Purchaser indemnifies and holds harmless the Supplier, and shall obtain from plant owner where equipment will be situated written assurance satisfactory to Supplier that owner indemnifies against and holds harmless Supplier from any claim, liability, or expense (including attorney's fees and costs) which Supplier may incur to any person or entity, whether based on any claim of negligence on the part of Supplier, or any other cause whatsoever for personal injury (including death) or property damage, including but not limited to loss of, loss of use of, damage, whether on-Site or off-Site arising out of or resulting from the Equipment furnished and/or Service performed under the Purchase Agreement or any use thereof, or from any cause whatsoever.
Purchaser waives and will furnish written evidence that insurers of Purchaser waive all rights of recourse and subrogation against Supplier. Purchaser will cause the plant owner to waive and furnish written evidence that the insurers of the plant owner waive all rights of recourse and subrogation against Supplier, for all personal injury or property damage liability. AII such waivers shall be in a form acceptable to Purchaser.

Ο Αγοραστής θα αποζημιώσει και θα απαλλάξει τον Προμηθευτή από κάθε ευθύνη, λαμβάνοντας ταυτόχρονα έγγραφη βεβαίωση από τον ιδιοκτήτη του εργοστασίου όπου θα βρίσκεται ο εξοπλισμός προς ικανοποίηση του Προμηθευτή, στην οποία θα δηλώνεται, ότι ο ιδιοκτήτης θα απαλλάξει τον Προμηθευτή από κάθε ευθύνη και θα τον αποζημιώσει έναντι κάθε αγωγής, ευθύνης ή εξόδων (συμπεριλαμβανομένης της δικηγορικής αμοιβής και εξόδων) ενδεχομένως προκαλέσει ο Προμηθευτής σε βάρος οιουδήποτε φυσικού ή νομικού προσώπου, είτε βάσει οιασδήποτε προσφυγής κατά του Προμηθευτή για αμέλεια ή οιασδήποτε άλλης προσφυγής για σωματικές βλάβες (συμπεριλαμβανομένου θανάτου) ή υλικές ζημίες, συμπεριλαμβανομένης, αλλά όχι περιοριστικά, οιασδήποτε απώλειας, απώλειας χρήσης, ζημίας προκληθείσας εντός ή εκτός του εργοστασίου εξαιτίας ή συνεπεία του Εξοπλισμού ή/και της Υπηρεσίας που παρασχέθηκε βάσει Συμβολαίου Αγοραπωλησίας ή λόγω της χρήσης αυτών ή εξ οιουδήποτε άλλου λόγου.

Ο Αγοραστής θα εξασφαλίσει, ότι ο ιδιοκτήτης του εργοστασίου θα παραιτηθεί, και θα παράσχει έγγραφη απόδειξη της σχετικής παραίτησης των ασφαλιστών του, από κάθε δικαίωμα αναγωγής και υποκατάστασης κατά του Προμηθευτή σε σχέση με κάθε ευθύνη που αφορά σε σωματικές βλάβες ή υλικές ζημίες. Κάθε τέτοια παραίτηση θα παρέχεται σε μορφή αποδεκτή από τον Αγοραστή.

Source text - English 15. LIMITATION OF LIABILITY (U.S.A.)
Except for fraud or willful misconduct by Seller, neither Seller nor its suppliers will be liable to Purchaser whether in contract, in tort, under any warranty, for any special, indirect, incidental, or consequential loss or damage whatsoever, or for loss of use of equipment or cost of capital, loss of profits or revenues or the loss of use thereof, cost of purchased or replacement power (including additional expenses incurred in using existing power facilities), or claims of customers of Purchaser. The remedies set forth herein are exclusive and the total cumulative liability of Seller under the Purchase Agreement or any act or omission in connection therewith or related thereto, whether in contract, in tort, under any warranty, or otherwise, will be limited to the price of the item of equipment on which such liability is based.
In all cases where Purchaser's claim, whether in contract, in tort, under any warranty, or otherwise, arises out of or is in connection with the sale, delivery, or use of defective Equipment or Services under a Purchase Agreement or damage resulting therefrom, Purchaser's exclusive remedies and Seller's sole liability shall be limited to those specifically provided in this Agreement.
The provisions of this Article, and of all other sections of the Purchase Agreement providing for limitation of liability of Seller shall also protect its Suppliers and shall apply to the full extent permitted by law, regardless of fault and notwithstanding any other provisions of the Purchase Agreement, and shall survive any termination or expiration of the Purchase Agreement.

Ο Πωλητής και οι προμηθευτές του δεν θα φέρουν καμία ευθύνη έναντι του Αγοραστή απορρέουσα από σύμβαση, αδικοπραξία ή οιαδήποτε εγγύηση, σε σχέση με οποιαδήποτε ειδική, έμμεση, θετική ή αποθετική ζημία ή απώλεια, ή σε σχέση με απώλεια χρήσης εξοπλισμού ή κόστους κεφαλαίου, απώλεια κερδών ή εσόδων ή την απώλεια χρήσης αυτών, του κόστους της ενέργειας που καταναλώθηκε ή της ενέργειας αντικατάστασης (συμπεριλαμβανομένων πρόσθετων εξόδων με τα οποία επιβαρύνθηκε κατά την χρήση των υφιστάμενων ηλεκτρικών εγκαταστάσεων), ή αξιώσεις πελατών του Αγοραστή, εξαιρουμένων των περιπτώσεων απάτης και δόλου εκ μέρους του Πωλητή. Οι επανορθώσεις που ορίζονται στο παρόν είναι αποκλειστικές, ενώ το σύνολο της ευθύνης του Πωλητή βάσει της Σύμβασης Αγοραπωλησίας ή οιασδήποτε σχετικής ή συνδεόμενης με αυτήν πράξης ή παράλειψης, είτε απορρέει από σύμβαση, αδικοπραξία ή από οιαδήποτε εγγύηση ή διαφορετικά, θα περιορίζεται στην τιμή του σχετικού με την ευθύνη εξοπλισμού.
Στις περιπτώσεις που αξίωση του Αγοραστή απορρέουσα από σύμβαση, αδικοπραξία, εγγύηση ή διαφορετικά, προκύπτει από ή συνδέεται με την πώληση, παράδοση ή χρήση ελαττωματικού Εξοπλισμού ή Υπηρεσιών παρασχεθέντων στο πλαίσιο Σύμβασης Αγοραπωλησίας, ή με ζημία που προκλήθηκε από τον εν λόγω εξοπλισμό ή υπηρεσία, τότε οι αποκλειστικές επανορθώσεις του Αγοραστή και η αποκλειστική ευθύνη του Πωλητή θα περιορίζονται σε εκείνες που ορίζονται στην παρούσα Σύμβαση.
Οι διατάξεις του παρόντος Άρθρου και του συνόλου της Σύμβασης Αγοραπωλησίας που αφορούν στον περιορισμό της ευθύνης του Πωλητή, θα προστατεύουν και τους Προμηθευτές αυτού και θα έχουν εφαρμογή στο μέγιστο βαθμό που επιτρέπεται από το νόμο, ανεξαρτήτως ελαττώματος και επιφυλασσόμενης οιασδήποτε άλλης διάταξης της Σύμβασης Αγοραπωλησίας, ενώ θα παραμένουν σε ισχύ ακόμη και μετά την καταγγελία ή λήξη της εν λόγω σύμβασης.
