Source text - English Company XYZ and the Contractor acknowledge that by means of their business relationship they will have access to and become familiar with the confidential information, product development, and trade secrets including, but not limited to, processes, product specifications, prices, production costs, enhancements, adaptations, computer processes, customer lists, customer contact information, employee data und financial information regarding Company XYZ or Contractor, and new or proposed translations, information of third parties contained in transferred documents, work or products together with other information of a proprietary or confidential nature. The preceding defines Confidential Information.
Company XYZ and the Contractor agree not to disclose any Confidential Information either during or after the commercial relationship, and will not at any time during or subsequent to this Agreement disclose or use in any way any confidential information or knowledge or data received while working with Company XYZ or Contractor, unless necessary to execute their mandate to the other party.
Company XYZ and Contractor agree not to go around and circumvent or bypass or obviate each other, directly or indirectly, nor attempt to circumvent this Agreement in an effort to gain or save fees, commissions, remuneration's or considerations to the benefit of one of the parties to this Agreement. The parties also undertake not to make use of a third party, irrespective of their form, to circumvent this clause and circumvent each other.

Firma XYZ und der Auftragnehmer stimmen überein, keine vertraulichen Informationen weiterzugeben, weder während noch nach Beendigung ihrer geschäftlichen Beziehung und sie werden auch zu keiner Zeit während dieser Vereinbarung oder nachfolgend irgendwelche vertraulichen Informationen oder Wissen oder erhaltene Daten weitergeben, während die Zusammenarbeit mit Firma XYZ oder dem Auftragnehmer anhält, sofern dies nicht notwendig wird, um ihr Mandat einer anderen Partei gegenüber zu erfüllen.
Firma XYZ und der Auftragnehmer stimmen überein, sich gegenseitig weder direkt noch indirekt zu umgehen, übergehen oder hintergehen, noch zu versuchen, diese Vereinbarung zu umgehen mit der Absicht, Gebühren einzusparen, Provisionen, Vergütungen oder Gegenleistungen zugunsten einer der beiden Parteien dieser Vereinbarung zu erhalten.
Die Parteien werden sich ebenfalls verpflichten, keine dritte Partei, ungeachtet ihrer Form, zu benutzen, um diese Klausel oder einander zu umgehen.

Verbraucher sehnten sich vor allem bei Massengütern nach Individualität und einer persönlichen Note. Es gehe darum, alle Sinne der Kunden anzusprechen. In der Regel haben Hersteller jedoch wenig Einfluss auf die Präsentation ihrer Produkte in den Verkaufsstätten. Millard Brown rät deshalb, einzigartige Kaufumgebungen zu schaffen, die den Aufbau von Kundenloyalität erleichtern. Dies kann ein spezielles Regal im Ladengeschäft sein oder die Lieferung des Produkts zum Kunden nach Hause.
Eigene Shops böten die Möglichkeit, den persönlichen Kontakt zwischen Hersteller und Endkunde herzustellen. Gastfreundlichkeit, Service und Vertrauen verbesserten die Markenwahrnehmung. Beispiele für erfolgreiche Shops seien Marken wie Nike, Apple oder Nespresso. Diese Firmen hätten anfangs über Intermediäre angeboten und seien schließlich erfolgreich dazu übergegangen, eigenständige Läden aufzubauen. Eine Alternative seien Micro Stores, kleine Nischen in großen Kaufhäusern, in denen eigene Markenwelten geschaffen werden können.

Micro Stores, small niches, in which own brand worlds can be created are an alternative, the study suggests.
