An account is now open for fuel at the Eva petrol station opposite the Colony Hotel.
The purpose of the facility is to provide for the fuel cost incurred in traveling on company business. Where vehicles are used for both private and company use personnel will be required to meet the cost of private use. Private use includes traveling to and from the employee’s normal place of work, unless specifically authorised otherwise by senior management.
The attached list of vehicles is approved to use the fuel facility. Where vehicles are used by several personnel one individual is deemed to have ownership. The owner is responsible for submitting a monthly Company Travel return to show the business travel incurred. The return sets out the scale allowance for specific destinations. Where the fuel charge exceeds the travel allowance the excess will be treated as private motoring and the owner will be required to reimburse the cost. The Company Travel return will be submitted to the CEO for approval and then forwarded to the Accounts Department.
The account garage should be used whenever possible for business motoring. If it is necessary to buy fuel elsewhere the fuel receipt must be attached to the monthly return in order to claim the cost.
Fuel Purchase Procedure
1. On arrival notify the garage office that this is an account car.
2. Draw down fuel and note the pump price total.
3. Sign the receipt at the garage office confirming the pump price.
4. Retain copy of receipt provided by the garage and attach to Company Travel return.

Bununla şirketin iş seyahatlerinde gereken yakıt ihtiyacını karşılamak amaçlanmaktadır. Araçlar hem kişisel nedenler hem de şirket işleri için kullanıldığında, araç personeli kişisel kullanımdan doğan masrafları karşılamalıdır. Üst yönetim tarafından özel olarak izin verilmedikçe, çalışanın iş yerine ve iş yerinden yaptığı seferler kişisel kullanıma dâhildir.
Yakıt olanağından yararlanmasına izin verilmiş araçlar ekteki listededir. Araçlar birkaç personel tarafından kullanıldığında, bir kişi araç sahibi sayılacaktır. Araç sahibi yapılan iş seyahatlerini göstermek amacıyla aylık Şirket Seyahat beyannamesi vermekle sorumludur. Beyannamede gidilen yerler için harcanan ödenek belirtilir. Yakıt masrafının seyahat ödeneğini geçmesi kişisel kullanıma girecek ve yapılan masraf araç sahibi tarafından karşılanacaktır. Şirket Seyahat beyannamesi onaylanmak üzere CEO’ya gönderildikten sonra Muhasebe Bölümüne iletilecektir.
İş için araç gereken her durumda yakıt gereksinimi benzin istasyonundaki hesaptan karşılanmalıdır. Yakıt ihtiyacını başka bir yerden karşılamak gerekirse, yapılan masrafı göstermek için satın alınan yakıtın makbuzu aylık beyannameye iliştirilmelidir.

1. Benzin istasyonuna vardığınızda istasyonun ofis bölümüne aracın şirketin hesabına ait olduğunu bildirin.
2. Yakıtı doldurduktan sonra benzin pompa fiyatını not edin.
3. Benzin istasyonu ofisinde makbuzu imzalayarak benzin pompa fiyatını onaylayın.
4. Benzin istasyonundan verilen makbuzun kopyasını saklayın ve Şirket Seyahat beyannamesine iliştirin.

Vankomisine bağlı nötropeni gelişen enfektif endokarditli bir çocukta teikoplanin kullanımı

SUMMARY: Neutropenia is an uncommon adverse effect associated with prolonged vancomycin therapy. The vancomycin-induced neutropenia is believed to be immunologically based and independent of drug concentrations. Neutrophil counts normally recover after discontinuation of vancomycin in this situation, but treatment options are needed for those patients who require ongoing antibiotic therapy. We report an eight year-old boy with infective endocarditis and vancomycin-induced neutropenia in which the neutropenia resolved after vancomycin was replaced by the structurally related compound teicoplanin. Patients should have periodic assessment of white blood cell and neutrophil counts and discontinuation of vancomycin should be considered if neutropenia develops.

ÖZET: Nötropeni uzamış vankomisin tedavisi ile ilişkili nadir yan etkilerdendir. Vankomisinin indüklediği nötropeninin immünolojik temele dayandığına inanılmaktadır ve ilaç konsantrasyonundan bağımsızdır. Vankomisin tedavisi kesildikten sonra nötrofil sayısı normale döner, fakat antibiotik tedavisine devam edilmesi gereken hastalarda tedavi seçenekleri gözden geçirilmelidir. Bu makalede enfektif endokarditli, vankomisinin indüklediği nötropenisi olan
ve nötropeninin vankomisin yerine yapısal olarak ilişkili bir bileşik olan teikoplanin kullanımı ile düzelen sekiz yaşında bir erkek çocuk sunulmuştur. Vankomisin tedavisi alan hastaların nötrofil ve lökosit sayısı periyodik olarak değerlendirilmeli ve nötropeni gelişirse, tedaviye devam edilmemelidir.

Vankomisin Streptomyces orientalis den türetilen ve özellikle metisiline dirençli Staphylococcus aureus ve koagulaz-negatif stafilokoklara karşı kullanılan glukopeptit yapısında bir antibiyotiktir. Ek olarak vankomisin penisiline allerjik veya dirençli gram pozitif bakterilerle oluşan bakteriyel endokardit tedavisinde hala en önemli alternatiftir1. Vankomisin tedavisine bağlı olarak görülen başlıca yan etkiler "red man sendromu" nefrotoksisite ve ototoksisitedir. Nötropeni, vankomisin kullanılmasına bağlı seyrek olarak gelişen fakat potansiyel olarak ciddi bir komplikasyondur2. Nötropeni normalde vankomisin tedavisinin kesilmesinden sonra düzelir, fakat ara vermeden antibiyotik tedavisine devam edilmesi gereken hastalarda alternatif antibiyotiklerin belirlenmesi gerekmektedir. Burada vankomisin tedavisine bağlı olarak nötropeni gelişen bir hastada glukopeptit yapısı bakımından vankomisine benzer olan teikoplanin kullanılması ile kısa sürede nötropeninin düzeldiği bir hasta sunulmuştur.
Vaka Takdimi
Sekiz yaşında erkek hasta, ateş, diz, kalça, el bileklerinde ağrı ve şişlik nedeniyle getirildi. Hastanın öyküsünden daha önce hiçbir şikayetinin olmadığı, eklemlerindeki ağrıların üç ay önce başladığı, bir ay önce bademciklerinin şiştiği, 10 gün önce gittikleri doktor tarafından hastaneye yatırılarak tedavi edildiği daha sonra kalbinde delik var denilerek hastanemize gönderildiği öğrenildi. Fizik muayenesinde vücut sıcaklığı 39°C olup kalp taşikardikti ve tüm odaklarda III/VI şiddetinde sistolik üfürüm duyuluyordu. Diğer sistem bulguları normaldi. Hemoglobin 12.7 gr/dl, lökosit sayısı 29.000/mm3, trombosit sayısı 348.000/mm3 idi. Sedimentasyon hızı 74 mm/saatti. Periferik kan yaymasında polimorfonükleer hücre egemenliği olan hastanın biyokimyasal incelemesi LDH (laktik dehidrogenaz) yüksekliği (800 IU/L) dışında normal sınırlardaydı. TORCH, hepatit paneli ve HIV testi negatif olarak saptandı. EKG'de sağ dal bloğu, sağ ventrikül hipertrofisi bulunan hastanın telegrafisinde kardiotorasik oran %50 olarak ölçüldü. Ekokardiografik incelemesinde ventriküler septal defekt (VSD), pulmoner stenoz, küçük ASD ve VSD'nin sağ tarafında 3.2 X 7.0 mm çapında vejetasyon saptandı. Kan kültüründe Staphylococcus epidermidis üredi.
Bu bulgularla enfektif endokardit tanısı konan hastaya vankomisin (60 mg/kg/gün, dört dozda intravenöz) ve gentamisin (7.5 mg/kg/gün, üç dozda intravenöz) başlandı. Tedavi ile genel durumu düzelen hastanın düzenli olarak yapılan tam kan sayımı ve biyokimya takibinde vankomisin tedavisinin 18. gününde hemoglobin ve trombosit sayısı normal sınırlarda iken lökosit sayısının belirgin şekilde düştüğü saptandı (hemoglobin 13.2 gr/dl, trombosit sayısı 151.000/mm3, lökosit sayısı 900/mm3 ve mutlak nötrofil sayısı 300/mm3). Genel durumu iyi olan, ateşi ve septik bulguları da olmayan hastaya nötropeninin nedenini araştırmak üzere kemik iliği aspirasyonu yapıldı. Kemik iliğinin normoselüler olduğu ve myeloid seride artma olduğu görüldü. Vankomisin kullanımı ile beraber literatürde nötropeni bildirildiği için nötropeninin nedeninin vankomisin kullanımına bağlı olabileceği düşünüldü ve vankomisin kesildi. Hastanın endokardit nedeniyle antibiyotik tedavisine devam edilmesi gerektiğinden teikoplanin ve gentamisin olarak tedavisine devam edildi. Vankomisin kesildikten dört gün sonra beyaz küre sayısı G-CSF (granulocyte colony-stimulating factor) kullanılmamasına rağmen yükselmeye başladı (lökosit sayısı: 2.500/mm3 ve mutlak nötrofil sayısı 1.000/mm3) ve altıncı günde 4700/mm3’e ulaştı. Antibiyotik tedavisi altıncı haftaya tamamlanan hasta kontrollere gelmek üzere taburcu edildi. Altı aylık takipte nötropeni görülmedi.
Tartışma
Nötropeni vankomisin kullanımına bağlı olarak gelişen seyrek bir komplikasyondur, Farber ve
Moellering2. tarafından yapılan bir retrospektif çalışmada vankomisin kullanan 98 hastanın %2'sinde nötropeni geliştiği bildirilmiştir. Bu komplikasyon daha çok uzun süre vankomisin
kullananlarda diğer ilaç toksisitesi belirtileri olmadan bildirilmiştir, istisnalar dışında nötropeni ilaç kesildikten sonra spontan olarak düzelir. Bu düzelme genellikle birkaç gün içinde olmakla beraber hemodiyaliz hastalannda bu süre dört haftaya kadar uzayabilir3.
Nötropeninin mekanizması günümüzde hala kesin olarak bilinmemektedir. Bu komplikasyon daha çok 15-40 gün gibi uzun süre vankomisin kullananlarda bildirildiği için doz ile ilişkili olabileceği belirtilmiştir. Bu nedenle izlemde vankomisin kan düzeylerine bakılması önerilmektedir. Biz teknik yetersizlik nedeniyle kan ilaç düzeylerine bakamadık, fakat günlük dozu dört eşit dozda vererek riski azaltmaya çalıştık. Kemik iliği baskılanması diğer bir olası bir neden olarak görülmemektedir. Çünkü kemik iliği incelemelerinde granülositer seride hem hiperplazi hem de hipoplazi gözlenmiştir. Hastamızda da kemik iliği incelemesinde granülositer seride hiperplazi saptadık. Diğer bir olası neden olarak immün aracılıklı mekanizma ileri sürülmüştür. Nötrofillere karşı gelişen vankomisine bağlı antikorların gösterilmesi bu tezi desteklemiştir. Schwartz4. vankomisin kullanan bir hastada serumda antinötrofil antikorları göstermiştir. Hastamızda teknik yetersizlik nedeniyle antinötrofil antikorları gösteremedik.
Yeterli süre antibiyotik tedavisi almadan once nötropeni gelişerek vankomisini kesilmesi gereken hastalarda antibiyotik seçenekleri konusunda az sayıda yayın vardır. Koo ve arkadaşları5. Nötropeni gelişen bir hastada vankomisin dozunu azalttığında nötropeninin düzeldiğini Lai ve arkadaşları6, ise iki hastada vankomisini G-CSF ile birlikte kullandıklannda nötropeninin düzeldiğim bildirmiştir. Sanche ve arkadaşları7, erişkin bir hastada vankomisin yerine teikoplanin kullanarak antibiyotik tedavisine devam ettiklerini ve nötropeninin yedi gün içinde düzeldiğini bildirmiştir. Hastamızda G-CSF kullanmadık. Antibiyotik tedavisine devam etmemiz gerektiği için vankomisin dozunun azaltılması yerine teikoplanin ile devam edilmesi kanısına varıldı.
Teikoplanin glikopeptit yapısında vankomisin ile yapısı ve etki spekturumu bakımından benzerlik gösteren bir antibiyotiktir. Literatürde vankomisin yerine teikoplanin kullanılan iki rapor vardır. Birincisinde vankomisine bağlı nötropeni gelişen bir hastada bir süre sonra başka bir enfeksiyon geliştiğinde teikoplaninin başarı ile kullanıldığı, diğerinde ise erişkin bir hastada aynı enfeksiyon sırasında teikoplaninin kullanımı bildirilmiştir7'8.
Sunduğumuz bu hasta ile vankomisin kullanıldığı durumlarda lökosit sayısının izlenmesi gerektiği ve nötropeni gelişen çocuk hastalarda antibiyotik tedavisine devam edilmesinin gerekli olduğu durumlarda teikoplaninin iyi bir alternatif olabileceği kanısındayız.

Vancomycin is an antibiotic with a glycopeptide structure derived from Steptomyces orientalis and used against coagulase-negative staphylococci and Staphylococcus aureus which is resistant to methicillin. Vancomycin is also still the most important alternative in the treatment of bacterial endocarditis caused by resistant gram-positive bacteria or for cases allergic to penicillin. The primary side-effects observed in vancomycin treatment are “red man syndrome”, nephrotoxicity and ototoxicity. Neutropenia is a potential serious complication which is occasionally related to the use of vancomycin2. Neutropenia generally disappears when vancomycin treatment is stopped but alternative antibiotics should be specified for patients who must have continuous antibiotic treatment. In this case study we have a patient who developed neutropenia in connection with vancomycin treatment but in which neutropenia resolved shortly after it was replaced with teicoplanin, which is structurally similar to vancomycin in terms of glycopeptide structure.
Case Presentation
An eight-year-old boy was brought for treatment due to fever, as well as pain and swelling in the knees, buttocks and wrists. From the patients history we learned that he had never had a complaint like this before, that the pain in his joints had begun three months ago, that his tonsils had swollen up 1 month ago, that the doctor who examined him 10 days ago admitted him to the hospital where he received treatment but later he was said to have a hole in his heart and was referred to us. A physical examination revealed that his temperature was 102.2 F and he had tachycardia. A III/IV degree heart murmur was heard in every chamber. Other system findings were normal. Hemoglobin was 12.7 gr/dl, leukocyte count 29.000/mm3, thrombocyte count 348.000/mm3. Sedimentation rate was 74 mm/hour. Biochemical analysis of the patient who had dominant polymorphonuclear cell in peripheral blood flow was within normal limits except for elevated (800 IU/L) LDH (lactic dehydrogenase). TORCH, hepatitis panel and HIV tests were negative. The EKG revealed that the patient had a right bundle branch block and hypertrophy in the right ventricle. The cardiothoracic ratio was measured as 50%. The echocardiograph exam revealed a ventricular septal defect (VSD), pulmonary stenosis, small ASD and vegetation on the right VSD measuring 3.2 x 7.0 mm. Staphylococcus epidermidis was identified in the blood culture.
With these findings, the patient was diagnosed with infective endocarditis and treatment was begun with vancomycin (60 mg/kg/day, in 4 intravenous doses) and gentamycin (7.5 mg/kg/day, in three intravenous doses). Complete blood counts and biochemical monitors was performed regularly on the patient whose general condition began to improve with treatment but on the 18th day of vancomycin treatment the leukocyte count dropped significantly although hemoglobin and thrombocyte counts were within normal limits (hemoglobin 13.2 gr/dl, thrombocyte count 151,000/mm3, leukocyte count 900/mm3 and absolute neutrophil count was 300/mm3). Bone marrow aspiration was performed to investigate the cause of neutropenia in a patient whose general condition was good and who had no fever or septic symptoms. The bone marrow was normocellular and indicated an increase in myeloid series. Because the literature indicated neutropenia with vancomycin treatment, it was decided that the neutropenia might be related to the use of vancomycin and the vancomycin was discontinued. Because the patient was endocarditis and needed to continue antibiotic treatment, teicoplanin and gentamycin were used to continue treatment. Four days after the vancomycin was discontinued, the white blood cell count began to rise in spite of the fact that G-CSF (granulocyte colony-stimulating factor) had not been used (leukocyte count 2,500/mm3 and absolute neutrophil count 1,000/mm3) by the sixth day it had reached 4700/mm3. The patient was released after completing 6 weeks of antibiotic treatment upon the condition that he would return for check-ups. Neutropenia was not observed in the six months of follow-up.
Discussion
Neutropenia is a rare complication associated with vancomycin therapy In a retrospective study conducted by Farber and Moellering2, it was reported that neutropenia developed in 2 percent of the 98 patients who used vancomycin. This complication has been reported more commonly in those who have used vancomycin for extended periods of time without other symptoms of drug toxicity.Though there are exceptions, neutropenia resolves spontaneously when the drug is discontinued. Although resolution generally takes place within a couple of days, it may take as long as four weeks in patients on hemodialysis3.
Today the exact mechanism of neutropenia is still unknown. Because this complication is generally reported in patients who have used vancomycin for 15-40 days, there may be a connection with dosage. Therefore, it is recommended that blood levels of vancomycin be monitored. Due to lack of technical capacity, we were unable to monitor drug levels in the blood but we attempted to reduce the risk by administering 4 equal doses throughout the day. Bone marrow suppression is not viewed as a possible cause since examination of the bone marrow revealed both hyperplasia and hypoplasia in the granulocytic series. Examination of the bone marrow in our patient revealed hyperplasia in the granulocytic series. Another possible cause that has been put forward is a immuno-related mechanism. Evidence of antibodies related to vancomycin and developed against neutrophils supports this theory. Schwartz4 demonstrated the presence of antineutophil antibodies in a patient that used vancomycin. Due to a lack of technical facilities we were unable to demonstrate the presence of antineutrophil antibodies.
There are very few publications on the topic of antibiotic alternatives for patients that develop neutropenia before completing an adequate course of antibiotics and have to have their vancomycin discontinued. Koo et al.5 reported that in a patient who had developed neutropenia, it was resolved when the vancomycin dosage was reduced and Lai et al.6 reported that neutropenia was resolved in two patients when they used G-CSF with vancomycin. Sanche et al.7 reported using teicoplanin instead of vancomycin on an adult patient to continue their antibiotic treatment and that neutropenia was resolved in 7 days. We did not administer G-CSF to our patient. Because we had to continue the antibiotic treatment, we decided to replace vancomycin with teicoplanin instead of reducing the dosage.
Teicoplanin is an antibiotic, which, like vancomycin, has a glycopeptide structure and has a similar range of effects. There are two reports in the literature where teicoplanin was used to replace vancomycin. In the first, teicoplanin was used successfully in a patient that developed neutropenia associated with vancomycin and then developed a different infection later. In the second, teicoplanin was used on an adult patient during the same infection7-8.
With the results obtained from this patient, we have come to the conclusion that teicoplanin could be a suitable alternative in situations where vancomycin is used, and where it is necessary to monitor leukocyte counts as well as in children who develop neutropenia and must continue antibiotic treatment.

BİRİNCİ BÖLÜM
Genel Hükümler
Amaç
Madde 1 – Bu Yönetmeliğin amacı Türkiye Elektrik Kurumu dışındaki özel hukuk hükümlerine tabi yerli ve yabancı sermaye şirketlerine elektrik enerjisi üretim tesisi kurma ve işletme izni verilmesine dair esas ve usulleri belirlemektir.

Madde 2 – Bu Yönetmelik, Türkiye Elektrik Kurumu Dışındaki Kuruluşların Elektrik Üretimi, İletimi, Dağıtımı ve Ticareti ile Görevlendirilmesi Hakkında 3096 sayılı Kanunun 4 üncü maddesinde belirtilen sermaye şirketlerine (Üretim Şirketi) elektrik enerjisi üretim tesisi kurma, işletme ve Türkiye Elektrik Kurumu'na veya bölgede faaliyet gösteren görevli şirkete elektrik enerjisi satışına dair esasları kapsar.

İKİNCİ BÖLÜM
Üretim Tesisi Kurup İşletme İzni Verilmesine Dair Hükümler
İzin Verme Esasları
Madde 4 – Üretim tesisi kurup işletme izni aşağıda belirtilen esaslar gözönüne alınarak verilir.
a) Üretim tesisi Devletin genel enerji ve ekonomi politikasına uygun olacaktır.
b) Üretim tesisi kurma ve işletme sözleşmesi 99 yıla kadar süreli olabilir.
c) Üretim şirketi, yatırım programını, Bakanlığın onayladığı şekilde gerçekleştirmeyi taahhüd eder.
d) Üretim şirketi, kurup işlettiği tesisi sözleşme süresi sonuna kadar tesisin teknik ve ekonomik karakteristiklerine uygun olarak yenilemek zorundadır.
e) Üretim tesislerinin yıllık üretimlerini genel ekonomi düzeyinde Bakanlık planlar. Ulusal elektrik sisteminin emniyeti, stabilitesi ve değişen şartlara göre üretim planlamasının revizyonu Bakanlık adına TEK tarafından yapılır.TEK'in bu hususta aylık, haftalık, günlük ve saatlik süreleri kapsayan üretim programındaki değişikliklere üretim şirketleri süreleri aynen uyarlar.
f) (Değişik : 6/11/1998-98/11982 K.) Otoprodüktörlere, tesisin bulunduğu bölgeye bağlı olarak Türkiye Elektrik Üretim İletim Anonim Şirketi ve Türkiye Elektrik Dağıtım Anonim Şirketi ile görevli şirketin görüşü alınmak suretiyle Bakanlık tarafından üretim tesisi kurma ve işletme izni verilebilir.
g) (Değişik : 6/11/1998 - 98/11982 K.) Otoprodüktör veya otoprodüktör grubu şirketi, otoprodüktör statüsünde üretim tesisi kurup işletme izni almak amacıyla Bakanlığa başvurur.
Otoprodüktör grubunun bir defada teşekkül ettirilmesi ile otoprodüktör grubunu oluşturan ortakların müracaat aşamasında belirlenmesi ve Bakanlıkça onaylanması esastır. Otoprodüktör grubu şirketin kuruluş aşamasından sonra grubu oluşturan ortak sayısındaki ve grubun elektrik enerjisi ihtiyacını etkileyecek mahiyetteki ortaklık değişiklikleri Bakanlığın iznine tabidir. Üretilen enerjiyi kullanacak şirketlerin aynı şirketler grubu (aralarında resmi iştirak ilişkisi bulunan veya hissedarları aynı olan şirketler) veya holding bünyesinde olması halinde otoprodüktör grubu şirketi kurulması şartı aranmaz.

Otoprodüktör veya otoprodüktör grubu şirketlerin ürettiği ihtiyaç fazlası enerjiyi TEAŞ, TEDAŞ veya Görevli Şirketlere satıp, satmamasına bakılmaksızın enterkonnekte sisteme bağlantısı bulunması halinde şirket, "otoprodüktör statüsünde üretim tesisi kurulması, işletilmesi ve enerji fazlasının TEAŞ, TEDAŞ ve bağlı ortaklıkları veya görevli şirketlere satışına izin verilmesine ilişkin sözleşme"yi Bakanlık ile imzalar.
(Değişik : 29/9/2000 - 2000/1307 K.) Otoprodüktör ve/veya otoprodüktör grubu şirketlerin sahip oldukları sanayi tesisleri ile bin konutu aşan uydu kent yerleşim birimleri (rüzgar ve/veya güneş enerjisi elektrik üretim tesisleri için asgari bin konut şartı aranmaz), hastaneler, dört yıldızlı oteller ve tatil köyleri (rüzgar ve/veya güneş enerjisi elektrik üretim tesisleri için dört yıldız şartı aranmaz), organize sanayi bölgeleri, üniversite kampüsleri, belediyeler (çöp, çöp gazı vb. atıklar, biokütle, rüzgar ve/veya güneş enerjisi üretim tesisleri için) elektrik ihtiyaçlarının tamamını veya bir bölümünü kendi elektrik üretim tesislerinde güvenilir şekilde ve ekonomik olarak üretebilirler. Bunların yanı sıra kültür balıkçılığı tesisleri, kümes hayvanları üretim çiftlikleri, besicilik tesisleri, tarımsal sulama tesisleri elektrik ihtiyaçlarının tamamını veya bir bölümünü kendi rüzgar ve/veya güneş enerjisi elektrik üretim tesislerinde üretebilirler.
Ancak, toplam kurulu gücü 1500 kW ve daha az olan elektrik üretim tesisleri, üretilen enerjinin satışı ve nakli söz konusu olmamak, enerji aldığı kuruluşun olumlu görüşü alınmak ve proje onayı ile kabul işlemleri bakanlıkça yapılmak kaydıyla tesis edilerek işletmeye alınır.
Bu tür elektrik üretim tesislerinde üretilen enerji, üretildiği yerde tüketilmeyip TEAŞ/TEDAŞ, bunların bağlı ortaklıkları, dağıtım şirketleri ve/veya görevli şirketlere ait enerji iletim ya da dağıtım hatları üzerinden nakil yapıldıktan sonra tüketilecekse, Bakanlık ile Otoprodüktör Sözleşmesi ve TEAŞ/TEDAŞ, bunların bağlı ortaklıkları, dağıtım şirketleri ve/veya görevli şirketler ile Elektrik Satış Anlaşması (ESA) yapılır.”
Bu elektrik üretim tesisleri; sanayi tesisinin atık ısısı veya benzeri yan ürünlerinden yararlanan kombine çevrimli, gerekli buhar ihtiyacı, ara buharı veya egzos buharı ya da bunların karışımı biçiminde genel ısı çevrimi bilançosu verimi yükseltilerek karşılanan buhar çevrimli, hidroelektrik santral veya yenilenebilir enerji kaynakları (biyokütle, atıklar, rüzgar, güneş) ile çalışan enerji üretim tesisi mahiyetinde olabilir.
Otoprodüktör ve/veya otoprodüktör grubu olarak elektrik enerjisi elde etmek amacıyla kurulan tesisin atık ısısı var ise en geç 12 ay içerisinde değerlendirilir. Aksi halde tesis faaliyetten men edilir.
(Değişik : 18/5/2000 - 2000/743 K.) Otoprodüktör ve/veya otoprodüktör grubu şirketler faaliyet gösterdikleri bölge içerisinde TEAŞ, TEDAŞ, bağlı ortaklıkları veya görevli şirketler ile Enerji Satış Anlaşması imzalarlar. Otoprodüktör ve/veya otoprodüktör grubu şirketler TEAŞ, TEDAŞ, bağlı ortaklıklar veya görevli şirketler enerji alışverişi konusunda enerji mahsuplaşması yaparlar. Mahsuplaşılan enerji için taraflar Bakanlıkça belirlenen otoprodüktör enerji satış fiyatı üzerinden karşılıklı olarak fatura düzenlerler.
Rüzgar ve/veya güneş enerjisi üretim tesisleri ile rezervuarı olmayan hidroelektrik üretim tesislerinde (Bu Yönetmeliğin yürürlüğe giriş tarihinden önce işletmeye açılanlar da dahil olmak üzere) mahsuplaşma işleminde; cari ayda sisteme verilen elektrik (üretim), otoprodüktör veya otoprodüktör grubunca cari ayda sistemden çekilen elektrikten (tüketim) fazla ise, yapılacak bir protokol çerçevesinde bu fark fatura edilmeyip ertesi aya/aylara kWh olarak devredilir. Herhangi bir aydaki üretimin ilgili aydaki tüketimden az olması halinde ise eksik üretim evvelki aylardan devreden üretim fazlası ile kapatılır, kapatılamayan eksik üretim bir sonraki aya devredilmez. Ortaya çıkacak üretim fazlasına ait bedellerin hesap kesimi her takvim yılı 30 Haziran ve 31 Aralık itibarı ile yapılır.
h) (Değişik : 29/9/1997 - 97/10059 K.) Otoprodüktör ve/veya otoprodüktör grubu üretim tesisleri, ihtiyacının üzerinde üretilen elektrik enerjisinin satış fiyatı, enerji dağıtımı yapan kuruluşların ülke geneline nihai tüketiciye uyguladıkları ortalama enerji satış fiyatından fonlar ve paylar düşüldükten sonra kalan kısmın % 85'ini geçmeyecek şekilde Bakanlıkça belirlenir. Şirket ihtiyacının üzerindeki enerjiyi santralın enerji bağlantısını yaptığı kuruluşa satar.

i) (Ek : 14/7/1997 - 97/9670 K., Mülga; 6/11/1998 - 98/11982 K.) İmdat grubu kurup işletmek üzere yapılacak başvurular Bakanlık tarafından değerlendirilir. Uygun görülenlere izin verilir.
j) (Ek : 14/7/1997 - 97/9670 K, Değişik : 6/11/1998 - 98/11982 K.; Değişik birinci paragraf : 29/9/2000 - 2000/1307 K.) Otoprodüktör ve/veya otoprodüktör grubu şirketler ürettikleri elektrik enerjisini ortaklarına; TEAŞ, TEDAŞ ve bunların bağlı ortaklıkları ve/veya görevli şirketlerin iletim ve dağıtım tesislerinden yararlanmak üzere nakledebilirler.
Türk Silahlı Kuvvetlerini Güçlendirme Vakfının ortağı olduğu otoprodüktör grubu tarafından üretilecek enerjiden ihtiyaç kadarı ortaklık koşulu aranmaksızın Türk Silahlı Kuvvetleri teşekküllerine verilebilir.
Bu Yönetmeliğin yayımından önce faaliyet gösteren otoprodüktör ve/veya otoprodüktör grubu şirketlerin hakları saklıdır.
Başvuru ve Başvurunun Değerlendirilmesi
Madde 5 – 4/12/1984 tarihli ve 3096 sayılı Kanunun 4 üncü maddesine göre Bakanlığa yapılacak başvurularda gözönünde bulundurulacak hususlar:
a) İlk başvuruda bulunması gereken bilgiler,
1 – Kurulması teklif edilen üretim tesisinin karakteristik değerleri ve genel vaziyet planı,
2 – Ön rapor ve yatırımın tahmini gerçekleşme tarihi,
3 – Tesisin ne gibi araç, gereç ve teşkilatla gerçekleştirileceği,
4 – Tesisi işletmek istediği süre.
Birden fazla üretim tesisi için aynı yazı ile veya farklı zamanlarda aynı firma tarafından yapılacak başvurularda yukarıda belirtilen bilgiler her bir tesis için ayrı ayrı verilecek, ayrıca teklif edilen tesislerin öncelik sırasını gösteren bir zamanlama planı hazırlanacaktır. Bakanlık her bir tesisi ayrı birer başvuru gibi değerlendirecektir.
b) Bakanlık, ön rapor konusunda ilgili kuruluşların görüşlerini alır. Bakanlık görüşü olumlu olduğu takdirde, başvuru sahibi fizibilite raporunu Bakanlıkca öngörülen süre içerisinde hazırlayarak beş nüsha halinde Bakanlığa sunar.
Bakanlık, ayrıca teklif edilen tesisin bulunduğu yere bağlı olarak sonuç hakkında TEK'e veya ilgili görevli şirkete bilgi verir.
c) Aynı tesis için daha sonra başvuru olması halinde, başvuru sahibine fizibilite raporunu son teslim tarihinin ilk başvuru sahibine bildirilen tarih olduğu, hangi firmaların daha önce başvurduğu bildirilir, bir başka tesis için de başvurabilecekleri hatırlatılır.
d) Birden fazla başvurunun bulunduğu durumlarda tesisin ele alınması öngörülen tarih ve buna bağlı olarak gerçekleşme süresi, projenin ekonomisi, elektrik üretim maliyeti ve öngörülen satış fiyatı, firmanın mali yeteneği, tecrübesi, projeyi gerçekleştirmek için öngördüğü organizasyon gibi hususlarla birlikte firmanın seçilmesinde dikkate alınır.
e) Kamu kuruluşları yatırım programlarında yer alan tesislerle ilgili olarak alınacak teklifler için ilgili kamu kuruluşu ve Devlet Planlama Teşkilatının görüşü alınarak Bakanlık görüşü belirlenir.
Görüşün olumlu olması halinde başvuru sahibine, ilgili kamu kuruluşuyla işbirliği yaparak söz konusu tesisle ilgili, gerçekleşmiş ve gerçekleştirilecek yatırımı ortaya koyan ve başvuru sahibinin sorumluluğuna bırakılan işi içine alan, zamanlama planı, finansman durumu, organizasyon v.b. konularda bilgi veren raporu hazırlayarak Bakanlık tarafından belirlenecek süre içerisinde Bakanlığa göndermesi istenir.
Birden fazla başvuru olması halinde daha önceki maddelerde belirtilen hükümler uygulanır.

f) Aynı yer için birden fazla fizibilite raporunun alındığı durumlarda, Bakanlık ve ilgili kuruluş temsilcilerince yapılacak öndeğerlendirme sonucu en uygun teklifin seçilmesi amacıyla Bakanlık Müsteşarının başkanlığında ilgili müsteşar yardımcısı, ilgili daire başkanı ve ilgili kuruluş genel müdürlerinden oluşan en az beş kişilik bir "Teklif Değerlendirme Kurulu" oluşturulur. Kurul ilgili daire başkanının teklifi ile ve gerek duyuldukça toplanır.
g) Bakanlık, yerli ve yabancı sermaye şirketlerince ele alınmasını uygun gördüğü üretim tesislerini Resmi Gazete ile Kamu oyuna duyurarak bu tesisler için başvuruda bulunulmasını sağlayabilir. Söz konusu tesisler için alınacak başvurular bu Yönetmelik hükümlerine göre işlem görür.
h) Üretim tesislerine ait fizibilite raporları EK: 1'de verilen esaslara göre düzenlenir.
Fizibilite Raporundan Sonraki Çalışmalar
Madde 6 – (Değişik : 4/4/1996 - 96/8007 K.)
Bakanlık, Türkiye enerji planlaması ve politikaları yönünden, Devlet Planlama Teşkilatı Müsteşarlığı'nın görüşünü aldıktan ve üretim şirketinin kuruluşuna dair belgenin ibrazından sonra üretim tesisi kurma ve işletme izni verir ve taraflar arasında "Üretim Tesisi Kurma ve İşletme Sözleşmesi"aktedilir.
ÜÇÜNCÜ BÖLÜM
Denetim
Bakanlığın Denetim Yetkisi
Madde 7 – Üretim şirketlerinin görev alanlarıyla ilgili faaliyetleri bütün aşamalarda Bakanlık tarafından denetlenebilir. Denetimler sonucu tesbit edilen aksaklıklar ilgili şirket tarafından gecikmeye meydan verilmeden giderilir.
Bakanlık uyarılarına uymayan üretim şirketlerine uygulanacak yaptırımlar ve sözleşmenin feshine gidilmesini gerektiren durumlar sözleşmede yer alır.
DÖRDÜNCÜ BÖLÜM
Elektrik Enerjisi Satış Tarifesi
Tarife
Madde 8 – a) Üretim şirketlerinin elektrik enerjisi satış tarifeleri bu maddenin (b) bendindeki esaslar gözönüne alınarak adı geçen şirketlerce düzenlenir. Bakanlıkça onaylandıktan sonra yürürlüğe girer.
b) Tarifenin tesbitinde;
1 – İşletme ve bakım giderleri (yakıt, malzeme, personel, vergi, amortisman, diğer giderler)
2 – Yatırımlar için ödenen faiz ve kur farkları,
3 – Sermayenin yeniden değerlendirilmesi, piyasa şartlarına göre makul bir temettü verilmesi,Türkiye Elektrik Kurumunun benzer tesislerden aldığı fiyatlar,

4 – Bu oranlar gerektiğinde Bakanlar Kurulu Kararı ile değiştirilmek kaydıyla, hidroelektrik santrallar için % 10, termik santrallar için % 5 oranında ayrılacak ve satış bedelinden tenzil edilerek TEK veya görevli şirket tarafından Kamu Ortaklığı Fonu'na yatırılacak Kamu Ortaklığı Fonu payı,
5 – Kanuni ihtiyatlar,
gözönünde bulundurulur.
Satış Fiyatı
Madde 9 – (Değişik : 4/4/1996 - 96/8007 K.)
Elektrik enerjisi satış fiyatlarının belirlenmesinde ekonomik kaynak seçimine yardımcı olmak ve ülke ekonomisine sunulan elektrik enerjisi fiyatlarını olumsuz yönde etkilememek esas alınacaktır.
BEŞİNCİ BÖLÜM
Çeşitli Hükümler
Üretim Yetkisinin Sona Ermesi
Madde 10 – Üretim yetkisi süresinin sonunda üretim şirketleri verilmiş olan iznin konusuna giren tüm tesisler ile tüm taşınmaz malları bunlar üzerindeki haklarla birlikte tam ve çalışır vaziyette ve her türlü borç ve yükümlülükten arındırılmış olarak, Bakanlar Kurulunca kamu kuruluşuna hiç bir bedel ve hak talep edilmeksizin veya yeniden aynı üretim şirketine yeni şartlarla verilir.
Devir yapılacak tesisin işletmesi sırasında gerekli görülen ve Bakanlıkça onaylanarak gerçekleştirilen "idame ve yenileme yatırımları"nın geri ödenmesi, devir esnasında henüz tamamlanmamış ise, tesisi devir alan kamu kuruluşu, ödenmemiş kısmı, belirlenecek bir plana göre geri ödemeyi taahhüt eder.
Kamulaştırma
Madde 11 – Üretim şirketlerinin yapacağı üretim tesislerinin onaylanmış tatbikat projelerine göre, kamulaştırma ihtiyacı ortaya çıktığında, kamulaştırma bedeli şirket tarafından ödenmek kaydıyla Bakanlıkça, 2942 sayılı Kamulaştırma Kanunu hükümlerine göre, kamulaştırma yapılır.
Çok Maksatlı Hidroelektrik Santral Tesisleri
Madde 12 – Çok maksatlı hidroelektrik santral projelerinde maksat taksimi ve yapılmış yatırımların geri ödemesi EK: 2'de belirtilen esaslara göre yapılır.
Fizibilite Raporları ile Kesin Projelerin Satışı
Madde 13 – Kamu kurum ve kuruluşlarınca hazırlanmış olan fizibilite raporları ile kesin projelerin üretim şirketlerine satışı EK: 3'de belirtilen esaslara göre yapılır.

Bu Yönetmelikte geçen "TEK" ibaresi ilgisine göre "TEAŞ ve/veya TEDAŞ" olarak anlaşılacaktır.
Ek Madde 2 – (Ek : 4/4/1996 - 96/8007 K.)
Otoprodüktör enerji üretim santralında üretilen enerjinin otoprodüktör veya otoprodüktör grubu ortaklarına iletim ve dağıtım kuruluşlarının hatlarının kullanılarak nakledilmesi halinde, iletimde nakil bedeli olarak kuş uçuşu 100 km'ye kadar olan mesafelerde nakledilen miktarın %3'ü, daha sonraki her 100 km için %1.5'u ilave ve 600 km'den daha uzak mesafeler için sabit değer olmak üzere %10.5'u,dağıtımda ise mesafeye bakılmaksızın nakledilen enerjinin %6.5'u oranında nakil bedeli alınır.Otoprodüktör üretim grubu şirketi kurarak enerjisini grubundaki ortaklarına naklettirmek isteyen şirketlerin elektrik enerjisini (hangi gerilim seviyesinde olursa olsun) TEAŞ,TEDAŞ ve bağlı ortaklıkları ve/veya görevli şirketler alır ve naklederler.

Enerji nakli hususuna ilişkin olarak güzergah, mesafe, sayaç okuma, faturalama v.b. konular TEAŞ,TEDAŞ ve bağlı ortaklıkları ile görevli şirketlerin birlikte belirleyecekleri uygulama protokolünde yer alacaktır. Nakil bedeli otoprodüktör grubu ortağının bağlı olduğu bölgedeki dağıtım şirketinin uygulamakta olduğu tek terimli sanayi tarifesi esas alınarak hesaplanır.
(Ek : 6/11/1998 - 98/11982 K.) Rüzgar ve/veya güneş enerjisi ile çalışan elektrik üretim tesisi kurulacak olan otoprodüktör veya otoprodüktör grubu şirketlerden, kendisinin ve/veya ortaklarının elektrik enerjisi ihtiyacını karşılamak amacıyla TEAŞ,TEDAŞ, bağlı ortaklık ve/veya görevli şirketlerin iletim ve/veya dağıtım hatlarını kullanmaları halinde, ticari işletme tarihinden itibaren ilk beş yıl için geçerli olmak üzere birinci fıkrada belirtilen nakil bedellerinin %50'si alınır.

Bu Yönetmeliğin yürürlüğe girmesinden önce Bakanlıkça rüzgar ve/veya güneş enerjisi üretim tesisi kurma ve işletme izni verilen ve/veya işletmeye geçen otoprodüktör şirketlerden de kendisinin ve/veya ortaklarının elektrik enerjisi ihtiyacını söz konusu tesislerden karşılamak amacıyla TEAŞ, TEDAŞ, bağlı ortaklık ve/veya görevli şirketlerin iletim ve/veya dağıtım hatlarını kullanmaları halinde, bu Yönetmeliğin yürürlüğe girdiği tarihten itibaren beş yıl süreyle geçerli olmak üzere birinci fıkrada belirtilen nakil bedellerinin %50'si alınır.
Geçici Madde 1 – (Ek : 29/9/2000 - 2000/1307 K.)
Rüzgar, motorin, nafta ve LPG ile elektrik üreten otoprodüktör ve/veya otoprodüktör gruplarının üretim tesislerinde, otoprodüktör ya da otoprodüktör grubu ihtiyacının üzerinde üretilen elektrik enerjisinin satış fiyatı, 31/3/2002 tarihine kadar uygulanmak üzere, projenin genel işletme giderleri ile ülkenin enerji ihtiyacı gözönüne alınmak suretiyle enerji dağıtımı yapan kuruluşların ülke genelinde nihai tüketiciye uyguladıkları ortalama enerji fiyatından fonlar ve paylar düşüldükten sonra kalan kısmın % 100 (yüzde yüz)’ünü geçmeyecek şekilde Bakanlıkça belirlenir. Şirket, ihtiyacının üzerinde ürettiği elektrik enerjisini santralin enerji bağlantısını yaptığı kuruluşa satar.
Ayrıca, otoprodüktör ya da otoprodüktör gruplarının üretim tesislerinde atıl bulunan enerji üretim kapasitelerinin ulusal sisteme kazandırılmasına yönelik olarak teşvik edilmesi suretiyle, ülkemizin şu an içerisinde bulunduğu enerji darboğazının aşılabilmesini teminen, petrol ve diğer yakıt fiyatlarındaki değişmeler neticesinde, yakıt ve işletme giderleri maliyeti, yukarıda tanımlanan % 100 (yüzde yüz) katsayısına tekabül eden otoprodüktör enerji satış fiyatını aşması halinde, aradaki fark Bakanlıkça tespit edilir ve şirkete, enerjisini sattığı kuruluş tarafından ödenir. Bu uygulama 31/3/2001 tarihinde sona erer.

1 – Fizibilite raporu, tesisin kesin yapılabilirliğini ortaya koyan gerçek, güvenilir ve yeterli teknik ve ekonomik verilere dayanılarak hazırlanacaktır.
2 – Fizibilite raporunda, tesisin öngürülen program ve plana göre tamamlanması amacıyla,projenin özellikleri dikkate alınarak bir "Proje Danışma Kurulu"nun kurulması önerilebilir. Öneri Bakanlık tarafından uygun görüldüğü takdirde Kurul'un kurulmasına karar verilir.
3 – Hidrolik, linyit, taşkömürü, doğal gaz, sıvılaştırılmış doğal gaz veya petrol gazı, petrol ürünleri, Jeotermal, nükleer, güneş, rüzgar ve diğerleri gibi enerji kaynaklarına dayalı olarak elektrik enerjisi üretmek için yukarıda belirtilen fizibilite raporu örneğinden farklı özel fizibilite raporu düzenlemek isteyen başvuru sahibinin bu iş için Bakanlık'tan müsaade alması gerekir.
4 – Fizibilite raporunun hazırlanması sırasında, Bakanlık müracaat sahibinin işlerini aksatmayacak şekilde çalışmaları takip edebilir. Müracaat sahibi, Bakanlık elemanlarına gerekli bilgileri vermek ve yardım etmekle yükümlüdür.
5 – Fizibilite raporunda yer alacak ilave bilgiler;
– Elektrik enerjisi üretiminde yararlanılacak enerji kaynağının nereden temin edileceğini gösteren yasal belgelerin birer örneği, Termik santrallarda hammadde bedeli aynı karakterdeki Türkiye Elektrik Kurumu İşletmelerindeki bedelden fazla olamaz.
– Firmanın mali yeteneği, iç para, dış para, öz kaynak, öz kaynak artırım planı, kredi vermeyi uygun görecek banka niyet mektupları v.b. ve bunları tevsik eden belgelerin birer örneği.

1 – Fizibilite raporu, tesisin kesin yapılabilirliğini ortaya koyan gerçek, güvenilir ve yeterli teknik ve ekonomik verilere dayanılarak hazırlanacaktır.
2 – Fizibilite raporunda, tesisin öngörülen program ve plana göre tamamlanması amacıyla, projenin özellikleri dikkate alınarak bir "Proje Danışma Kurulu" nun kurulması önerilebilir. Öneri Bakanlık tarafından uygun görüldüğü takdirde Kurul'un kurulmasına karar verilir.
3 – Hidrolik, linyit, taşkömürü, doğal gaz, sıvılaştırılmış doğal gaz veya petrol gazı, petrol ürünleri, jeotermal, nükleer, güneş, rüzgar ve diğerleri gibi enerji kaynaklarına dayalı olarak elektrik enerjisi üretmek için yukarıda belirtilen fizibilite raporu örneğinden farklı özel fizibilite raporu düzenlemek isteyen başvuru sahibinin bu iş için Bakanlık'tan müsaade alması gerekir.
4 – Fizibilite raporunun hazırlanması sırasında, Bakanlık müracaat sahibinin işlerini aksatmayacak şekilde çalışmaları takip edebilir. Müracaat sahibi, Bakanlık elemanlarına gerekli bilgileri vermek ve yardım etmekle yükümlüdür.
5 – Fizibilite raporunda yer alacak ilave bilgiler:
– Elektrik enerjisi üretiminde yararlanılacak enerji kaynağının nereden temin edileceğini gösteren yasal belgelerin birer örneği, Termik santrallarda hammadde bedeli aynı karakterdeki Türkiye Elektrik Kurumu İşletmelerindeki bedelden fazla olamaz.
– Firmanın mali yeteneği, iç para, dış para, öz kaynak, öz kaynak artırım planı, kredi vermeyi uygun görecek Banka niyet mektupları v.b. ve bunları tevsik eden belgelerin birer örneği.

ÇOK MAKSATLI HİDROELEKTRİK SANTRAL PROJELERİNDE MAKSAT
TAKSİMİ VE YAPILMIŞ YATIRIMLARIN GERİ ÖDENMESİ ESASLARI
Elektrik enerjisi üretimi söz konusu olan çok maksatlı projelerde her maksada ait gider bölüştürmesinde uygulanacak metot, hesap metotlarında kullanılacak verilerin her proje için tam ve doğru olarak sağlanamaması veya her pojenin karakterine göre kullanılan metotların farklı sonuçlar vermesi de dikkate alınarak, çok maksatlı projenin karakterine ve veri durumuna göre DSİ tarafından tesbit edilir.
Bu tesbit, fizibilite çalışmaları sırasında ve 6. maddede belirtilen metotlardan birisi seçilerek yapılır ve fizibilite raporu bu esasları kapsar.
Madde 1 – Şirket fizibilite raporunu, gider bölüştürmesi için tesbit edilen metodu kullanarak hazırlar.
Ancak, gider bölüştürmesi işlemlerinin tamamlanmasından sonra, Şirketin teklifi üzerine, Bakanlık ve ilgili kurumlar ve Şirketin temsilcilerinden kurulu bir komisyon; gider bölüştürmesi işlemlerini tetkik eder ve üzerinde ilgililerin mutabakatını sağlar. Fizibilite raporu bu mutabakata uygun olarak sonuçlandırılır.
Madde 2 – Yapım tamamlandıktan sonra Madde 1'de öngörülen usule göre Bakanlıkça teşekkül ettirilen bir komisyon gider bölüştürmesi işlemlerini kesin giderlere ve Madde 15'deki esaslara göre düzeltir. Bu işlemde yeniden yüzdeler aranmaz, ortak gider daha önce bulunan yüzdeler oranında bölüştürülür.
Ancak, fizibilite raporunun hazırlanmasından tesisin kurularak işletmeye geçtiği tarihe kadar geçen süre içerisinde maksat yüzdelerini etkileyebilecek önemli değişiklikler olması halinde ilgili Kurum ve Şirket gider bölüştürmesi işlemlerinin yapılmasını Bakanlıktan isteyebilirler. Bakanlık gerekli gördüğü takdirde gider bölüştürmesi işlemleri yeni verilere ve kesin giderlere göre yapılarak maksat yüzdeleri yeniden bulunur. Ortak gider bu yeni yüzdelere göre maksatlara bölüştürülür.
Madde 3 – Gider bölüştürmesi hesabında her maksat için aynı faiz yüzdesi uygulanır ve bu faiz yüzdesi Bakanlıkça tesbit edilir.
Madde 4 – Çok maksatlı projelerin fizibilite safhasında ilgili Kurumlar ve Şirket gider bölüştürmesi konusunda sürekli işbirliği yaparak veri alışverişini ve varılacak sonuçların dayandığı ana kriterler hakkında görüş birliğini sağlarlar.

Madde 5- Elektrik enerjisi üretimi de söz konusu olan çok maksatlı projelerde her bir maksada düşen maliyet bedelleri aşağıdaki metotların birisi uygulanarak bulunur.

SECTION ONE
General Provisions
Purpose
Article 1 – The purpose of this Directive is to specify the principles and procedures for issuing permission to build and operate electricity generation facilities to domestic and foreign capital companies subject to the provisions of civil law but does not include TEK (Turkish Electrcity Agency).
Scope
Article 2 –This Directive covers principles related to the capital companies (Production Company) specified in article 4 of Law 3096 Regarding Commissioning for Electricity Production, Transmission, Distribution and Sales by Entities Other than the Turkish Electricity Agency (TEK) as well as building and operating electricity generation facilities and sales of electricity to the Turkish Electricity Agency or a commissioned company operating in the region.
Definitions
Article 3 – (Amendment: 4/4/1996 – 96/8007 K.)
In this Directive, terms are defined as follows:

Production Company : A capital company which has been given permission to produce electricity by the Ministry in accordance with article 4 of Law 3096 dated December 4, 1984.

Production facility : The facilities and integrated facilities which produce electric energy,
Agreement for Building and Operating a Production facility: The agreement drawn up in accordance with the provisions of Law 3096 between the Ministry and the Company that will build and operate the production facility
Autoproducer : Corporate entities that meet the conditions set forth in subsection (g) of article 4 of this Directive and which build production facilities in order to meet the need for electricity in their own area of operation.
Autoproducer Group : A group of corporate entities that meet the conditions set forth in subsection (g) of article 4 of this Directive and which build production facilities in order to meet the need for electricity in their own area of operation.
Emergency Groups : Electrical equipment used to prevent loss of life or assets and used only during electrical outages.
SECTION TWO
Provisions Regarding the Granting of Permission for Building and Operating Production Facilities
Principles for Granting Permission
Article 4 – Permission for building and operating production facilities shall be granted by taking the following principles into consideration.
a) The production facility must conform to the State’s general energy and economic policies.
b) The agreement pertaining to building and operating a production facility can have a term of up to 99 years.
c) The production company agrees/pledges to realize the investment program as approved by the Ministry.
d) The production company is required to make modernize the facility it builds and operates in a manner appropriate to the technical and economic characteristics of the facility until the agreement expires.
e) The Ministry shall plan the annual production levels of power plants at the level of the overall economy. TEK shall revise the production plans on behalf of the Ministry for the security of the national electric system, its stability and changing conditions. Production companies are obligated to conform to changes in the TEK production plan which covers monthly, weekly, daily and hourly time periods in this regard.
f) (Amendement : November 6, 1998-98/11982 K) Autoproducers may be given permission to build and operate production facilities by the Ministry provided that jit receives the opinions of the commissioned company and of the Turkish Electricity Distribution A.Ş. (TEDAŞ) and Turkish Electricity Production Transmission A.Ş. (TEÜİAŞ) in the region where the facility is located.
g) (Amendement : November 6, 1998 - 98/11982 K) The Autoproducers or Autoproducer group company shall make an application to the Ministry to receive permission to build and operate production facilities with the status of an autoproducer.
It is essential that the autoproducer group be formed (only) once, that the partners that form the autoproducer group be specified when the application is made and that it be approved by the Ministry. After the autoproducer group company is established, changes to the partnership (structure) in terms of the number of partners the group is composed of or issues that affect the group's need for electricity are subject to Ministry approval. If the companies that will use the energy generated are members of the same group of companies (companies which have an official affiliate relationship or whose shareholders are the same) or are part of a holding, there is no requirement that an autoproducer group company be established.

Regardless of whether the autoproducer or autoproducer group companies sell electricity they generate and which exceeds their needs to TEAŞ, TEDAŞ or Commissioned Companies, if it has a connection to the interconnected (grid) system, it shall sign an agreement with the Ministry “regarding the granting of permission for building and operating production facilities with the status of an autoproducer, and for the sale of excess electricity to TEAŞ, TEDAŞ, corporate affiliates or commissioned companies.
(Amendment : October 29, 2000 – 2000/1307 K.) Suburban residential complexes with more than 1000 units (the minimum requirement of 1000 units does not apply to wind and/or solar powered electricity production facilities), hospitals, four-star hotels and holiday villages (the four-star requirement does not apply to wind and/or solar powered electricity production facilities), organized industrials zones, university campuses and municipalities can generate all or part of their electricity power needs in their own electricity production facilities in a safe and economic manner with the industrial facilities owned by autoproducer and/or autoproducer group companies. In addition to these, fish culture facilities, poultry production farms, livestock fattening facilities and agricultural irrigation facilities can generate all or part of the electrical power needs in their own wind and/or solar energy powered electricity production facilities.
However, electrical power generation facilities with an installed capacity of 1500 kW or less may be constructed and put into operation provided that there is no sale or transmission of the electricity produced and by receiving a positive opinion from the entity it purchased electricity from as well as having the project approval and acceptance procedures done by the ministry.
If electricity produced in this type of power generation facility is to be consumed after being delivered via electricity transmission or distribution lines belonging to TEAŞ/TEDAŞ, their affiliates, distribution companies and/or commissioned companies, an Autoproducer Agreement will be concluded with the Ministry and an Electricity Sales Agreement (ESA) will be concluded with TEAŞ/TEDAŞ, their affiliates, distribution companies and/or commissioned companies.
These electrical power production facilities can be power generation facilities that work with hydroelectric power, renewable energy resources (biomass, waste, wind, solar) or steam that uses byproduct heat from industrial facilities or similar byproducts, required steam need (sic), intermediate steam or exhaust steam or general heat power that uses a combination of these to increase efficiency.
If a facility built for the purpose of producing electricity as an autoproducer and/or autoproducer group uses byproduct heat, it must be utilized within 12 months. Otherwise the facility will be banned from operation.
(Amendment : May 18, 2000 – 2000/743 K.) Autoproducers and/or autoproducer group companies shall sign an Electricity Sales Agreement with TEAŞ, TEDAŞ, affiliates or commissioned companies in the region where the company has operations. Autoproducers and/or autoproducer group companies shall make reciprocal energy deductions from each other’s accounts with regard to energy sales with TEAŞ, TEDAŞ, its affiliates or commissioned companies. The parties shall issue invoices to each other for the deducted energy at the autoproducer electricity sales price specified by the Ministry.
With regard to the reciprocal deduction procedure, in hydroelectric power generation facilities without a reservoir and wind and/or solar powered production facilities (including those which began operations before the effective date of this Directive), if the electricity transferred to the system in the current month (production) is greater than the electricity withdrawn from the system (consumption), an invoice will not be issued for the difference rather it will be transferred to subsequent month(s) as KWh within the framework of a protocol that will be drawn up. In the event that production in any given month is less than consumption in that same month, then the lack of production will be made up for by excess production from previous months. Lack of production that cannot be covered may not be transferred to the subsequent month. Calculation of the price of any excess production that occurs shall take place on June 30th and December 31st.
h) (Added : October 29, 1997 - 97/10059 K.) The sales price of electrical power produced by autoproducers and/or autoproducer group production facilities exceeding their own needs shall be determined by the Ministry and shall not exceed 85% of the average sales price of electricity that electricity distribution institutions charge the end consumer throughout the country after taxes and fees are deducted. The company shall sell energy that exceeds its own needs to the institution that the power plant has a power connection to.

i) (Added : July 14, 1997 - 97/9670 K., Abrogated; November 6, 1998 - 98/11982 K.) Applications for installing and operating emergency equipment shall be evaluated by the Ministry; permission shall be granted if the applications are deemed appropriate.

Autoproducers and/or autoproducer group companies may transfer the electricity that they produce to their affiliates by taking advantage of the transmission and distribution facilities of TEAŞ, TEDAŞ and their affiliates and/or commissioned companies.
Electricity produced by an autoproducer group whose shareholders include the Foundation for the Strengthening of the Turkish Armed Forces can be provided to enterprises of the Turkish Armed Forces and the shareholder/partner condition will not apply.
The rights of autoproducers and/or autoproducer group companies that were operating before this Directive was published shall be reserved.
Application and Evaluation of Application
Article 5 – According to article 4 of Law 3096 dated December 4, 1984, the following will be considered in applications made to the Ministry:
a) Information that must be provided in the initial application,
1 – Characteristic values and a general layout of the production facility being proposed,
2 – Preliminary report and a forecast for the completion of the investment,
3 – What kind of vehicles, equipment and organization will be used to complete the facility,
4 – The period of time it wants to operate the facility.
The information specified above shall be provided separately for each facility in applications made by the same company for more than one production facility whether it is made at the same time or different times. Furthermore, a schedule shall be prepared that shows priority for the different proposed facilities. The Ministry shall evaluate each facility as a separate application.
b) The Ministry shall obtain the opinions of concerned institutions regarding the preliminary report. If the Ministry evaluation is positive, the applicant shall prepare a feasibility report in the time specified by the Ministry and submit this to the Ministry in five copies.
The Ministry shall also inform TEK or the concerned commissioned company regarding the results depending on where the proposed facility is located.
c) If a subsequent application is received for the same facility, the applicant shall be informed of which companies have already applied and shall be notified that the deadline is the date given to the applicant who submitted the feasibility report, reminding them that they can apply for a different facility.
d) In situations where there is more than one application, the following issues shall be taken into consideration when choosing a company : the predicted date for beginning the project and the amount of time required to complete it, project cost, cost of electrical power generation and predicted sales price, company's financial status, experience and the organization that it requires to complete the project.
e) For proposals to be submitted for facilities included in the investment programs of public institutions, the Ministry's position shall be determined by consulting the concerned public institution and the State Planning Organization.
If a positive view is taken, then the applicant will be asked to cooperate with concerned public institutions regarding the facility in question, prepare a report that outlines the investment made or to be made and provides information on issues such as financials status, organization, a timeline, etc. for the job the applicant is responsible for. This report will be sent to the Ministry within the timeframe the Ministry specifies.
In the event that there is more than one application, the provisions in the previous articles shall apply.

f) In situations where more than one feasibility report is received for the same location, a "Proposal Evaluation Committee” chaired by the Undersecretary of the Ministry consisting of at least 5 persons, including the relevant Assistant Undersecretary, the relevant Agency Head and general managers of concerned institutions shall be formed in order to choose the best proposal after a preliminary evaluation to be performed by the Ministry and representatives of concerned institutions. The committee shall meet as required upon a proposal by the concerned Agency Head.
g) The Ministry shall inform the public about production facility it deems appropriate for domestic and foreign capital companies via the Official Gazette to ensure that there are applications for this facilities. Applications received for these facilities shall be processed in accordance with the provisions of this Regulation.
h) Feasibility reports for the production facilities shall be drawn up in accordance with the principles outlined in Attachment 1.
Work to be Carried Out After the Feasibility Report
Article 6 – (Amendment: April 4, 1996 – 96/8007 K)
The Ministry shall grant permission to build and operate production facilities after documents consulting with the Office of the State Planning Organization Undersecretary regarding Turkey’s energy planning and policies and after a document has been submitted showing that the production company has been established. A "Production Facility Construction and Operation Agreement” shall be concluded between the parties.
SECTION THREE
Inspection
The Ministry's Inspection Authority
Article 7 – The activities of the production company in its duty areas may be inspected by the Ministry at any stage. Problems identified during the inspection shall be resolved by the company in question without delay.
Sanctions to be imposed on production companies that do not conform to the warnings of the Ministry and situations that require the annulment of the contract are specified in the contract.
SECTION FOUR
Fee Schedule for the Sale of Electricity
Fee Schedule
Article 8 – a) The fee schedule for the Sale of Electricity shall be drawn up by the companies in accordance with the principles in subsection (b) of this article. It will become effective after being approved by the Ministry.
b) The following shall be taken into account when establishing the fee schedule:
1 – Maintenance and operating expenses (fuel, materials, personnel, taxes, amortization and other expenses)
2 – The interest and currency exchange rate differences paid on the investment,
3 – Reinvestment of capital, reasonable dividend distribution according to market conditions and the prices that TEK receives from similar facilities.

4- Although these ratios may be changed as necessary with a Council of Ministers Ruling, they shall be 10% for hydroelectric power plants and 5% for thermal power plants. It shall be deducted from the sales price and Public Partnership Fund tax shall be deposited into the Public Partnership Fund by TEK or the commissioned company.

Sales Price
Article 9 – (Amendment: April 4, 1996 – 96/8007 K)
The guiding principles in determining electric power sales prices shall be avoidance of a negative impact on the price of electricity available to the national economy and facilitating the choice of economic resources.
SECTION FIVE
Various provisions
Termination of Production Authority
Article 10 – When the production permission expires, the Council of Ministers shall assign all the facilities and property which is included in the scope of the permission given to the production company together with all accompanying rights, with the facilities complete and in working order and free from all debt and obligation, without requesting any payment or rights to a public institutions or to the same production company under new conditions.
If repayment of “maintenance and replacement investments” carried out with the approval of the Ministry and deemed necessary for the operation of the facility to be transferred has not been completed by the time the transfer is carried out, the public institution which receives transfer of the facilities pledges to repay the unpaid portion according to a repayment plan which will be specified.
Expropriation
Article 11 – When production facilities to be built by the production companies need to do expropriation according to the approved field projects, expropriation shall be carried out by the Ministry according to the provisions of Expropriation Law 2942 on the condition that the expropriation fee be paid by the company.
Multi-Purpose Hydroelectric Power Plant Facilities
Article 12 – repayment for completed investments and purpose allocation for multi-purpose hydroelectric power plant facilities shall be conducted in accordance with the principles specified in Attachment 2.
Feasibility Reports and Final Project Sales
Article 13 – Feasibility reports prepared by public agencies and institutions and the sale of final projects to production companies shall be conducted in accordance with the principles outlined in Attachment 3.
Basis
Article 14 – This Directive has been prepared according to article 10 of Law 3096 Regarding Commissioning of Institutions Other Than the Turkish Electricity Agency (TEK) for the Production, Transmission, Distribution and Sales of Electricity.
Additional Article 1 – (Added on: April 4, 1996 – 96/8007 K.)
The reference to “TEK” in this Directive may be understood to be “TEAŞ and/or TEDAŞ” as is appropriate.
Additional Article 2 – (Added on: April 4, 1996 – 96/8007 K.)
If electricity produced in an autoproducer power plant is transmitted to the autoproducer or autoproducer group partners using lines belonging to transmission or distribution institutions, the transfer fee for transmission shall be 3% of the amount transmitted for distances up to 100 km as the crow flies, an additional 1.5% for each 100 km after that and a fixed fee of 10.5% for distances greater than 600 km; the transfer fee in distribution shall be 6.5% of the amount of electricity transferred regardless of the distance. TEAŞ, TEDAŞ and its affiliates and/or commissioned companies shall take and transmit electricity (regardless of the voltage levels) from companies that establish autoproducer production group companies and want to transmit this electricity to group partners.

The application protocol that will be drawn up by TEAŞ, TEDAŞ and its affiliates and commissioned companies shall include issues related to electricity transfer such as route, distance, meter reading, invoicing, etc. Transfer fees will be calculated based on the single rate industrial fee schedule used by the distribution company in the region where the autoproducer group partner is found.
(Addition : November 6, 1998 – 98/11982 K.) If autoproducers or autoproducer group companies that will build an production facility powered by solar or wind energy use (either themselves and/or their partners) the transmission and/or distribution lines of TEAŞ, TEDAŞ, its affiliates and/or commissioned companies for the purpose of meeting its electrical power needs, 50% of the transfer fees specified in the first clause shall be paid for the first five years after the beginning of commercial operations.
(Addition : November 6, 1998 – 98/11982 K.) If autoproducers or autoproducer group companies that have been granted permission by the Ministry to build and operate production facilities powered by solar or wind energy or those who have begun operations before this Directive takes effect use (either themselves and/or their partners) the transmission and/or distribution lines of TEAŞ, TEDAŞ, its affiliates and/or commissioned companies for the purpose of meeting its electrical power needs from the facilities in question, 50% of the transfer fees specified in the first clause shall be paid for the first five years after this Directive goes into effect.
Temporary Article 1 – (Added : September 29, 2000 – 2000/1307 K.)
In production facilities of autoproducers and/or autoproducer groups that produce electricity with wind energy, diesel, naphtha or LPG, the sales price of electricity produced by the autoproducer or autoproducer group which exceeds its needs shall be determined by the Ministry, taking into account the country’s energy needs and the project’s general operating costs after deducting taxes and fees from the average price of electricity applied to end consumers throughout the country by companies engaged in electricity distribution and shall in no wise exceed 100% of this amount. The company shall sell electrical power that exceeds its needs to the institution that provides the connection to the power plant.
Furthermore, if fuel and operating costs exceed the autoproducer electricity sales price equivalent to the 100% ratio defined above because of fluctuations in the price of petroleum and other fuels, the difference shall be determined by the Ministry and the company shall be paid by the institution to which it sells electricity in order to overcome the electricity bottleneck currently faced by our country and to give incentives for including idle electricity production capacity in autoproducer or autoproducer group facilities into the national system (grid). This practice shall end on March 31, 2001.
Effective Date
Article 15 – This Directive shall go into effect upon publication.
Enforcement
Article 16 – This Directive shall be enforced by the Ministry of Energy and Natural Resources.

E X P L A N A T I O N S
1 – The feasibility report shall be prepared based on technical and economic data that is real, reliable and adequate and which demonstrates that the facility is really doable.
2 - The feasibility report may recommend that a “Project Consultation Committee” be formed to examine the project characteristics so that the facility is completed in accordance with the forecast plan and program. If the recommendation is deemed appropriate by the Ministry, a ruling will be issued for the formation of the committee.
3 – If an applicant wishes to draw up a special feasibility report that is different from the sample feasibility report given above for the purpose of generating electrical power from energy sources such as hydroelectric, lignite, coal, natural gas, liquefied natural gas or petroleum gas, petroleum products, geothermal, nuclear, solar, wind or other types of energy, then permission must be obtained from the Ministry.
4 – During the preparation of the feasibility report, the Ministry may monitor the job as long as it does not disrupt the work of the applicant. The applicant is responsible for providing Ministry officials with the necessary information and assisting them.
5 – Additional information that will be included in the feasibility report:
- A copy of each of the legal documents that shows where the energy which will be used to produce electricity will be obtained, the cost of raw materials in thermal power plants cannot be more than the cost of those used in identical TEK Enterprises.
- One copy each of the company's financial status, internal financing, external financing, equity capital, equity capital expansion plan, letters of intent from banks that will be willing to make loans and incentive documents.

PRINCIPLES REGARDING REPAYMENT FOR INVESTMENTS COMPLETED ON MULTI-PURPOSE HYDROELECTRIC POWER PLANT FACILITIES AND ON PURPOSE ALLOCATION
In multi-purpose projects involving production of electrical power, the method to be applied in the division of expenses for each purpose shall be determined by DSI (State Water Works) according to the nature of the multi-purpose project and the information available but taking into consideration whether the data to be used in calculations for each project is accurate and complete and whether the methods employed produce different results according to the characteristics of each project.
This determination shall be made by choosing one of the methods specified in article 6 during the feasibility studies and the feasibility report will include these principles.
Article 1 – The Company shall prepare the feasibility report using the method determined for division of expenses.
However, after the completion of the expense allocations procedures, the company shall submit a proposal to form a commission consisting of representatives from the Ministry, concerned institutions and the Company shall investigate the expense allocation procedures and see that all concerned reach an agreement. The feasibility report shall be concluded in accordance with this agreement.
Article 2 – After construction is completed, a commission formed by the Ministry according to the procedures provided for in Article 1 shall correct the division of expense procedures in accordance with final expenses and the principles in Article 15.
