Più che il senso dell'espressione in sé, mi sorprende quello di tutto il periodo: sta bene che gli stivali Anouk si differenzino in più punti percepibili dal disegno o modello comunitario impugnato, ma cosa può significare che [detti stivali] si differenzino anche dai diritti di proprietà intellettuale (o dai diritti di tutela) su cui il richiedente si è basato in occasione della causa di Milano? Mi sembra un discorso sconnesso...

"Das Mailänder Gericht hat nur die Aussage getroffen, dass nach italienischem Recht angeblich ein Urheberrecht an den Moon Boots der Antragstellerin bestehe. Ein angebliches Urheberrecht der Antragstellerin an den Moon Boots nach italienischem Recht ist aber nicht Gegenstand des vorliegenden Nichtigkeitsverfahrens.
