونية العامة ويسمح للوصول إلى هذه المواد في الدولة أ بموافقة مالك أو المتكفل بهذه المواد).
في ظروف معينة تكون سلطات تنفيذ القانون قادرة على مشاركة نظيرتها في الولايات المتحدة في دليل الجريمة بشكل غير رسمي ومع هذا فإن إيجاد الموظف المسئول المناسب في الدولة أ والذي سيتم اكتشاف هذا التعاون من خلاله هو أمر علمي غير دقيق في أفضل الأحوال. ومن المناطق المحتملة التي يمكن أن يدخل عن طريقها أي شخص إلى سلطات تنفيذ القوانين الأجنبية (1) الخبير المفوض الذي يشارك في شبكة مجموعة الثمانية للتواصل الدولي بين الجرائم عالية التقنية (سيتم مناقشتها لاحقا) (2) الأشخاص الذين يتواصلون مع سلطات تنفيذ القانون والذين يبقي عليهم مكتب الشئون الدولية(3) المندوبين عن سلطات تنفيذ القانون الأمريكية المتواجدين في السفارة الأمريكية للدولة الأخرى (مثل عملاء مكتب التحقيقات الفيدرالي القانونيين وبعض وكلاء الخدمة السرية الأمريكية وخدمة الجمارك الأمريكية) و (4) مسئول الأمن المحلي ( من خدمة الأمن الدبلوماسي) في السفارة الأمريكية (الذين رما يكون لديهم بعض المعارف الجيدين بسلطات تنفيذ القوانين داخل الدولة). يمكن الوصول إلى مكتب الشئون الدولية عن طريق الاتصال ب 0000-514-202.
وفي الوقت الذي لا تستطيع فيه الدولة أ توفير المساعدات الغير رسمية فسيتم طلب الأدلة عادة بموجب اتفاقيات المساعدات القانونية المتبادلة القائمة (MLATs) أو بموجب معاهدات المساعدات القانونية المتبادلة أو من خلال تبادل الخطابات ما بين القضاة. راجع ص 28 من قانون الولايات المتحدة. هذه المطالب الرسمية يقوم بها مكتب الشئون الدولية وتطالب الهيئة المركزية المفوضة للدولة أ، أو في حالة عدم وجود معاهدات المساعدات القانونية المتبادلة بها السلطات المقابلة الأخرى (السلطات المركزية غالبا ما تتواجد داخل وزارة العدل أو في أي وزارة أو مكتب آخر تتواجد فيه سلطات تنفيذ القوانين. ويتمتع مكتب الشئون الدولية بعدد من المحامين المسئولين عن كل دولة ومنطقة في العالم، وبما أم المطالب الرسمية من هذا النوع تتطلب إجراءات ووثائق محددة وربما تستغرق بعض الوقت لمعرفة نتائجها. ينبغي على سلطات تنفيذ القوانين التواصل مع مكتب الشئون الدولية بأسرع ما يمكن حيث تكون الحاجة لمساعدة قانونية دولية في هذا الوقت ضرورة ملحة.
عندما يكون لدى سلطات تنفيذ القوانين الأمريكية سببا لتؤمن بأن الأدلة الاليكترونية تتواجد على حاسب آلي أو شبكة حواسيب خارج البلاد وتتوقع التأخر قبل أن يتم تأمين هذا الدليل في الدولة أ، فيجب مطالبة سلطات تنفيذ القوانين بالحصول على الدليل بأسر ما يمكن. هذا الطلب الشبيه بالطلب الموجود بموجب القانون الأمريكي رقم 18 &2703 بمزود خدمة أمريكية (راجع الفصل 3 G.1 ص 10) سيتمتع بدرجات مختلفة من النجاح بناء على عدة عناصر أهمها سواء كانت الدولة أ لديها قانون بحفظ البيانات وسواء كانت الولايات المتحدة لديها بعض الأفراد الكافيين المتصلين بسلطات تنفيذ القانون في الدولة أ لضمان التنفيذ الفوري للطلب. وقد ألزم مجلس اتفاقيات أوروبا للجرائم الشبيكة والذي انتهى عام 2001 جميع القضاة بأن يكون لديهم المقدرة على التأثير بالحصول على المطالب عبر الحدود ووفرة هذا الشكل الحاسم بالمساعدة ولذلك من المتوقع أن تزاد بصورة كبيرة في المستقبل.
ولضمان المحافظة على المطالب أو في وقت الطوارئ حين تكون المساعدة الدولية الفورية مطلوبة، فإن الشبكة الدولية لنقاط التواصل خلال 24 ساعة والتي قام على إنشائها المجموعة الفرعية للجريمة عالية التقنية لدول مجموعة الثمانية يمكنها أن تقدم المساعدة. هذه الشبكة التي تأسست عام 1997 تتكون من 28 دول أعضاء تقريبا ويزداد عدد هذه الدول سنويا. لكل دولة مشاركة في هذه المجموع خبير بجرائم الكمبيوتر ووسيلة للاتصال بمكتب هذا الشخص أو بالشخص نفسه أربع وعشرون ساعة يوميا. راجع Michael A. CCIPS هي نقطة الاتصال الأمريكية ويمكن الاتصال بها على الرقم 1026-514-202 خلال ساعات العمل المعتادة أو في أوقات أخرى من خلال مركز اتصالات وزارة العدل على الرقم 5000-514-202.كما تلزم لجنة اتفاقيات أوروبا للجريمة الشبكية جميع الدول الأعضاء بأن تكون على اتصال 24 ساعة من أجل حالات الجرائم التي تحدث عبر الشبكة الاليكترونية ولذلك فإن الاستجابة الدولية على مدار 24 ساعة متوقع لها ان تستمر في الزيادة. بالإضافة إلى أن مركز CCIPS لديه نقاط اتصال عالية التقنية بسلطات تنفيذ القوانين في عدد من الدول الغير مشاركة في مجموعة الثمانية أو في المجلس الأوروبي، وعلى جميع العملاء والمدعين الاتصال بمركز مكافحة جرائم الكمبيوتر وحقوق الملكية الفكرية CCIPS للحصول على المساعدة.
وفي حالة ما حاولت سلطات تنفيذ القوانين الأمريكية الوصول عن غير قصد إلى كمبيوتر موجود في دولة أخرى فيجب على الفور استشارة CCIPS أو مكتب الشئون الدولية أو أي هيئة معنية أخرى فربما تثار بعض القضايا مثل قضية السيادة أو مسألة المجاملة ،كما أنه إذا دعت الضرورة كما في حالة أي تهديد إرهابي إلى إمكانية الوصول إلى أحد أجهزة الكمبيوتر الموجود خارج البلاد من قبل سلطات تنفيذ القانون الأمريكية فينبغي على الفور استشارة السلطات الأمريكية المعنية.
إن البحث عن أدلة اليكترونية تتواجد خارج الولايات المتحدة أو مصادرتها أو الحصول عليها يمكن أن يثير مشاكل عصيبة من جانب كل من القانون والسياسة. فعلى سبيل المثال يجوز تطبيق التعديل الرابع الأمريكي في بعض الحالات ولا يجوز تطبيقه في حالات أخرى. راجع قضية United States v. Verdugo-Urquidez, 494 U.S. 259 (1990) والتي جاء فيها (أنه أخذا في الاعتبار الحالات التي يتم فيها تطبيق التعديل الرابع الأمريكي على عمليات البحث التي تتم خارج أمريكا). لا تحاول هذه الدراسة تقديم أي إرشادات تفصيلية حول كيفية حل القضايا الدولية الصعبة التي ربما تنشأ في بعض الحالات التي تتضمن وجود الأدلة الاليكترونية خارج حدود البلاد، ينبغي على المحققين والمدعين الاتصال CCIPS أم مكتب الشئون الدولية للحصول على المساعدة في حالات خاصة.

مشكلة البحث:
يحظى النشاط السياحي باهتمام كبير في الدول المتقدمة والنامية على حد سواء، حيث يوجد العديد من الأسباب التي جعلت النشاط السياحي أحد المكونات الرئيسية في خطط التنمية لتلك الدول، ومن أهم هذه الأسباب حدوث تحولات هيكلية طويلة الأجل في الطلب كان من نتائجها التوسع في الاقتصاد الخدمي، حيث توصلت الدراسات الاقتصادية إلي وجود علاقة طردية تربط بين تقدم أي مجتمع وبين حجم قطاع الخدمات ونصيبه النسبي من الناتج الوطني في المجتمع ( )، لذا فقد شهد هذا العصر تبوأ صناعة السياحة قمة جميع الصناعات، ويتضح ذلك بمتابعة تطور حركة السياحة الدولية خلال الفترة من 1950 إلى عام 1999، حيث ازداد عدد السائحين من 25.282 مليون سائح في عام 1950 إلي 656.9 مليون سائح في عام 1999. كما ارتفعت الإيرادات السياحية الدولية من2.1 مليار دولار في عام 1950الى 455 مليار دولار عام 1999 بمتوسط معدل نمو سنوي 12%.( )
ويظهر تطور صناعة السياحة من خلال تطور أنماطها والتي ترتبط بالعديد من الأنشطة التي تفرز تأثيرات مباشرة وغير مباشرة على اقتصاديات الدول التي تمتلك الموارد السياحية المختلفة. وتعتبر سياحة المؤتمرات Convention Travel مجالاً من مجالات سياحة الأعمال والتي تشمل أنشطة رئيسية تتمثل في الاستشارات والمؤتمرات ومتابعة الأعمال والتدريب, وأنشطة ثانوية تتمثل في التنزه والتسوق.( )
وتتضح أهمية سياحة المؤتمرات في العصر الحالي من خلال نمو قطاع الخدمات والاتجاه العالمي نحو حرية التجارة وبلورة مفهوم اقتصاديات السوق مما جعل سياحة المؤتمرات أحد أهم المجالات تأثيرا في نمو صناعة السياحة.( )
واكتسبت سياحة المؤتمرات أهميتها من خلال قدرتها على جذب المستويات المرتفعة من السائحين والذين يتميزون بارتفاع مستوى إنفاقهم نتيجة تحمل المنظمات التي يمثلونها لنفقات حضورهم المؤتمرات، وبالتالي تصبح الفرصة متاحة أمام سائحي المؤتمرات لزيادة إنفاقهم الشخص. وفي ذات الوقت يتميز سائحو المؤتمرات بارتفاع مستواهم الثقافي مما يمثل ترويجاً فعالاً للدول المنظمة للمؤتمرات في حالة نجاح هذه الدول في تقديم خدمة مرتفعة الجودة في هذا المجال. كما تؤثر سياحة المؤتمرات تأثيراً مباشراً على مستويات الإشغال أو العمالة في المنشات السياحية ومراكز المؤتمرات.( )
وفي ظل التوجه الجديد للمملكة العربية السعودية بشأن تنمية وتطوير منتجاتها السياحية انطلاقاً من الإمكانات المتعددة التي تتيح للمملكة أن تحتل مكانة متميزة في السوق السياحي على المستويين الإقليمي والدولي تتضح أهمية الدور الذي يمكن أن يمارسه نشاط سياحة المؤتمرات في تدعيم وتحفيز هذا التوجه.
وفي سبيل توضيح معالم هذا الدور يصبح من الأهمية استكشاف أهمية تنمية سياحة المؤتمرات في المملكة وإمكانيات المملكة الحالية والتي يمكن أن تضع نشاط سياحة المؤتمرات في دائرة اهتمام الجهات المنوطة بتنمية وتطوير صناعة السياحة في المملكة, وكذلك البحث في طبيعة المعوقات التي تواجه تنمية سياحة المؤتمرات في المملكة، ومن ثم البحث في كيفية تصميم استراتيجيات تسويقية تتيح إمكانية تقديم المملكة لمنتج متميز في مجال سياحة المؤتمرات.
أهمية البحث
تتضح أهمية البحث فيما يلي :
1- يعتبر نشاط سياحة المؤتمرات أحد الأنماط السياحية المتميزة التي تشكل منظومة مدعمة ومؤثرة في تنمية صناعة السياحة. لذلك، فتتضح أهمية تناول هذا النمط السياحي بالدراسة والتحليل لبيان كيفية تنمية وتطوير مكونات هذا النشاط في سبيل الحصول على مخرجات تسهم بشكل فعال في تنمية صناعة السياحة ومن ثم الاقتصاد الوطني في المملكة.
2- يركز هذا البحث على دراسة وتحليل نمط سياحي محدد مما يتيح الفرصة لتحقيق درجة مرتفعة من التعمق في دراسة مكونات هذا النمط وكيفية تنميته، وذلك انطلاقاً من إدراك أن الأنماط السياحية ليست متشابهة وأن لكل نمط سياحي مدخلاته وأنشطته ومخرجاته التي تميزه عن الأنماط السياحية الأخرى.
3- تمثل مخرجات هذا البحث أهمية كبيرة للجهات الرسمية التي تتولى إدارة النشاط السياحي في المملكة، بما يوفره لها من استراتيجيات شاملة تسهم في تفعيل الدور المتوقع لنشاط سياحة المؤتمرات في تنمية صناعة السياحة ومن ثم الاقتصاد الوطني في المملكة.
4- تمثل مخرجات هذا البحث أهمية ملحوظة للمنشات المشاركة في نشاط تسويق وتنظيم المؤتمرات (الفنادق الكبرى، الوكالات السياحية الكبرى، مراكز المؤتمرات)، حيث يضع أمامها رؤية شاملة لهذا النشاط. كما يتيح لها الاستفادة من تجارب منشات مماثلة في دول حققت تقدماً في هذا المجال.
5- يمثل هذا البحث أهمية ملحوظة للباحثين في علم السياحة بوجه عام، وسياحة المؤتمرات بوجه خاص، حيث يوفر إطارا من البيانات والمعلومات تتيح لهم إمكانية توليد أفكار بحثية جديدة أو تطوير مشروعات بحثية قائمة.
أهداف البحث:
يهدف هذا البحث إلي اقتراح مجموعة من الاستراتيجيات التسويقية التي تسهم في تنمية سياحة المؤتمرات في المملكة, ويتحقق هذا الهدف من خلال تحقيق الأهداف الفرعية التالية :

2- استكشاف الإمكانيات والمقومات التي تمتلكها المملكة في مجال سياحة المؤتمرات.

4- تصميم الاستراتيجيات التسويقية الملائمة لمواجهة المعوقات وتطوير الإمكانات.

4- ما هي طبيعة المعوقات المحتمل أن تواجه تنمية سياحة المؤتمرات في المملكة ؟
5- ما هي الاستراتيجيات التسويقية المطلوبة لتنمية سياحة المؤتمرات في المملكة؟
منهج البحث:
يسعى هذا البحث لتحقيق الهدف الرئيسي من خلال إتباع منهج وصفي تحليلي يقوم على تجميع البيانات من خلال إجراء دراسة مكتبية بهدف توفير البيانات والمعلومات اللازمة لإتمام الدراسة، وذلك من خلال الكتب والدوريات والأبحاث والرسائل العلمية المنشورة وغير المنشورة ذات الصلة بموضوع البحث. وتتمثل البيانات والمعلومات المطلوب تجميعها فيما يلي :
1. مفهوم سياحة المؤتمرات وأهميتها
2. كيفية تسويق سياحة المؤتمرات
3. أهمية تنمية نشاط سياحة المؤتمرات في المملكة.

الإطار النظري:
المبحث الأول: سياحة المؤتمرات: المفهوم؛ الأهمية؛ المتطلبات.
بدأ نشاط عقد المؤتمرات في منتصف القرن الثامن عشر، وكان هذا النشاط مقتصراً على عدد قليل من الجمعيات الثقافية بغرض تبادل المعلومات ووضع السياسات واتخاذ القرارات، ثم ازداد الاهتمام بهذا النشاط وتم تأسيس أول مكتب للمؤتمرات في مدينة ديترويت بولاية ميتشيجن الأمريكية عام 1896 وتبعها إنشاء عدة مكاتب في مدن أمريكية أخرى، ونشطت حركة سياحة المؤتمرات عقب الحرب العالمية الثانية نتيجة لتقدم وسائل المواصلات وظهور وسائل الاتصال الحديثة، وفي السبعينات تم تأسيس عدد كبير من هيئات المؤتمرات في الدول الأوروبية والآسيوية مثل ألمانيا وايطاليا وهونج كونج وسنغافورة. وفي فترة الثمانينات والتسعينات زاد الاهتمام بنشاط سياحة المؤتمرات بعدما أدركت الدول المتقدمة والنامية على حد سواء الفوائد المتعددة التي يفرزها هذا النشاط.
وتتطلب سياحة المؤتمرات لكي تمثل عنصر جذب لأي دولة تسعى إلى تنمية هذا النشاط إلى توافر التسهيلات والإمكانيات اللازمة لتحقيق الفاعلية في تسويق سياحة المؤتمرات وتعظيم عوائدها.
نتناول في هذا الجزء مفهوم سياحة المؤتمرات وعلاقتها بسياحة الأعمال ومدى الأهمية الاقتصادية والاجتماعية والثقافية لنشاط سياحة المؤتمرات، ونعرض الإمكانيات والقدرات اللازم توافرها لمزاولة هذا النشاط
1. مفهوم سياحة المؤتمرات وعلاقتها بسياحة الأعمال:
سياحة المؤتمرات هي نمط سياحي حديث يعتمد بصفة أساسية على حدث رئيسي هو المؤتمر أو الاجتماع، ذلك الحدث يتم من خلاله تسويق أنشطة أخرى مصاحبة (سياحية وترفيهية).
وتعتبر سياحة المؤتمرات مجالاً من مجالات سياحة الأعمال Business Travel. وتتعلق سياحة الأعمال بالأشخاص الذين يسافرون لتحقيق أغراض تتعلق بعملهم لذا فهي تعتبر أقدم أشكال السياحة حيث يسافر الناس بغرض العمل والتجارة منذ زمن بعيد. وتشكلت أهمية سياحة العمال في العصر الحالي من خلال نمو قطاع الخدمات والذي يسهم بنحو (75 %) من الناتج المحلي الإجمالي في عدة دول متقدمة (الولايات المتحدة الأمريكية، اليابان، بريطانيا، ألمانيا، فرنسا، ايطاليا) ولقد كان للاتجاه العالمي نحو حرية التجارة وبلورة مفهوم اقتصاديات السوق دوراً واضحاً في جعل سياحة الأعمال أحد أهم الأنماط السياحية المؤثرة في نمو صناعة السياحة.
وتشتمل سياحة الأعمال على العديد من الأنشطة أهمها ما يلي:
- الاجتماعات والمؤتمرات: هو نشاط يرتكز على التقاء مجموعة من الأشخاص لمناقشة موضوع محل اهتمام، وهذا اللقاء قد يحضره ستة أشخاص وقد يحضره مئات الأشخاص، وقد يستغرق عدة ساعات وقد يمتد إلى أسبوع، وقد يكون الاجتماع أو المؤتمر تجاري أو طبي أو اجتماعي..الخ. وكما ذكر من قبل فان هناك عدة أنشطة ترفيهية وسياحية تتزامن مع عقد الاجتماع أو المؤتمر وهو ما يشكل نمط سياحة المؤتمرات.
- المعارض: وهي أحداث يتم تنظيمها بهدف عرض وتقديم منتجات وخدمات معينة على جمهور من العملاء المستهدفين، والمعارض تعتبر جزء من سياحة الأعمال لأنها تشتمل على طلب لخدمات سياحية تتمثل في الإقامة والانتقال
- برامج التدريب: وهي تمثل يشارك فيها أشخاص يسعون إلى تنمية معارفهم ومهاراتهم في مجالات عملهم أو اهتماماتهم، وقد يكون التدريب داخلي بمعنى أنه يوجه للعاملين في شركة أو جهة ما على وجه التحديد، أو تدريب مفتوح موجه لكل من يشعر بأنه يمكن أن يستفيد منه
- سياحة الحوافز: وهي أداة إدارية تستخدم لتحفيز الموظفين والمديرين على تطوير أدائهم ومخرجاتهم، حيث يتم تنظيم رحلات سياحية مجانية للموظفين والمديرين تقديراً لانجازاتهم.
ويعتبر نمط سياحة المؤتمرات هو أحد أهم الأنماط السياحية التي تندرج تحت مفهوم سياحة الأعمال، حيث تشكل سياحة المؤتمرات نسبة 1% من إجمالي السياحة الدولية، كما أن واحد من كل خمسة من سائحي الأعمال يحضر مؤتمر أو اجتماع أو ندوة خارج حدود دولته.
2. الأهمية الاقتصادية لسياحة المؤتمرات:
تسعى الكثير من الدول والمناطق والمدن إلى تنمية نشاط سياحة المؤتمرات بهدف تحقيق الاستفادة من التأثيرات الاقتصادية المتعددة لهذا النشاط. وبالأساس فان سياحة المؤتمرات تكتسب أهميتها الاقتصادية من خلال ارتفاع معدل إنفاق سائح المؤتمر مقارنة بإنفاق السائح في الأنماط السياحية الأخرى ، وذلك يرجع إلى أن تكاليف الإقامة ورسوم الاشتراك في المؤتمر تتحملها الجهة التي يمثلها سائح المؤتمر، ومن ثم تكون الفرصة متاحة لدى سائح المؤتمرات كي يضاعف إنفاقه الشخصي في أوجه متعددة مثل التنزه والتسوق. ووفقاً للإحصائيات العالمية حول حركة السياحة الدولية في الفترة من عام 1983 إلى عام 1993، وبناءاً على التقديرات الموضوعة للإيرادات السياحية ولأوجه إنفاق السائح، فان سياحة المؤتمرات تأتي في المرتبة الثانية من حيث متوسط إنفاق السائح في اليوم الواحد بعد السياحة العلاجية.
ويتراوح إنفاق سائح المؤتمر ما بين 525 دولار إلى نحو 970 دولار، ينفقها في فترة إقامة تصل إلى 3،8 يوم، كما أوضحت الدراسات التي أعدتها الهيئة الدولية للمؤتمرات ومكاتب الزوار (I.C.V.B) أن كل 2000 دولار تنفق في المؤتمر تولد فرصة عمل.
كما أن سياحة المؤتمرات تسهم في خلق صورة ايجابية متحضرة للمدن التي تمتلك مراكز مؤتمرات، وهذا جعل بعض المدن يعتمد اقتصادها بالكامل على سياحة المؤتمرات مثل (أتلانتا، برمنجهام، بوسطن، سنغافورة)، وفيما يلي نعرض بالتفصيل التأثيرات الاقتصادية المباشرة وغير المباشرة لسياحة المؤتمرات:
أولاً: التأثيرات الاقتصادية المباشرة:
أ. تأثيرها سياحة المؤتمرات على ميزان المدفوعات: يتكون ميزان المدفوعات من ميزان المعاملات الجارية والميزان الرأسمالي، ويعد الميزان السياحي جزءاً من ميزان المعاملات الجارية، لذلك فان رصيد الميزان السياحي يؤثر على ميزان المعاملات الجارية سواء كانت سلباً أو إيجابا، فإذا كان رصيد الميزان السياحي موجباً فانه يعوض الرصيد السالب لميزان المعاملات الجارية أو يزيد من الرصيد الموجب له، والعكس إذا كان هذا الرصيد سالباً. وهذا يوضح الدور الهام الذي يمكن أن تمارسه سياحة المؤتمرات في زيادة رصيد الميزان السياحي ( في عام 1994 وفي الولايات المتحدة الأمريكية قدرت إيرادات صناعة المؤتمرات بنحو 83 بليون دولار)
ب. تأثير سياحة المؤتمرات على العمالة: تؤثر سياحة المؤتمرات على خلق فرص العمل وتخفيض معدلات البطالة، وذلك لأن صناعة السياحة بصفة عامة صناعة مركبة تؤثر وتتأثر بالعديد من الصناعات الأخرى، وفي ذات الوقت فهي صناعة كثيفة العمالة سواء كانت هذه العمال مباشرة تعمل في القطاع السياحي ذاته (مراكز المؤتمرات، الفنادق، الشركات السياحية) أو غير مباشرة تعمل في قطاعات أخرى مثل المراكز التجارية والنقل والمواصلات والاتصالات( في بريطانيا وتحديداً في مدينة برمنجهام بلغ عدد سائحي المؤتمرات في عام 1993 نحو 4،5 مليون زائر من داخل بريطانيا وخارجها، أنفقوا 430 مليون دولار تسببت في خلق 16800 فرصة عمل)
ثانياً: التأثيرات الاقتصادية غير المباشرة:
أ. لا تقتصر الآثار الاقتصادية للدخل المحقق من سياحة المؤتمرات على الإيرادات المحددة به فقط، ولكن يظهر أثر المضاعف في دوران الإيرادات المحققة في حركة الاقتصاد القومي دورات متعددة يكون أثرها اكبر من المبلغ الأصلي، ويقدر بعض الخبراء أن أثر المضاعف لسياحة المؤتمرات يتراوح من (3 إلى 5) مما يعني فوائد اقتصادية عظيمة للدول التي تهتم بتنمية هذا النشاط
ب. عادة ما يحتفظ السائحون بجزء من ميزانياتهم للإنفاق على التسوق وشراء المنتجات الوطنية في الدولة المضيفة، ويمثل هذا شكلاً من أشكال التصدير دون الحاجة إلى شحن وتسويق خارجي، ويظهر هذا العامل بوضوح في سياحة المؤتمرات، حيث ترتفع معدلات إنفاق سائحي المؤتمرات وبالتالي يساهمون بفاعلية في ترويج بعض السلع.
ت. تسهم سياحة المؤتمرات في خلق صورة ايجابية متحضرة للمدن التي تمتلك مراكز مؤتمرات، وهذا جعل بعض المدن يعتمد اقتصادها بالكامل على سياحة المؤتمرات مثل (أتلانتا، برمنجهام، بوسطن، سنغافورة)
ث. عادة ما تعقد المؤتمرات بعيداً عن مواسم الذروة السياحية، وهذا يتيح الفرصة لتفادي الآثار السلبية الناشئة عن ظاهرة موسمية السياحة.
3. الأهمية الاجتماعية والثقافية:
سياحة المؤتمرات شأنها شأن السياحة الترفيهية أو الثقافية لها تأثير مباشر على البيئة المادية، فسياحة المؤتمرات تشجع على بناء المزيد من الفنادق ومراكز المؤتمرات في المناطق والمدن المختلفة وهذا بالطبع يؤثر على ظهور منشآت جديدة في المجتمع، كما أن الرغبة في اجتذاب سائحي المؤتمرات وإشباع احتياجاتهم يشجع الجهات الرسمية على تطوير أدائها في مجال تعمير المدن ونظافتها وإمدادها بالخدمات المتطورة وهو ما ينعكس إيجابا على ارتفاع مستوى المعيشة. كما أن سياحة المؤتمرات تخلق حالة من الزخم الثقافي والمعرفي في المجالات المختلفة، فالمؤتمرات في حد ذاتها تمثل مصدر لتنمية الوعي في المجتمع خاصة إذا تم الاهتمام بها إعلاميا، كذلك تسهم سياحة المؤتمرات بشكل مباشر في رفع مستوى المعيشة في المناطق التي تستقبل سائحي المؤتمرات من خلال تطوير المنشآت والخدمات في هذه المناطق.
المبحث الثاني: تسويق سياحة المؤتمرات:
على اعتبار أن هذا العصر هو عصر المؤتمرات بأنواعها المختلفة (علمية، طبية، سياسية، اقتصادية،..الخ) على المستويين الإقليمي والدولي، فقد اهتمت العديد من الدول المتقدمة والنامية على حد سواء بالتسويق السياحي للمؤتمرات، فهذه الدول تسعى إلى إبراز مواردها وإمكانياتها في مجال عقد المؤتمرات وتفعيل اتصالاتها مع الشركات السياحية العالمية ومنظمي المؤتمرات والجهات المهتمة بعقد المؤتمرات. ونظراً لأن سياحة المؤتمرات هي نمط سياحي متميز وذو طبيعة خاصة نجد أن التسويق لسياحة المؤتمرات يختلف عن التسويق السياحي بوجه عام، هذا الاختلاف يتضح في عدة أوجه:

ب. يتميز سائحو المؤتمرات بمعدلات إنفاقهم المرتفعة، نظراً لأن الجهات والمنظمات التي يمثلونها تتولى دفع نفقات رسوم اشتراكهم في المؤتمر وتكاليف الإقامة، ولذلك فان الفرصة تكون متاحة أمام سائح المؤتمر لزيادة إنفاقه على المشتريات ووسائل الترفيه، بينما يسعى السائح العادي أغلب الأحيان إلى الاقتصاد في نفقاته.
ج. يتم تسويق سياحة المؤتمرات من خلال الاتصال بهيئات وشركات واتحادات سياحية متعددة، ومن ثم فان قرار اختيار مكان عقد المؤتمر هو قرار متشابك وتتدخل فيه العديد من العوامل، وهذا يجعل تسويق سياحة المؤتمرات أكثر صعوبة مقارنة بتسويق الأنماط السياحية الأخرى، وهذا يفرض أهمية ممارسة جهود مكثفة ومتنوعة في مجال سياحة المؤتمرات، وستتضح فيما بعد طبيعة هذه الجهود والجهات المسئولة عن النهوض بها.

المنتج في سياحة المؤتمرات عبارة عن خبرة كاملة يحصل عليها سائحو المؤتمرات من خلال التفاعل مع العناصر التالية:أماكن إقامة(موقع، تسهيلات وخدمات)، أماكن تنظيم مؤتمرات(حجم، موقع، تسهيلات)، بلد المقصد(خدمات مساعدة وبنية أساسية، أماكن ترفيه، مناخ ملائم)، انتقالات( سهولة الوصول والانتقالات في المطارات، الموانئ بحرية، المواصلات داخلية)، شركات(موردي الخدمات، وسطاء)، خدمات ما بعد البيع (إحصائيات وتقارير بعد انتهاء المؤتمرات، متابعة إنهاء إجراءات، التأكد من إشباع الاحتياجات،...الخ). ومن ثم فان خبرة سائحي المؤتمرات تتشكل بالتفاعل مع هذه العناصر في ثلاثة مراحل، المرحلة الأولى تتعلق بإجراءات المشاركة في المؤتمر وهي مرحلة تسبق الحدث، المرحلة الثانية تتزامن مع الحدث(تنظيم المؤتمر) وهي مرحلة استهلاك الخدمات، المرحلة الثالثة بعد انتهاء الحدث وتتعلق بالانطباعات التي تبقى في ذاكرة السائحين.
وفي سبيل تنمية وتطوير المنتج في سياحة المؤتمرات يجب دراسة وتحليل ما يلي:
الطلب الحالي والمتوقع على سياحة المؤتمرات في الدولة
التسهيلات والإمكانيات التي تمتلكها الدولة في مجال سياحة المؤتمرات وترغب في تسويقها
المغريات السياحية التي تمتلكها الدولة
طبيعة الصورة الذهنية للدولة كمقصد لسياحة المؤتمرات
الاتجاهات السائدة في الدول المتقدمة في مجال سياحة المؤتمرات
ب. التسعير:

الجانب الأول: يتعلق بتسعير المؤتمر ذاته ويعتمد ذلك على تكلفة تنظيم المؤتمر والتي تتنوع ما بين تكاليف ثابتة يتم تحملها بغض النظر عن عدد الحاضرين الفعليين في المؤتمر ( إيجار مكان تنظيم المؤتمر وتجهيزاته، أجور المتحدثين، تكاليف الترويج للمؤتمر، الوسائل السمعية والبصرية). وتكاليف متغيرة تتحدد بناءاً على عدد الحاضرين الفعليين للمؤتمر (الإقامة، الترفيه، الانتقالات). ويتم تقدير عدد المشاركين الذي يصل إلى نقطة التعادل وتشير إلى عدد المؤتمرين المطلوب مشاركتهم لتغطية التكاليف الثابتة والمتغيرة وما يزيد عن ذلك العدد يمثل ربح المنظم وما يقل عنه يمثل خسارة وعدم تغطية تكاليف تسويق وتنظيم المؤتمر.
الجانب الثاني: يتعلق بتسعير الخدمة المتكاملة ( تنظيم المؤتمر بالإضافة إلى الرحلات السياحية والترفيهية المصاحبة له. والسعر المناسب هنا هو السعر الذي يجذب اكبر عدد من المنظمات والهيئات المهتمة بعقد المؤتمرات.
ج. التوزيع:

د. الترويج:

المبحث الثالث: مقومات ومعوقات تنمية نشاط سياحة المؤتمرات في المملكة:
في تقرير المجلس العالمي للسياحة (World Travel &Tourism Council, 2003)( ) الذي تناول تطور النشاط السياحي في المملكة، أوضح التقرير أن النشاط السياحي في المملكة من المتوقع أن يولد إيرادات قدرها 76.5 بليون ريال سعودي في عام 2003ومن المتوقع إن يرتفع هذا الرقم إلى 138.1 بليون ريال في عام 2013، كما إن الطلب السياحي من المتوقع أن ينمو بنسبة 4.9% في خلال الفترة بين عام 2003 و 2013، وتبلغ الاستثمارات السياحية في المملكة 12.3 بليون ريال سعودي في عام 2003 ومن المتوقع أن تصل في عام 2013 إلى 23.1 بليون ريال سعودي.
كما يشير التقرير في جزء هام إلى مدى قدرة صناعة السياحة في المملكة على المنافسة، من خلال قياس عدة عناصر مؤثرة في تنافسية صناعة السياحة، وقد أوضح التقرير أن العنصر الأكثر تنافسية هو توافر البنية التحتية الملائمة لتنمية النشاط السياحي، العنصر الذي يليه هو أسعار الخدمات السياحية، في حين احتلت عناصر أخرى مراتب متأخرة بما يشير إلى أنها تعوق تنمية النشاط السياحي في المملكة وتتمثل هذه العناصر في الموارد البشرية المؤهلة ودرجة الانفتاحية على العالم الخارجي ومستوى التكنولوجيا المستخدم في المنشآت السياحية.
وما ورد في التقرير يتفق مع توجهات المملكة في مجال تطوير صناعة السياحة بأنماطها المختلفة، حيث تدرك الجهات المسئولة عن تنمية قطاع السياحة في المملكة أن صناعة السياحة تستطيع أن تسهم بشكل فاعل في تحقيق أهداف التنمية الاقتصادية نتيجة للآثار الإيجابية التي تفرزها صناعة السياحة، والمتمثلة في تنويع مصادر الناتج الوطني، وتحسين ميزان المدفوعات، وتأثير السياحة على التنمية الاقتصادية الإقليمية، وزيادة الفرص الاستثمارية للقطاع الخاص، وإتاحة فرص جديدة للعمل ( )
وتشكل سياحة المؤتمرات أحد أهم الأنماط السياحية التي يمكن الاستفادة من مخرجاتها في تطوير صناعة السياحة بالمملكة ومن ثم تحقيق أهداف التنمية الاقتصادية المنشودة، وهناك مبررات واضحة تؤكد على أهمية تنمية هذا النمط السياحي في هذه المرحلة على وجه التحديد:
أ. تسعى الأجهزة الرسمية إلى النهوض بقطاع السياحة بوجه عام، وهذا يتطلب في حد ذاته بناء وتفعيل رؤية شاملة تستهدف استثمار وتنمية كافة الموارد السياحية للمملكة، وفي مجال المؤتمرات تمتلك المملكة العديد من المقومات (سيرد ذكرها لاحقاً) التي تؤهلها للحصول على مكانة متميزة في هذا المجال
ب. تتناسب طبيعة سياحة المؤتمرات مع الطبيعة الخاصة للمجتمع السعودي، فهي نمط سياحي يتسم إلى حد كبير بمراعاة القواعد الأخلاقية في المجتمعات المستضيفة لسياحة المؤتمرات
ج. ينبغي الاستفادة من المنافع المتعددة التي تفرزها سياحة المؤتمرات سواء فيما يتعلق بخلق فرص عمل جديدة وتنمية موارد الدخل القومي وتطوير البنية الأساسية وخلق وعي معرفي وثقافي في المجتمع وبناء صورة ذهنية متميزة للمجتمع السعودي باعتباره مجتمع يحض على قيم الثقافة وتبادل المعرفة
أولاً: مقومات تنمية نشاط سياحة المؤتمرات في المملكة:
تتنوع المقومات اللازمة لتنمية نشاط سياحة المؤتمرات مابين مقومات رئيسية ترتبط بتهيئة العناصر اللازمة لممارسة النشاط وعناصر مساعدة أو مدعمة لنمو هذا النشاط، فيما يلي نعرض المقومات الرئيسية والمعدمة لتنمية نشاط سياحة المؤتمرات في المملكة:
أ. تبلغ مجمل مساحة أراضي المعارض في المملكة حوالي 29 ألف م2، ومجمل مساحة مرافق المؤتمرات والاجتماعات حوالي 61 ألف م2. ويتوافر في المملكة عدد من مرافق المعارض ومراكز المؤتمرات، وهي بشكل عام مرافق عصرية وجيدة التجهيز معدة لاستضافة المؤتمرات والمعارض العالمية. كما أن هناك العديد من مرافق الاجتماعات التي يمكنها استضافة ما يزيد على 1000 شخص في آن واحد. وهناك ثلاثة أنواع رئيسية من هذه المرافق بالمملكة هي: مراكز المعارض، ومراكز مخصصة للمؤتمرات، ومرافق الاجتماعات الملحقة بالفنادق. ويتراوح معدل الاستخدام لهذه المنشآت بين (25% و40%)، حيث تحقق كل من الرياض وأبها أكبر معدلات الاستثمار لهذه المرافق. وبالتالي فهناك مجال للتوسع في هذه الشريحة من السوق. وتتركز سياحة الأعمال في المدن الكبرى حيث توجد معظم مراكز الأعمال التجارية، وقد طورت كل من هذه المدن المرافق والخدمات اللازمة لاستضافة هذه الشريحة من السياحة، حيث يتوافر ما يزيد على 7 آلاف غرفة فندقية في الرياض، وحوالي 16 ألف غرفة في جدة، وألفا غرفة تقريباً في كل من الدمام والخبر. وفي كل من الرياض وجدة مركز للمعارض (مركز الرياض للمعارض، ومركز جدة الدولي للمعارض). وفي مدينة الرياض يوفر فندق إنتركونتننتال مساحة قدرها 2405م2، ومركز الفيصلية للمؤتمرات مساحة قدرها 5200م2 مخصصة لاستضافة المؤتمرات.
ب. تطور البنية الأساسية: تمتلك المملكة بنية أساسية متطورة تتمثل في توافر شبكات الطرق والجسور والموانئ والمطارات والاتصالات، وتعد شبكة الهاتف والنقل والكهرباء والمياه من أفضل الشبكات المتوافرة بمنطقة الخليج والشرق الأوسط.
ج. وجود الأماكن المقدسة والتي تعطي للملكة صورة ذهنية خاصة وفريدة تميزها عن سائر دول العالم، فالمدينة المنورة ومكة المكرمة هي وجهة المسلمين في جميع أنحاء العالم الذي يترقبون بشغف زيارتها دائماً، وهذا يضفي بعد خاص للملكة كمقصد لسياحة المؤتمرات، ومن ثم فان المنتج المتوقع أن تقدمه المملكة في مجال سياحة المؤتمرات سيمتلك ميزة تنافسية فريدة من خلال تمكين أعضاء وفود المؤتمرات من زيارة الأماكن المقدسة، أو من خلال تهيئة تلك المدن لتكون من المدن الجاذبة لسياحة المؤتمرات.
د. الاستقرار السياسي والأمني: حيث تتمتع المملكة باستقرار سياسي وأمني مشهود وهذا يشجع على توافد السائحين من الخارج والذين يلقون تأميناً كاملاً ورعاية على كافة المستويات.
ه. توافر المنتجعات والأماكن السياحية التي تشكل عامل جذب لسياحة المؤتمرات حيث تتاح الفرصة لسائحي المؤتمرات كي يقوموا برحلات ترفيهية في أثناء انعقاد المؤتمرات أو ما بعد انتهائها.
و. وجود الأماكن المقدسة والتي تعطي للملكة صورة ذهنية خاصة وفريدة تميزها عن سائر دول العالم، فالمدينة المنورة ومكة المكرمة هي وجهة المسلمين في جميع أنحاء العالم الذي يترقبون بشغف زيارتها دائماً، وهذا يضفي بعد خاص للملكة كمقصد لسياحة المؤتمرات، ومن ثم فان المنتج المتوقع أن تقدمه المملكة في مجال سياحة المؤتمرات سيمتلك ميزة تنافسية فريدة من خلال تمكين أعضاء وفود المؤتمرات من زيارة الأماكن المقدسة، أو من خلال تهيئة تلك المدن لتكون من المدن الجاذبة لسياحة المؤتمرات.
والعرض السابق يوضح ان المملكة تمتلك القاعدة التي تستطيع أن تنطلق منها نحو تنمية نشاط سياحة المؤتمرات، وان كانت هناك حاجة ماسة لتنمية وتطوير هذا القطاع في مختلف المحاور.
ثانياً: معوقات تنمية نشاط سياحة المؤتمرات في المملكة:
تتشكل المعوقات التي تؤثر سلباً على توجهات المملكة في مجال تنمية سياحة المؤتمرات من نفس المصادر التي تتشكل منها المعوقات التي تواجه تنمية صناعة السياحة بشكل عام، وهي كما يلي:
1. عدم توافر العدد الكافي من مراكز وقاعات المؤتمرات المجهزة لاستقبال وفود المؤتمرات، فعلى الرغم من وجود عدة مراكز مجهزة إلا أنها تعتبر غير كافية لتحقيق التطور المأمول في هذا النشاط، خاصة أن المراكز الموجودة حالياً تتركز بصفة أساسية في مدينة الرياض.
2. وجود صعوبات ملحوظة لحصول الوافدين من رجال أعمال وسائحين على تأشيرات دخول للمملكة، ودائماً يطبق على جميع الوافدين نفس الإجراءات في الحصول على التأشيرات، وهذا يتسبب في التأثير السلبي للصورة الذهنية للمملكة كمقص لسياحة المؤتمرات مع وضع في الاعتبار التسهيلات التي تقدمها الدول المنافسة في المنطقة لسائحي الأعمال والمؤتمرات.
3. عدم تقديم التسهيلات الجمركية اللازمة لوفود المؤتمرات، فكثير من الأجهزة والأدوات يتم مصادرتها في الجمارك أو إدخالها برسوم مرتفعة، وسياحة المؤتمرات والمعارض هي سياحة تعتمد بشكل كبير على الأجهزة والمعدات والأدوات المختلفة.
4. عدم وجود شركات مؤهلة ومتخصصة في مجال تسويق وتنظيم سياحة المؤتمرات، فالشركات السياحية الحالية تقتصر خبرتها فقط على مجال تسويق وتنظيم السياحة الدينية، وسياحة المؤتمرات هي نمط سياحي يحتاج إلى توافر إدارية وتسويقية مميزة غير متوافرة حالياً في السوق السعودي لأسباب متعددة تتعلق بعدم توافر الكوادر الوطنية المؤهلة في هذا المجال، والتوسع في تطبيق سياسات السعودة والتي تحد من قدرة المنشآت الرسمية والخاصة على استقدام الكفاءات البشرية من الخارج، وكذلك وجود قصور في أنظمة التعليم والتدريب التي من المفترض أن تسهم بشكل فاعل في تنمية المهارات البشرية العالمة في هذا المجال.
5. وجود قصور واضح في المعلومات عن المملكة كمقصد سياحي بصفة عامة وكمقصد لسياحة المؤتمرات بصفة خاصة، وهناك قصور واضح في السياسات الترويجية التي تنتهجها المنشآت الرسمية والخاصة في هذا المجال.
الاستراتيجيات التسويقية المقترحة لتنمية سياحة المؤتمرات في المملكة:
يمتلك التسويق استراتيجيات وأدوات متعددة تمكنه من المساهمة بدور فاعل في مجال تنمية سياحة المؤتمرات، وتتسم تلك الاستراتيجيات بالشمول وبقدرتها على التعامل مع مختلف المحاور المرتبطة بتنمية هذا القطاع، نتناول فيما يلي بالتفصيل الاستراتيجيات التسويقية المقترحة في هذا المجال.
أولاً: إستراتيجية دراسة سوق سياحة المؤتمرات:
تستهدف هذه الإستراتيجية تجميع وتحليل البيانات المتعلقة بسوق سياحة المؤتمرات على المستوى المحلي والإقليمي والدولي وذلك بهدف التعرف على معطيات هذا السوق والفرص المتاحة فيه لتنمية سياحة المؤتمرات في المملكة، ومن المقترح أن تشتمل تلك الإستراتيجية على تصميم وتنفيذ آلية للدراسة العلمية المتعمقة في عدة محاور:

2. إعداد دراسة تستهدف المعرفة المتعمقة لتجارب الدول العربية والأجنبية في مجال تنمية سياحة المؤتمرات، ومن ثم تحديد كيفية الاستفادة من نتائج الدراسة في تنمية سياحة المؤتمرات في المملكة.
3. إعداد دراسة للتعرف على توجهات مخططي ومنظمي المؤتمرات في الخارج، وكذلك اتجاهات وانطباعات الجهات المهتمة بعقد المؤتمرات، واعتبار نتائج هذه الدراسات مدخلات أساسية في إستراتيجية تنمية سياحة المؤتمرات في المملكة.
ثانياً: إستراتيجية تطوير المنتج في قطاع سياحة المؤتمرات:
تستهدف هذه الإستراتيجية بناء منتج متميز للمملكة في مجال سياحة المؤتمرات، هذا المنتج يشتمل على كافة العناصر الأساسية والفرعية التي تسهم بشكل مباشر في تقديم خدمة متميزة في هذا المجال، ومن المقترح أن تركز تلك الإستراتيجية على تصميم وتنفيذ آلية لها عدة محاور:
1. إنشاء منطقة جمركية خاصة بوفود المؤتمرات الدولية في المناطق المستقبلة لسياحة المؤتمرات، تتضمن هذه المنطقة تقديم التسهيلات التالية:
o سرعة دخول المنطقة الجمركية والخروج منها
o إعفاء المعدات التي تستخدمها الوفود من الرسوم الجمركية وهي المعدات التي يستخدمها أعضاء الوفود أثناء انعقاد المؤتمر ويصطحبونها عند مغادرتهم
o تخفيض الرسوم الجمركية على الواردات من الأجهزة التي تستخدم في عقد مؤتمرات
2. تقديم إعفاءات ضريبية لمدة عشرة سنوات للشركات المتخصصة الجديدة التي تدخل سوق سياحة المؤتمرات، مع وجود ضمانات بالتزام هذه الشركات بعنصر التخصص في مجال سياحة المؤتمرات.
3. التركيز على تطوير مدن معينة تمتلك موارد متعددة كي تكون مدن مؤتمرات مثل المدينة المنورة والخبر وأبها، والعمل في اتجاه تطوير إمكانيات تلك المدن (البنية الأساسية من اتصالات ومواصلات وخدمات مختلفة) بما يفي باحتياجات عملاء سياحة المؤتمرات.
4. تأسيس مركز تدريب بوزارة السياحة خاص بتنمية المهارات في مجال تسويق وتنظيم سياحة المؤتمرات بحيث يقدم المركز برامجه للأفراد الراغبين في العمل في هذا المجال، وكذلك الشركات التي تسعى إلى تطوير مهارات منتسبيها في مجال تسويق وتنظيم سياحة المؤتمرات
5. تصميم وتنفيذ برامج مكثفة ومتنوعة لتأهيل الكوادر الوطنية للعمل في مجال سياحة المؤتمرات بأنشطته المختلفة وهذا يتحقق من خلال التوسع في إنشاء كليات للسياحة والفندقة وتطوير المناهج التي يتم تدريسها حالياً في كليات ومعاهد السياحة لتركز على تنمية المعرفة والمهارات التي يتطلبها نشاط سياحة المؤتمرات.
6. تأسيس مركز عالمي للمؤتمرات على غرار مراكز المؤتمرات المعروفة على مستوى العالم وتزويد هذا المركز بكافة الإمكانيات التي تؤهله للوصول إلى مكانة متميزة في هذا المجال.
7. تشجيع الاستثمار في مجال سياحة المؤتمرات من خلال تقديم محفزات متنوعة تشجع المستثمرين على استثمار أموالهم في مجال بناء قاعات المؤتمرات والمعارض والفنادق ذات التجهيزات الخاصة لوفود المؤتمرات
ثالثاً: إستراتيجية الترويج للمملكة كمقصد متميز لسياحة المؤتمرات:
تستهدف هذه الإستراتيجية توظيف الوسائل الترويجية المتعددة لتعريف عملاء سياحة المؤتمرات على المستوى الإقليمي والدولي، ومن المقترح أن تشتمل الإستراتيجية المقترحة على التوجهات التالية:
1. قيام وزارة السياحة بإصدار مجلة درية متخصصة (نصف سنوية أو سنوية) في مجال سياحة المؤتمرات مترجمة لعدة لغات، وتوزيعها على جميع المنظمات والهيئات العالمية المهتمة بعقد المؤتمرات ومنظمي المؤتمرات في الخارج وتتضمن هذه المجلة الإمكانات والتسهيلات التي تقدمها المملكة في مجال سياحة المؤتمرات، وأخبار عن المؤتمرات المنعقدة والمزمع عقدها وانطباعات سائحي المؤتمرات، على ان يتم تمويل تكلفة طبع وتوزيع المجلة من إعلانات الشركات السياحية والمتخصصة والفنادق ومراكز المؤتمرات
2. تصميم موقع على الانترنت بعدة لغات عالمية يوضح إمكانيات المملكة في مجال سياحة المؤتمرات، ويعرض معلومات شاملة بشأن المنتج الذي تقدمه المملكة في هذا المجال، مع الترويج للموقع في العديد من المواقع العالمية السياحية.
3. تشكيل وفود من الأجهزة الرسمية والخاصة تتولى مهمة الترويج لإمكانيات المملكة في مجال سياحة المؤتمرات في المحافل العالمية ولدى الجهات المهتمة بعقد المؤتمرات.
4. المشاركة الفعالة في المؤتمرات والمعارض الدولية بعرض أفلام ونماذج لمكونات المنتج الذي تقدمه المملكة في مجال سياحة المؤتمرات.
5. تفعيل دور مكاتب التمثيل الثقافي والسياحي في الخارج ليساهموا بشكل مؤثر في الترويج للمملكة كمقصد لسياحة المؤتمرات

1. تصميم خطة محددة تعتمد على توظيف أسلوبين في التوزيع، الأسلوب الأول يستهدف الاتصال المباشر بالهيئات والمنظمات والشركات المهتمة بعقد المؤتمرات بحيث يسهل لهذه الجهات الاتصال بالأجهزة والمنشآت المعنية ومن ثم الحصول على الخدمة المطلوبة، الأسلوب الثاني يستهدف الاتصال بمنظمي المؤتمرات في الخارج والذين يتولون مهمة تسويق المؤتمرات للجهات المختلفة ومن ثم يتم اعتبار هؤلاء المنظمين وسطاء للوصول بالخدمة إلى العميل النهائي وهو الجهة التي تسعى إلى تنظيم مؤتمر.
2. تفعيل دور شبكة الانترنت في توزيع الخدمة التي تقدمها المملكة في مجال سياحة المؤتمرات، من خلال تخصيص قسم من الموقع الذي تم اقتراحه مسبقاً لترويج سياحة المؤتمرات، هذا القسم يستهدف بيع المنتج وتسهيل كافة الإجراءات اللازمة لاستهلاك الخدمة.
خامساً: إستراتيجية تسعير الخدمات التي تقدمها المملكة في مجال سياحة المؤتمرات:
تستهدف هذه الإستراتيجية تصميم وتنفيذ رؤية واضحة في مجال تسعير الخدمات التي تقدمها المملكة في مجال سياحة المؤتمرات بحيث يتم تقديم أسعار تنافسية في هذا السوق، ومن المقترح أن تحتوي تلك الإستراتيجية على التوجهات التالية:
1. تصميم آلية للتنسيق بين مختلف الجهات التي تسهم في صناعة المنتج في سياحة المؤتمرات 0شركات سياحية، فنادق، شركات طيران، مراكز مؤتمرات، جهات رسمية) بحيث يتم تحديد دور كل جهة في تقديم أسعار تنافسية تلبي احتياجات عملاء هذا القطاع وترتفع بالقيمة التي يحصلون عليها باستهلاكهم لهذه الخدمة، ومن ثم يتم التجنب المبكر لأية سياسات غير رشيدة في هذا المجال.

3. البحث في كيفية تقديم خدمات مصاحبة في جميع مراحل استهلاك الخدمة بحيث تضيف هذه الخدمات قيمة حقيقة للمنتج الذي تقدمه المملكة في مجال سياحة المؤتمرات.
سادساً: إستراتيجية البحث المستمر عن مزايا تنافسية في مجال سياحة المؤتمرات:
تستهدف هذه الإستراتيجية تصميم وتنفيذ رؤية تؤدي إلى اكتساب المملكة لمزايا تنافسية في مجال سياحة المؤتمرات، ومن المقترح أن تشتمل تلك الإستراتيجية على التوجهات التالية:
1. الاستفادة من نتائج الدراسات الميدانية والمكتبية المقترحة في تحديد كيفية اكتساب مزايا تنافسية متنوعة ومتجددة من مصادر مختلفة (تدنية التكاليف، التجديد والإبداع، تجزئة السواق)

Strategies proposed for developing convention travel in Kingdom of Saudi Arabia
Issue of Research:
Tourism is enjoying a great importance in both the developing and developed countries alike. There are many reasons that made tourism a main component in the development plans of these countries, the most important of which is the occurrence of long term structural changes in demand which resulted in expanding the economy of services.
Economical studies found a direct relationship between the progress of a society and the volume of service sector and its share in national production (GNP) in that society (1). That's is the reason why tourism industry came first before all industries, this. This becomes clear when tracking the development of international tourism during 1950 to 1999 as we will notice that the number of tourists increased from 25.282 millions in 1950to reach 656.9 millions in 1999.The international tourist revenues increased as well from 2.1 billion $ in 1950 to 455 billion $ in 1999 with an annual growth rate of 12% (2).
The development in tourism industry appears through the development of its patterns which are related to many activities that affect - directly and indirectly- the economies of the countries enjoying different tourist resources. Convention Travel is considered one of the fields of business tourism which include main activities represented in consultations, conventions, following up business and training, and secondary activities such as entertainment and shopping (3).
Convention Travel importance in the current time appears in the growth of services sector and the international approach towards free trade and manifesting the concept of market economy and that's what made Convention Travel one of the most important fields influencing the growth of tourism industry (4).

Convention Travel has gained its importance through its ability to attract high standard tourists who are privileged with high levels of expenditures as the organizations they represent afford their expenditures for attending conferences and thus the convention tourists have a chance to increase their personal expenses. Meanwhile, those convention tourists are privileged also with high levels of education and culture and this is considered an effective promotion for the countries organizing such conferences only if these countries succeeded in offering a high quality service in this field. Convention Travel as well has a direct influence on levels of employment in the touristic facilities and conferences centers (5).
In the shadow of the new approach of KSA regarding developing its touristic products via a lot of abilities that enable the Kingdom to occupy a special position in the market of tourism on both national and international levels, the importance of the role that cat Convention Travel can play in supporting and enhancing this approach becomes crystal clear.
In order to clarify the faces of this role, it becomes important to explore the importance of developing convention travel in the Kingdom and its current potentials that can influence the authorized parties for developing tourism in the Kingdom to take care of Convention Travel and also to find out the nature of the obstacles facing the development of Convention travel in the Kingdom and thus finding out how to design marketing strategies that enable the Kingdom to offer a distinguished product in the field of Co0nvention travel.

Objectives of the research:
This study aims at suggesting some marketing strategies that participate in developing Conventions Travel in the Saudi Kingdom. This goal can be reached through achieving the following sub-goals:
1- clarifying how important developing this activity of convention tourism is in the Kingdom
2- exploring the abilities and potentials which the Kingdom owns in the field of Convention tourism
3- identifying the nature of the obstacles facing the development of convention tourism in the Kingdom
4- designing the marketing strategies which are suitable for facing the obstacles and developing the capabilities
Inquiries of research:
This study is searching for answers to the following inquiries:
1- what is the concept of convention travel and what are the reasons of both developing and developed countries alike to develop this tourism pattern?
2- What is the role that convention travel could play in enhancing tourism industry in the Kingdom?
3- Does the Kingdom have the abilities necessary for directing attention towards developing convention tourism?
4- What is the nature of obstacles that may face the development of convention travel in the Kingdom?
5- What are the marketing strategies required for developing convention travel in the Kingdom?
Methodology of research:
This study aims at achieving the main goal through following an analytical descriptive method based on collecting data by carrying out a librarian study in order to provide the data and information necessary for completing this study. This could be achieved through books, researches, periodicals, and relevant scientific studies published and not published. The data and information to be collected are:
1- The concept and importance of convention travel
2- How to market convention travel
3- The importance of developing convention travel in the Kingdom
4- Fundamentals of developing convention travel in the Kingdom.
5- The obstacles facing developing convention travel in the Kingdom
The activity of holding conferences started in the middle of the eighteenth century and it was confined to a limited number of cultural societies to exchange information and setting policies and making decisions. Gradually, attention for this activity increased and the first conferences office was founded in Detroit- Michigan in the USA in1896 followed by founding other offices in other American countries. Convention travel became active after World War II as a result of the progress in transportation and the invention of modern means of communication, in the 1970s a large number of conferences authorities were founded in the European and Asian countries such as Germany, Hong Kong, and Singapore. In 1980s and 1990s attention to this activity of convention travel increased again after the developed and developing countries alike realized the various benefits of this activity (6).
In order to be an attraction element for any country seeking to develop this activity, convention travel needs the availability of facilities and potentials necessary for achieving the effectiveness in marketing convention travel and showing its great benefits.
In this part we handle the concept of Convention travel and its relation with business tourism and the economic, social and cultural importance of this activity of convention travel. We here show the possibilities and capabilities that should be made available to practice this activity.
1. The concept of Convention travel and its relation with business tourism
Convention travel is a modern tourism pattern basically based on a main event which is the conference or the convention. Through this event some other actions are being marketed (touristic and entertainment) (7).
Convention travel is one of Business Travel fields. Business Travel is related to persons who travel to achieve some goals that are linked to their work, so it is considered the oldest form of tourism as people travel for work and trade since a very long time. Workers travel importance is formed nowadays through the growth of service sector which participates with 75% of GNP in a number of developed countries (USA, United Kingdom, Japan, Germany, France, Italy). The international approach towards free trade and focusing on the concept of market economy played a clear role in making business travel one of the most important touristic patterns affects the growth of tourism industry (8).

Business travel includes a number of activities the most important of which are (9): :
- conferences and meetings: which is an action based on the meeting of some people to discuss an important topic. This meeting might be attended by six persons or hundreds of people, it may take some hours or extend to a whole week, and this conference or meeting could be commercial, medical, social…..etc. and as mentioned before, there are a lot of entertaining and touristic actions coincide with the meeting or the convention and that is the base of convention travel pattern.
- Fairs: which are events organized with the aim of offering specific products and services for a public of targeted clients. Fairs are considered part of business travel because it consists of demanding some touristic services represented in accommodation and transportation
- Training programs: which are events in which people who seek developing their skills and knowledge in the field of their work or interest participate. The training could be in house, meaning that it is directed to workers in a specific company, or it could be open training to any one who feels that he could benefit from it.
- Bonuses Travel: which is an admini9strative tool used to urge employers and managers to develop their performance and outcomes as free touristic trips are organized for employers and managers in return for their achievements.
Convention travel pattern is considered the most important of these patterns that comes under the concept of business travel, as convention travel represents 1% of the total international tourism percentage. And one of each five tourists in business travel attends a conference or a meeting or a forum outside his country (10).
2. The economic importance for convention travel
Many countries, regions and cities seeks for developing convention travel aiming at achieving the benefit of the various economic effects of this activity. Basically, convention travel gains its importance through the increase in the expenses rate of the convention tourist in comparison to the tourist expenses in other touristic patterns. This is because the accommodation costs and fees of participation in the conference are incurred by the authority represented by the convention tourist thus

There is an available chance for convention tourist to double his personal expenses in various fields such ad entertainment and shopping. According to the international statistics regarding the international movement of tourism from 1983 to 1993, and depending on the estimations for touristic revenues and the fields in which the tourist will spend his money, convention travel comes second regarding the average of the tourist expenses per day after the medical travel (11).
The convention tourist expenses range between 525 $ to 970 $ he spends in 38 days almost. The studies prepared by (I.C.V.B) also showed that each 2000 $ spent in the conference generates a work opportunity (12).
Convention travel as well participates in creating a civilized positive image for the cities that owns conference centers like (Atlanta, Birmingham, Boston, Singapore).we will shoe in detail the direct and indirect economic effects for convention travel hereafter:
First: direct economic effects (13):
a) the influence of convention travel on the balance of payments: balance of payments consists of the balance of current accounts and the capital balance, the touristic balance is considered a part of the current accounts balance, so the credit of the touristic balance influences the current accounts balance whether it was positive or negative. If the account of the touristic balance is positive, it compensates the negative credit of the current accounts balance or increases its positive credit and vice versa if it was negative. Here the important role that convention travel can play in increasing the balance of touristic accounts is clear (in 1994 in USA the revenues of conventions industries estimated with 83 billion $).
b) The influence of convention travel on employment: convention travel influences the creation of job opportunity and decreasing the unemployment rates that is because tourism industry in general is a complex industry affects and is affected by other various industries, meanwhile it is an intense work power industry whether this power was working in the tourism sector itself directly (conference centers, hotels, tourism companies) or indirectly in other sectors such as shopping centers, malls,

c) transportation and communication (in UK, specifically in Birmingham, convention tourists number in 1993 reached 4.5 millions from inside and outside UK, spent 430$ million creating 16800 job opportunity).
Second: the indirect economic effects (14):
a) Economic effects of income achieved through convention travel aren't confined only to the revenues related to it but there is a double influence appears in the rotation of this achieved revenues in the movement of national economy in various rotations by which the amount of money achieved is bigger than the original sum. Some experts estimate that this double effect of convention travel ranges between 3 to 5, i.e. great economical benefits for the countries interested in developing such activity.
b) Usually, tourists keep part of their budgets to spend on shopping and buying national products in the host country. This represents one of the export forms without any need for loading and external marketing. This appears clearly in convention travel as the expenses rates of tourists increase and consequently they participate actively in promoting some merchandise.
c) Convention travel creates a civilized positive image for the cities owning conference centers, this made the entire economy of some cities depends mainly on convention travel such as (Atlanta, Birmingham, Boston, Singapore)

Convention tourism creates a state of cultural and knowledge impulse in different fields too, conventions in itself are sources for developing awareness in society especially if it has been taken care of by the media. Convention travel also participates directly in raising the standards of living in the regions receiving Convention tourists through developing facilities and utilities in these areas (15).
Topic Two: marketing convention travel
Taking into account that this era is the era of conferences in its different types (scientific, medical, political, economical….. etc.) on both national and international levels, many countries in the developed and developing countries alike has taken care of touristic marketing for conferences. These countries seek to manifesting their soursec and abilities in the field of holding conferences and activating its communications with international travel agencies and conferences organizers and other authorities interested in holding conferences. Because convention travel is a distinguished pattern of tourism with a special nature, we find that marketing convention travel is different than touristic marketing in general; this difference comes in many faces (16) :
a) the normal tourist in his trip means to achieve goals related to entertainment and picnics, so he is always traveling, while the main aim of the convention tourist is attending the conference or convention so he stays most of the time in one place
b) convention tourists are distinguished by their high expenses rates because the organizations and authorities they represent affords their participation fees in the conference and costs of accommodation, so there is a big chance for the convention tourist to increase his expenses on purchasing and entertainment while the normal tourist seeks most of the time to economize his expenses.
c) marketing convention travel is done through contacting some travel agencies, companies and unions thus the decision for choosing where to hold the conference is an overlapping decision in which many factors interfere, this makes marketing convention travel more difficult in comparison to other travel patterns. This imposes the importance of practicing intensive and diverse efforts in the field of convention travel. In convention travel, revenues are identified depending on the volume of groups attending the convention, how long they will stay and the services they ask for in the host country. This points out to the vital role marketing can play in order to increase the revenues received from convention travel sector. The marketing role isn't confined only on designing and carrying out marketing strategies (product, pricing, distribution, promotion) but it extends to achieving positive reaction between these strategies (17).
Hereafter we will analyze and study the components of marketing mix for convention travel as well as the roles played by formal and private institutions in the field of marketing convention travel.
1. components of marketing mix in convention travel:
The marketing mix for convention travel consists of a number of elements discussed as follows (18) :
a) Product:
Product in the convention travel is a complete experience attained by convention tourists through interacting with the following factors: accommodation places (place, facilities and services)K places for organizing conferences (volume, place, facilities). The host country ( assistance services and fundamentals, entertainment places, suitable weather), transportation (easy arrivals and transportation in the airports, ports and internal means of transportation), companies (service suppliers, intermediaries), after sale services (statistics and reports after the end of the conference, tracking completion of procedures, making sure of satisfying all needs…etc.) . Thus, the experience of convention tourist is formed by interacting with these factors in three phases; first phase is related to the procedures for participating in the conference which is a previous phase before the event. Second phase coincides with the event (organizing the conference) which is the phase of consuming services. Third phase after the end of the event and is related to the impressions stay in the tourists memories.
In order to develop the product in convention travel we need to study and analyze the following:

b) Pricing
pricing is one of the critical factors in all markets, but it becomes more complicate in the market of Convention travel specifically for many reasons the most important of which is the difference in costs and prices between countries and also the differences in costs and prices inside one country between regions as it considers one of the challenges facing conferences marketers. Moreover, usually conferences marketers face the problem of identifying the value the client gets and the one who gets different services in the mean time, thus a difficulty arises in identifying the prices suitable to the value the tourist have in this field.
Pricing in the field of convention travel consists of two sides:
First side related to putting a price for the conference itself depending on the cost of its organization from settled costs incurred regardless of the number of real attendants in the conference (the rent and supplies of the place where the conference will be held, spokesmen fees, costs of conference promotion, visual and audio means), and changing costs depend on the actual number of attendants (accommodation, entertainment, transportation), the number of participants is estimated by the even point meaning the number of attendants required to participate to cover the settled and changing costs, the remnant represents the conference profit, and if the number is less than the even point, this represents a loss and doesn't cover the costs of marketing and organizing the conference.
The second side is related to pricing the thorough service (organizing the conference in addition to the inherent touristic and entertainment trips), the suitable price here is the price which attracts the greatest number of organizations and bodies interested in holding conferences.
c) Distribution
Distribution is attached to how the clients in the field of convention travel could buy a product or get it. There are two kinds of distribution in the field of convention travel, direct distribution through direct contact with the bodies interested in holding the conference and indirect distribution through contacting the conference organizers outside as well as foreign travel companies that deals with marketing the conferences these bodies hold. One of the studies published in "Convention Travel and Bonuses" book showed that 35% of the clients in this sector prefer booking through the Internet, the study also proved that conference centers sites are still in need to be developed to offer more information the clients of this activity needs.
• Public Relations: there are many tools used by the public relations position in promoting convention travel the most important of which is the documentary recorded movies about the abilities of the country in the field of convention travel, organizing trips for the members of international organizations and unions aiming at giving them information about the abilities of the country in the field of convention travel, preparing brochures and printed books to be distributed on conventions and conferences planners.

Topic Three: Fundamentals and obstacles of developing convention travel in KSA
In the report of (World Travel &Tourism Council 2003) (20) handling the development of tourism in KSA, it showed that it is expected that the Tourism activity in KSA could generate revenues estimated with 76.5 milliards of SR in 2003, and it is expected that it will increase to be 138.1 milliards SR in 2013. the Travel demand is expected to increase as well to 4.9% in between 2003 and 2013. The current travel investments in KSA is about 12.3 milliards SR in 2003 and is expected to increase in 2013 to be 23.1 milliards SR.
The report , in one of its important paragraphs, points out to the ability of tourism industry in KSA to compete through measuring a number of factors influencing the competitiveness of tourism industry. The report shows that the most competitive factor is the availability of good infrastructure that fits the development of the tourism activity, the following factor is the prices of touristic services while other factors came last pointing out that they hinder the development of touristic development in KSA, these factors are represented in the qualified human resources and the degree of openness on the outside world and level of technology used in touristic institutions.
The report agrees with the kingdom approaches in the field of developing Tourism in its different types, as responsible authorities for developing the tourism sector in the Kingdom realize that tourism industry participates highly in achieving the purposes of economic development as a result of the positive effects from tourism industry and represented in diversifying the sources of national product and improving the balance of payments and the influence of tourism on the regional economic development and increasing the investment opportunities for the private sector and making available new job opportunities (21).

Convention travel represents one of the most important patterns whose outcomes can be useful in developing tourism industry in KSA and thus achieving the targets of desired economic development, there are clear justifications that affirms the importance of this travel pattern especially in this stage:
a) the official authorities seek to raise the tourism sector in general and this in itself needs building and activating a thorough vision targeting investment and development of all touristic resources for KSA. And in the field of conferences, the kingdom owns a lot of potentials (that will be mentioned later) that qualify it to obtain a distinguished position in this field.
b) The nature of convention travel is suitable to the private nature of the Saudi society as it is a touristic pattern that takes in consideration keeping the moral roles to a great extent in the societies hosting convention travel.
c) We should make use of the various benefits that come out from convention travel whether regarding creating new job opportunities, developing the sources of national income, developing the fundamental structure, creating cultural and knowledge awareness in the society and building a good image of the Saudi society in mind as considered a society encouraging the values of culture and exchanging knowledge.
First: the fundamentals of developing convention travel in KSA;
The fundamentals necessary for developing convention travel are ranging between main fundamentals related to preparing the factors necessary to practice the action, and helping or supporting factors help in growing this action. Here after we will present the main and supportive fundamentals to develop convention travel in KSA:
a) Total area of fair grounds in KSA reaches about 29.000 m2 and the total area of conferences and conventions utilities reaches 61000 m2 . and its available in the kingdom also a number of fair and conference centers utilities which are in general modern and good furnished utilities prepared to host conferences and international fairs. There is a number of convention utilities that can host over 1000 people in the mean time. There is also three main kinds of these utilities in KSA: Fair centers, centers specialized for conferences, and convention utilities attached to hotels. The rate of using such utilities range between (25% to 40%). Riyadh and Abha achieve the largest rates in investing these utilities, consequently there is a space to extend this activity in the market. Business travel is concentrated in big cities where there is most of the trade business centers. Each of these cities has developed the utilities and services necessary to host this portion of tourism as there is more than 7000 hotel room in Riyadh and about 16000 in Jeddah and 2000 almost in both Dammam and Khobar. And in Riyadh and Jeddah, there is a fair Center in each (Riyadh Fair Center & Jeddah International Fair Center). and in Riyadh, Intercontinental Hotel provides an area of 2405 m2, while Alfaysaliyah Conference center provides an area of 5200 m2 to host conferences (22)
b) The development of fundamental structure: the kingdom owns an advanced fundamental structure represented in the availability of roads nets, bridges, ports, airports and communication. Telephone lines, transportation, electricity and water are considered among the best networks available in Gulf and Middle East regions (23)
c) The existence of sacred places that gives the kingdom a special and rare image in mind that distinguish it from other countries in the world. Mecca and al Medina are the Muslim destination in the whole world who are waiting passionately to visit, this gives the kingdom a special dimension as a destination for convention travel. Thus the product expected to be offered by the kingdom in the field of Convention travel will have a special competitive advantage by enabling members and delegations of conventions to visit sacred places, or preparing such places to be cities attracting convention travel.
d) Political and security stability: as the kingdom enjoys a known political and security stability encouraging tourists to visit KSA and enjoying complete insurance and caring on all levels (24) .
e) The availability of resorts and touristic places that are considered an attraction factor to convention travel as tourists can have the opportunity to go in entertainment trips during or after the conference.
The previous presentation clarifies that the kingdom owns he base from which it can reach the development of convention travel activity even if there is an urgent need to develop such sector on different faces.
Second: obstacles facing the development of convention travel in KSA
The obstacles affects the kingdom approaches negatively in the field of developing convention travel are formed from the same sources of obstacles facing the development of industry of tourism in general and they are as follows:
1) Unavailability of sufficient conferences centers and halls that are equipped to receive the conferences delegations. Although there is a number of equipped centers, it still in sufficient to achieve the desired development in this field especially that the existing centers are concentrated in Riyadh
2) There are noticeable difficulties facing businessmen and tourists in having visas into the kingdom, this has a negative effect on the image of the kingdom as it decreases the convention travel if we put in consideration the facilities made by competitive countries in the region offered to business men and conferences.
3) Not offering the necessary custom facilities for conferences delegations, a lot of tools and equipments are confiscated in customs or enter into the kingdom by paying high fees. Fair and convention travel depends mainly on equipments and machines.
4) Nonexistence of specialized or qualified companies in this field of marketing and organizing convention travel, the experience of current travel companies is confined to marketing and organizing religious travel while convention travel is a tourism pattern that needs the availability of distinguished marketing and managing that doesn't exist now in the Saudi market for many reasons related to the unavailability of qualified national cadres in this field and extending in applying Saudification policies that limit the ability of private and public institutions o receive human resources from outside Saudi Arabia. There is also some kind of shortage in teaching and training systems that is supposed to participate actively in developing human skills working in this field.
5) There is a clear shortage in the information about the kingdom as a touristic destination in general and as a destination for convention travel in particular. There is also a clear shortage in the policies of promotion adopted by public and private institutions in this field
Proposed marketing strategies for developing convention travel in KSA
Marketing has various strategies and tools that enables it to participate actively in the field of developing convention travel. These strategies are characterized with comprehensiveness and ability to deal with different faces related to developing this sector. Here we will handle in detail the marketing strategies proposed in this field.
First: the strategy of studying the market of convention travel
This strategy targets collecting and analyzing data related to the market of convention travel on the local, regional and international levels aiming at getting acquainted with this market facts and its available opportunities to develop convention travel in the kingdom, it is suggested that this strategy would include designing and carrying out a mechanism for in depth scientific study in various pivots:
1. doing a field study aiming at knowing the actual problems facing the development of convention travel in the kingdom. Through this study the impressions and suggestions of workers in tourism sector will be known whether working in private or public institutions and also getting to know the impressions and suggestions of researchers and experts specialized in that field.

It is proposed that this strategy would concentrate on designing and carrying out a multi pivots mechanism:
1. establishing customs area specialized to international conferences delegations in the regions receiving convention travel, this area includes offering these facilities:
• getting in and out the custom area rapidly
• exempting the equipments used by the delegations from custom duties, the machines they use during the conference and take with them when leaving.
• Decreasing custom duties on equipments imported to be used in conferences
2. offering tax exemptions for ten years to the new specialized companies that enter the market of convention travel with some guarantees that these companies will be committed to the element of specialization in the field of convention travel.
3. concentrating on developing certain cities to be conferences cities like Medina, Khobar and Abha, and working towards developing the abilities of these cities (fundamental structure: communication, transportation, and other services) in away satisfies the needs of convention travel tourists
4. establishing a training center in the ministry of tourism to develop the skills in the fields of marketing and organizing convention travel so that it could offer its programs to whoever wants to work in this field and also to companies that seek to develop the skills of its workers in the field of marketing and organizing convention travel

Third: strategy of promoting KSA as a distinguished destination for convention travel
This strategy aims at employing promoting means to let convention tourists know about the national and international levels, it is suggested that this strategy should include the following approaches:
1. the ministry of tourism should publish a periodical specialized magazine (annual or semi annual)in the field of convention travel translated into a number of languages and to be distributed on all organizations and international bodies interested in holding conferences and on conferences organizers abroad. This magazine would include the abilities and facilities available in KSA in the field of convention travel and some news about the existing and future conferences and the impressions of convention tourists, and the cost of printing and distributing the magazine should be financed by the advertisements of travel and specialized companies and hotels and conference centers.
2. designing a website n many languages that would show the abilities of KSA in the field of convention travel and showing comprehensive information about the product introduced by the kingdom, and promoting the site in other different international travel sites.
3. forming delegations from both public and private authorities to handle the task of promoting to KSA in the field of convention travel in the international events and at the bodies interested in holding conferences.
4. effective participation in international fairs and conferences with the target of showing movies and models of the components of the product offered by KSA in the field of convention travel.
5. activating the role of offices of travel and cultural representation abroad to participate effectively in promoting to KSA as a destination for convention travel.
6. showing movies of the abilities of KSA in the sector of convention travel on specialized channels that reach the targeted clients in this field

The second way aims at contacting conferences organizers abroad who will take care of marketing the conferences to different bodies, thus these organizers are considered intermediaries conveying the service to the end customer who is the body seeks to organize the conference
2. activating the internet role in distributing the service offered by KSA in the field of convention travel by specifying a section in the website suggested previously to promote convention travel. This section will aim at selling the product and facilitating all other procedures necessary to consume the service
Fifth: strategy of pricing services offered by KSA in the field of convention travel
This strategy aims at designing and carrying out a clear vision in the field of pricing services offered by KSA in the field of convention travel so as to offer competitive prices in the market. It is suggested that this strategy would include the following approaches:
1. designing a mechanism to coordinate between the different bodies participating in manufacturing the product in convention travel (travel agencies, hotels, flight companies, conference centers, official bodies) so as to determine the role of each body in offering competitive prices satisfying the needs of the clients of this sector and raises the value they get when they consume such services, that is why any irrational policies in this field should be avoided early.
2. designing and carrying out a mechanism that depends on an in depth study for international and national economic positions, the monetary system, exchange prices as well as future expectations to the markets of convention travel and using this study to set suitable pricing policies.
3. searching how to offer accompanying services in all the stages of consuming the service so as these services would add a real value to the product offered by the kingdom in the field of convention travel.
Sixth: strategy of continuous search for competitive privileges in the field of convention travel
This strategy aims at designing and carrying out a vision that leads KSA to acquire competitive privileges in the field of convention travel. This strategy is suggested to include the following approaches:
1. making use of the findings of suggested field and librarian studies in determining how to acquire various and renewed competitive privileges from different resources ( low cost, renewal and creativity, market portioning)
2. continued evaluation by competitors approaches and competitive position to the product offered by KSA in the field of convention travel and thus developing new policies that go along with all the new information in this market.
3. holding workshops that gather all the parts participating in manufacturing the product of convention travel aiming at reaching new ideas and visions enriching and distinguishing the product offered by KSA in this field.
General Recommendations:
1. coordination between all the formal authorities in the country ( ministry of tourism, ministry of transportation, ministry of commerce, foreign affairs ministry and ministry of the interior) in order to manufacture a distinguished product in the field of convention tourism.
2. concentrating in future on creating awareness on all formal and civil levels with the importance of developing the pattern of convention travel and the exerted efforts in this field.
